AN ORDINANCE RELATING TO TRAILER OR
MOBILE HOME PARKS; ADOPTING MINIMAL
REQUIREMENTS FOR TRAILER PARKS OR
MOBILE HOME PARKS WITHIN THE CITY OF
EDGEWATER, FLORIDA; PROVIDING FOR
APPLICATIONS FOR LICENSES TO OPERATE
TRAILER PARKS OR MOBILE HOME PARKS;
SETTING•FORTH A LICENSE FEE SCHEDULE;
PROVIDING PENALTIES FOR VIOLATIONS OF
THIS ORDINANCE; AND PROVIDING AN
EFFECTIVE DATE THEREFOR.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER,
FLORIDA:
SECTION 1. Application for license or permit;
prerequisites.
Any applicant for a license or permit to operate a
trailer park or mobile home park must submit a detailed
plot plan to the City Council of the City of Edgewater,
Florida, along with said application for a license or per-
mit to operate said trailer park or mobile home park. The
application for alicense or permit to operate a mobile home
park or trailer park shall thereupon be withheld for a period
of ten (10) days from said application to the City in order
that the Building Inspector may determine the location of the
park, elevation, rights of ingress and egress, and the size
of the plot of ground to be encompassed by said park. The
Building Inspector shall, as soon as practicable after the
ten day period set forth herein, make recommendations to the
City Council advising whether the application for a license
or permit shall be accepted or rejected. Thereupon, it shall
be the duty of the City Council to consider the application,
the plot plan and the recommendations of the Building Inspector
and thereupon either accept or reject said recommendation,
and either give or deny the applicant a license or permit.
SECTION 2. Minimal requirements.
(1) All streets within any trailer park or mobile
home park in the City of Edgewater, Florida are
required to be at least 18 feet wide and shall be
paved with a suitable topping approved by the City
Council. All streets must be provided with adequate
drainage facilities. No street shall be obstructed
in any way so as to hinder or block emergency
vehicles, including but not limited to fire trucks,
police vehicles and ambulances.
(2) Streets and park area are to be illuminated
properly all night.
(3) All trailer parks or mobile home parks must
contain a minimum number of trailer spaces which
shall be no less than forty (40); provided further,
that this provision shall not apply to the expansion
or extension of any existing trailer parks. The
size of the plot for each trailer shall contain no
less than 3,500 square feet, and no side of any
trailer plot or space shall be less than 40 feet.
(4) No trailer in any trailer park or mobile
home park shall be closer than SO feet from the
nearest edge of a public dedicated street, and
no trailer shall be closer than 6 feet to any
plot line for that particular trailer space.
(5) All electrical wiring to the trailer shall be
done under ground and shall comply with the National
Fire Protection Association Electrical Code, as
amended.
(6) All plumbing within any trailer park or
mobile home park shall comply with the Southern
Standard Plumbing Code, as amended.
(7) The owner or operator of any trailer park or
mobile home park is required to install a sewage
system within said park and shall also be required
to hook into and use the city sewage system where
available, as defined by Ordinance No. 538 and
amendments thereto of the City of Edgewater, Florida.
Any owner or operator of a trailer park or mobile
home park shall bear the cost of hooking into the
said city sewage system. All said sewage systems
shall meet the specifications and requirements of
the Board of Health of the State of Florida. No
trailer park owner or operator shall be issued an
occupational license to operate a trailer park un-
less and until all requirements set forth herein are
met.
(8) The owner or opp rator of any trailer park or
mobile home park is required to install a water
system within said park and shall also be required
to hook into and use the city water system where
available, as defined by Ordinance No. 539 and amend-
ments thereto of the City of Edgewater, Florida.
Any operator or owner of a trailer park shall bear
the cost of hooking into said city water system.
All said water systems shall meet the specifications
and requirements of the Board of Health of the State
of Florida. No trailer park owner or operator shall
be issued an occupational license to operate a trailer
park unless and until all requirements set forth here-
in are met.
(9) There shall be at least one central toilet and
shower for each sex, where accommodations are
available for over night campers or trailers.
(10) City water shall be piped to each trailer with
not less than 3/4" piping.

(11) Each trailer space shall be numbered and
a directory shall be maintained at the office
of the trailer park or mobile home park which
shall contain the numbers of the various trailer
spaces and the names of the corresponding occupants
thereof.
SECTION 3. No occupational license to operate a trailer
park or mobile home park shall be issued until compliance
with all regulations and requirements as set forth above
and no occupational license to operate a trailer park or
mobile home park shall be issued unless and until a plot
plan of the proposed trailer park or mobile home park is
approved by the City Council.
SECTION 4. License Fees.
The owner or operator of a trailer park or mobile home
park shall be required to obtain an annual occupational
license tax for regulatory purposes and for the privilege
of operating a trailer park or mobile home park within the
City of Edgewater, Florida. The owner or operator of said
trailer park shall be liable for payment of said license
and said license year shall begin October 1 and end September
30 of the following year. All trailer parks or mobile home
parks shall pay for occupational licenses the following
amounts according to the following schedule:
1 to 9 trailer spaces ....... $25.00
10 to 19 trailer spaces ...... $35.00
20 or more trailer spaces .... $45.00.
The above stated license fees shall be due and payable on
October 1 of each year and failure to pay said occupational
license when due shall be considered a violation of this
Ordinance.
SECTION 5. Any person, firm or corporation owning or
operating a trailer park or mobile home park without a license
to do so, or who is found guilty of violating any of the pro-
visions of this chapter shall be subject, upon conviction, to
the penalties provided by Section 1-8 of the Code of Ordinances
of the City of Edgewater, Florida.

SECTION 6. That Ordinances No. 285, No. 550 and
No. 631 of the City of Edgewater, Florida be and the same
are hereby revoked and repealed effective as of the date
of the adoption of this Ordinance; provided however, that
the rights and obligations held by and imposed upon operators
or owners of existing trailer parks or mobile home parks shall
not be affected by the repeal of said Ordinances. The pro-
visions of any other Ordinances in conflict with the pro-
visions of this Ordinance shall likewise be repealed subject
however, to the vested rights and obligations of existing
trailer park or mobile home park owners or operators.
SECTION 7. Definitions.
A trailer park or mobile home awk shall be defined as
a vehicle used as sleeping or living quarters while in the
City of Edgewater, Florida, whether the same be mounted on
wheels or not and whether the same be propelled either by
its own power or by other driven vehicles to which it may
be attached. The City Council of the City of Edgewater shall
be the sole judge as to whether a structure, purported vehicle
or purported trailer or mobile home is in fact a trailer or
mobile home and subject to the provisions of this Ordinance.
SECTION 8. No person or persons shall be permitted to
live in or park a trailer or mobile home, as defined herein,
on any lot within the city unless the trailer is in a
recognized licensed trailer park; provided however, nothing
herein shall be construed so as to prohibit parking any
trailer or mobile home upon property zoned as a business
area noted as Commercial Zone B-1 for the wholesale and retail
sale of trailers and accessories, and an occupational license
for the sale thereof is first had and obtained from the City
Clerk. Any person found guilty of violating the provisions
of this section shall be subject to the penalties as provided
by Section 1-8 of the Code of Ordinances of the City of Edge-
water, Florida.

Nothing contained in this Ordinance shall prohibit
any person from maintaining what is commonly known as a
camper upon property other than a recognized and licensed
trailer park or mobile home park, or upon property zoned
Commercial B-1 for tte wholesale and retail sale of
trailers and accessories.
SECTION 9. This Ordinance shall take effect immediately
upon its passage by the City Council and approval by the
Mayor.
The above and foregoing Ordinance was read in full and
passed by vote of the City Council of the City of Edgewater,
Florida at a regular meeting of the said Council held on the
2nd day of March A.D., 1970. Upon motion duly made, seconded
and carried, the requirement of reading said Ordinance upon
second reading was waived and the Ordinance was ordered put
upon final passage.
