602ORDINANCE NO._61 AN ORDINANCE PROHIBITING SWIMMING OR WADING IN ANY FRESH WATER NATURAL OR ARTIFICIAL LAKES OR SHELL PITS WITHIN THE CORPORATE LIMITS OF THE CITY OF EDGEWATER, FLORIDA, DECLARING THE SAME TO BE A VIOLATION OF THIS ORDINANCE, PROVIDING A PENALTY FOR VIOLATIONS THEREOF AND PROVIDING AN EFFECTIVE DATE THEREFOR. WHEREAS, It has been determined by the City Council of the City of Edgewater, Florida that in order to promote and provide for the public health, safety and welfare the swimming or wading in any natural or artificial lakes or shell pits in the City should be discouraged and prohibited, for the reason that the said lakes and/or shell pits are not properly super- vised or protected and are inherently dangerous. NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That it shall be unlawful for any person or persons to swim or wade in any fresh water lake or shell pit, whether natural or artificially created, within the corporate limits of the City of Edgewater, Florida and the same is hereby prohibits. SECTION 2. That the swimming or wading in any fresh water lake or shell pit, either natural or artificially created, within the corporate limits of the City of Edgewater, Florida shall be a violation of this Ordinance. SECTION 3. That any person or persons violating this Ordinance shall, upon conviction thereof, be subject to the penalties provided in Section 1-8 of the Code of Ordinances of the City of Edgewater, Florida. SECTION 4. That all Ordinances or parts of Ordinances in conflict herewith be and the same are hereby rescinded. SECTION 5. That this Ordinance shall take effect immediately upon its adoption by City Council and approval by the Mayor. The above and foregoing Ordinance was read in full and passed by vote of the City Council of the City of Edgewater, Florida at a regular meeting of said Council held on the 1st day of July A.D., 1968. Upon motion duly made, seconded and carried, the require- I.. ment of reading said Ordinance upon second reading was waived and the Ordinance was ordered put upon final passage.
