AN ORDINANCE AMENDING ORDINANCE NO. 571
RELATING TO BID OF SANITARY ENGINEERING
COMPANY OF ORMOND BEACH, FLORIDA TO EXTEND
SEWER LINES PURSUANT TO THE 1967 SEWER
EXTENSION PROGRAM OF THE CITY OF EDGEWATER,
FLORIDA, AUTHORIZING AN ADJUSTMENT IN THE
TOTAL CONTRACT PRICE, AUTHORIZING PAYMENT OF
THE BALANCE DUE SAVE AND EXCEPT FOR $1,000.00
TO BE WITHHELD PENDING ADJUSTMENT OR REPAIRS
BY THE SAID SANITARY ENGINEERING COMPANY TO
PROPERTY OWNERS AFFECTED BY THE SAID SEWER
EXTENSION PROGRAM, AND AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE A CHECK OR DRAFT
TO THE SAID SANITARY ENGINEERING COMPANY IN
THE AMOUNT OF $10,327.75.
WHEREAS, the City Council of the City of Edgewater did on
September 4, 1967 accept the bid of Sanitary Engineering Company
of Ormond Beach, Florida to extend sewage lines pursuant to the
1967 sewer extension program of the City of Edgewater, Florida
in the amount of $56,613.00, and
WHEREAS, the said contract was based on a unit price, the
exact quantity of materials to be used being unknown at the time
of submission of said bid, and
WHEREAS, the work has been completed by the said Sanitary
Engineering Company pursuant to the contract entered into, save
and except for certain adjustments or repairs which the City
Council feels are due to property owners in the City of Edgewater,
Florida, and
WHEREAS, the total price for the work completed in extending
the sewage lines, pursuant to the 1967 sewer extension program,
is the sum of $64,659.70, as per Change Order No. 1 heretofore
entered into between the said company and the City Council, and
final adjustment, and
WHEREAS, the said Sanitary Engineering Company has been paid
to date the sum of $52,186.95, and
WHEREAS, the City Council feels that the Sanitary Engineering
Company is due as and for final payment the sum of $12,472.75,
less money owed the city by the said company for one load of fill
too",
at $10.00, twenty-nine hours labor and grader at $15.00 per
hour, or $435.00, sixteen hours man hand labor at $2.50 per
hour, or $40.00 and as liquidated damages as per the contract
twenty-two days at $30.00 per day, or $660.00, for a total
credit against the said sum of $12,472.75 of $1,145.00, and
WHEREAS, the City Council feels that the adjusted net
amount due Sanitary Engineering Company of Ormond Beach is
the sum of $11,327.75 from which shall be withheld or retain-
ed until certain adjustments or repairs are made to property
owners the sum of $1,000.00.
NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
EDGEWATER, FLORIDA:
SECTION 1. That Section 1. of Ordinance No. 571 be and
the same is hereby amended to read as follows:
SECTION 1. That the competitive bid of Sanitary
Engineering Company, Inc. of Ormond Beach,
Florida to do and complete the 1967 sever
extension program by the City of Edgewater,
Florida as per specifications for the total
sum of $64,659.70, be and the same is hereby
accepted.
SECTION 2. That the city, having paid to date pursuant
to the said contract the sum of $52,186.95 leaving a balance
due the said Sanitary Engineering Company of $12,472.75 and
from the said amount the city having deducted the sum of $1,145
as amounts owdd by Sanitary Engineering Company to the city,
and having ascertained that the net adjusted amount due Sanitary
Engineering Company of Ormond Beach as and for final payment is
the sum of $11,327.75, from which the sum of $1,000 be and the
same shall be withheld until certain adjustments or repairs are
made by Sanitary Engineering Company to property owners in the

City of Edgewater, Florida, the Mayor and City Clerk be and
they are hereby authorized to execute a check or draft of
the City of Edgewater, Florida to Sanitary Engineering
Company, Inc. of Ormond Beach, Florida in the amount of
$10,327.75.
SECTION 3. That when and if adjustments referred to
in paragraph 2 have been completed to the satisfaction of
City Council, the Mayor and City Clerk be and they are hereby
authorized to execute a check or draft on the City of Edge-
water, Florida to Sanitary Engineering Company of Ormond
Beach, Florida in the amount of $1,000.00.
SECTION 4. That all ordinances or parts or ordinances
in conflict herewith be and the same are hereby repealed.
SECTION 5. That this ordinance shall take effect
immediately upon its passage by the City Council and approval
by the Mayor.
The foregoing ordinance was read in full and passed by
vote of the City Council of the City of Edgewater, Florida at
a Special Meeting of said City Council held on May 16, 1968.
Upon motion duly made, seconded and carried, the require-
ment of reading said ordinance upon second reading was waived
and the ordinance was ordered put upon final passage.
Passed by vote of the City Council of the City of Edge-
water, Florida at a Special Meeting of said council held on
May 16, 1968, and approved as provided by law, the vote of said
Council being as follows:
