ORDINANCE NO. 599
AN ORDINANCE AMENDING SECTION 13 OF
ORDINANCE NO. 219, HERETOFORE ENACTED
ON JANUARY 19, 1959, AS AMENDED BY
SECTION 1. OF ORDINANCE NO. 346, HERE-
TOFORE ENACTED ON MARCH 18, 1963,
RELATING TO PETITIONS FOR CHANGE IN
ZONING CLASSIFICATION BY PROVIDING A
FEE OR CHARGE FOR THE COST OF PROCESS-
ING THEREFOR AND BY PROVIDING THAT
PETITIONS FOR CHANGE IN ZONING CLASS-
IFICATION SHALL NOT BE RE -SUBMITTED
TO THE CITY COUNCIL OR ZONING BOARD
OF THE CITY OF EDGEWATER, FLORIDA
UNLESS AND UNTIL ONE YEAR HAS ELAPSED
FROM THE DATE OF FILING THE ORIGINAL
OR PRIOR PETITION FOR CHANGE .IN ZONING
CLASSIFICATION UNLESS THE RE -PETITION
IS BASED UPON A CLEAR CHANGE IN CIRCUM-
STANCES, AND PROVIDING THAT THE ZONING
BOARD SHALL BE THE JUDGE AS TO WHETHER
A CLEAR CHANGE OF CIRCUMSTANCES EXISTS
UPON A RE -PETITION WITHIN ONE YEAR; AND
PROVIDING THAT THE RECOMMENDATION OF THE
ZONING BOARD THAT A CLEAR CHANGE IN
CIRCUMSTANCES DOES NOT EXIST CAN BE
OVERRIDDEN ONLY BY THE VOTE OF THREE
COUNCILMEN; AND PROVIDING AN EFFECTIVE
DATE THEREFOR.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA:
SECTION 1. That Section 13 of Ordinance No. 219, heretofore
enacted on the 19th day of January, 1959, as amended by Section 1.
of Ordinance No. 346, heretofore enacted on the 18th day of March,
1963, be and the same is hereby amended to read as follows, to -wit:
SECTION 13. CHANGE IN CLASSIFICATION. Any person
owning property located in the City of Edgewater, Florida,
desiring to effect a change in the classification thereof
as prescribed and limited under the Zoning Ordinance of
the City of Edgewater, Florida or amendment thereto, shall
proceed in the following manner, to -wit: Such person shall
file with the City Council of the City of Edgewater, Florida,
at any regular session thereof, or with the Clerk of the
City of Edgewater, Florida, during office hours, a petition
directed to the City Council of the City of Edgewater,
Florida, wherein property sought to be reclassified shall
be described fully and accurately. Such drojRipi:ton'--
shall set forth any improvement located on said proper

petition shall set forth the classification desired by the
owner; such petition shall state in short and concise language
the reason of the petitioner in asking the reclassification of
such property, and shall be signed by the owner of the land or
some person duly authorized by such owner to sign such petition.
The authority authorizing the person other than the owner to
sign such petition shall be attached to and accompany such
petition. Each petition shall be accompanied by a payment of
Two and 50/100 ($2.50) Dollars to be placed in the General Fund
of the City of Edgewater, Florida, and such owner of the land
shall, in addition thereto, be obligated to reimburse the City
the cost of publication and the cost of letters and any other
administrative cost incurred by the City, in compliance with
Ordinance No. 487, enacted on June 6, 1966.
No person owning property located in the City of Edgewater,
Florida, after having once petitioned for a change in classi-
fication of zoning of a particular piece of property,9.shall
re -petition for such change in classification until one (1)
year has elapsed from the date of the prior or original petition,
unless there is a clear showing of change in circumstances
sufficient to justify the consideration of the petition. The
Zoning Board shall be the sole judge as to whether a clear
change in circumstances does in fact exist if a petition is
re -filed within one year. The recommendation of the Zoning
Board that there is or is not a clear change in circumstances
can be overridden by the City Council only upon the affirmative
vote of three (3) members of said City Council.
SECTION 2. That all Ordinances or parts of Ordinances
in conflict herewith be and the same are hereby repealed.
SECTION 3. That this Ordinance shall take effect
immediately upon its passage by the City Council and approval
by the Mayor.
The above and foregoing Ordinance was read in full and
passed by vote of the City Council of ttMTFity of Edgewater,
Florida at a regular meeting held on thdiY61h day of May A.D.,
1968, and approved as provided by law.
Upon motion duly made, seconded and carried, the require-
ment of reading said Ordinance upon second reading was waived
and the Ordinance was ordered put upon final passage.
Passed by vote of the City Council of the City of Edgewater,
Florida at a regular meeting of said Council held on the 6th day
of May A.D., 1968 and approved as provided by law; the vote of
said Council upon roll call being as follows:
