487ORDINANCE NO. 487 AN ORDINANCE AMENDING SECTION 15 OF NUMBER 219 IN REFERENCE TO PETITION FOR REZONING BY CITY COUNCIL TO ZONING AND PLANNING BOARD,SO AS TO PROVIDE FOR MORE ADEQUATE NOTICE TO ADJOINING, ABUTTING AND AFFECTED PROPERTY OWNERS. WHEREAS, it has been recommended by the zoning and planning boar of the City of Edgewater, Florida that Section 15 of Ordinance Number 219 is inadequate as regards notice to affected property owners upon an application for a change in zoning in that the present ordinance provides only for notification to affected property owners by publication in the City of Edgewater, Florida, and WHEREAS, the zoning and planning board of the City of Edgewater, Florida has indicated that the said publication does not give adequate notice to affected property owners and that additional notification should be provided so that all property owners who are or may be affected by a change in zoning will have an opportunity to be heard, and WHEREAS, the City Council of the City of Edgewater, Florida concurs in the recommendation of the zoning and planning board of the City of Edgewater, Florida and the said City Council feels that it is desirable and fair to provide every reasonable safeguard in the form of notice to affected property owners upon a petition for change in classification of zoning, and WHEREAS, it is felt that not only should publication be made setting forth the time and place of such hearing on petition for change in classification but that each affected property owner should be notified by letter. NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA, THAT SECTION 15 OF ORDINANCE NUMBER 219 BE AMENDED SO AS TO READ AS FOLLOWS: Section 1. Upon referring of a petition for rezoning by the City i Council to the zoning and planning board, the zoning and planning board shall call a public hearing of the abutting and/or adjoining and/or affected property owners in accordance with the following: (a) If less than a city block be involved, where the portion petitioned for rezoning is a corner, the legal and/or equitable owner of the property for one (1) block on both sides of the intersecting streets from that corner must be notified as more particularly set forth hereinafter. (b) If less than a city block be involved, where the portion petitioned for rezoning is not a corner, legal and/or equitable owners of the property along the street on which the petitioned property lies for a distance of three hundred (300) feet in a.I directions from the property sought to be rezoned must be notified as more particularly set forth hereinafter. (c) If a city block or more is involved the legal and/or equitable owners of the property lying for a distance of one (1) block surrounding the property sought to be rezoned must be notified as more particularly hereinafter set forth. At least fifteen (15) days notice of time and place of such hearing as above set forth shall be published in a newspaper of general circulation in the City of Edgewater, Florida and in addition the City Clerk shall by form letter carrying the name and address of the zoning and planning board chairman, send said letter by certified mail to all legal and/or equitable property owners as described in subsections (a), (b) and (c) of this amended ordinance which amends Section 15 (a), (b) and (c) of Ordinance Number 219. The said letter shall provide at least fifteen (15) days notice of the timeandplace of the hearing to the legal and/or equitable property owners as above set forth. The said publication and the said letter shall include the zoning change or changes requested, the party or parties requesting the same, the date, time and place of the public hearing. The cost of the said publication and the cost of the said letter shall be borne by the applicant or applicants. Section 2. All ordinances or parts of ordinances in conflict herewith be and the same are hereby rescinded. Section 3. This ordinance shall take effect immediately upon its passage and approval by the Mayor. The above ordinance was read in full and passed by unanimous vote of the City Council of the City of Edgewater, Florida at a regular meeting of said City Council held on the `�" day of June 1966. Upon motion duly made, seconded and carried, the requirement of reading said ordinance upon second reading was waived and the ordinance was put upon final passage.
