AN ORDINANCE SUPPLEMENTING SECTION
10. 1 OF THE CITY CODE BY ADDING THERETO
SECTION 10. 1 - A, SETTING FORTH PREREQUISITE
FOR SANITATION PERMITS, ITS ISSUANCE, POSTING
AND REVOCATION.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA:
SECTION 1. That the City of Edgewater, Florida hereby adopts
Chapter 170C - 16 - Food Service, Chapter 170C-17 - Food Processing, and
Chapter 170C-18 - Food outlets of the Florida State Sanitary Code, a chapter of
the Florida State Board of Health Rules and Regulations, filed with the
Secretary of State, June 3, 1962.
SECTION 2. Permit prerequisite to operation, issuance, revocation,
and display.
(1) No food service, food processing, or food outlet establishment
as set forth in Chapters 170C-16-17-18 of the Florida State Sanitary
Code shall be operated or maintained in UP city until a Sanitation
Permit for the operation and maintenance of such establishments
has been obtained from the Health Officer or his authorized
representative.
(2) The permit shall be issued annually without charge to the owner
or operator of any food service, food processing or food outlet
establishment in the city operating and maintaining such an
establishment in compliance with the terms of this ordinance for
which an occupational license has been obtained.
(3) All Sanitation Permits shall be displayed prominently and
conspicuously with the City License in the establishment for which
the permit and license are issued.
(4) Sanitation Permits are revocable by the Health Officer or his
authorized representative for violation ofeany,-ofhttwMf ents

of this ordinance. Written notice of such revocation, together
with the list of violations signed by the Health Officer or his
authorized representative, and shall be served upon the owner or
manager of the establishment by a member of the City Police
Department, and a copy thereof shall be filed with the City Clerk.
No food service, food processing or food outlet establishment
shall be operated as such an establishment after its permit has
been revoked as stated.
SECTION 3. Additional Requirements:
(1) All food service, food processing and food outlet establishments
shall comply with the requirements as set forth in the applicable
chapters mentioned before of the Florida State Sanitary Code, and
any future amendments or revisions thereto.
(2) Any additions or renovations to any of the above mentioned
establishments shall submit detailed drawings of plans to the health

department and the building and inspection department for approval
prior to the start of any construction.
SECTION 4. Enforcement, inspections and right of entry:
(1) It shall be the duty of the Health Officer or his authorized
representative to enforce the terms of this ordinance and to
lconduct inspections in all such establishments in the city as often
as necessary to determine compliance.
(2) The Health Officer or his authorized representative shall have
the right of entry to any food service, food processing or food outlet
establishment that is open for business and shall have access to all
parts of the said establishments to examine and inspect the premises
including all equipment and facilities therein. It shall be unlawful
for the owner, operator, manager or any employee of the sOID

SECTION 5. Penalty for violation of provisions:
Any person, persons, firm or corporation acting either as owner,
manager or employee of a food service, food processing or food
outlet establishment who shall be guilty of a violation of this
ordinance shall upon conviction in the municipal court be
punished pursuant to Section 1 - 8 of the City Code, of the City of
Edgewater, Florida.
SECTION 6. All ordinances or parts of ordinances in conflict
herewith be, and the same are hereby repealed.
SECTION 7. This ordinance shall take effect immediately upon its
passage and approval of the Mayor.
The above ordinance was read in full and passed by vote of the City
Council of the City of Edgewater, Florida, at a regular meeting of said
Council held on the 7th day of March , 1966.
Upon motion duly made, seconded and carried, the requirement of
reading said ordinance upon second reading was waived and the ordinance
was ordered put upon final passage.
Passed by vote of the City Council of the City of Edgewater, Florida,
at a regular meeting of said Council held on the 7th day of March
1966, and approved as provided by law, the vote of said Council being as follows:
