452ORDINANCE N0. 452 AN ORDINANCE AUTHORIZING THE PAVING OF CERTAIN STREETS IN THE CITY OF EDGEWATER, VOLUSIA COUNTY, FLORIDA BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That the City of Edgewater, Florida, will pave theAw following streets within the City of Edgewater, to -wit: Coco Palm Drive (from Indian River Blvd. to Azalea) Magnolia Avenue Neptune Drive Valencia Drive New York Avenue Wilkinson Drive SECTION 2. That the County Commissioner of District No. 5, Volusia County, Florida, will bear the cost of equipment and labor for the above mentioned paving, and that the cost of material for said paving will be prorated one third each to the abutting property owners on both sides of the streets, and the remaining one third to be paid by the City of Edgewater, Florida. SECTION 3. That immediately upon determination as to the cost of said paving material, the abutting property owners shall be billed for their proportionate share, which may be paid in the following manner: (a) Without interest if said bill is paid within 30 days of billing. (b) In the event said paving bill is not paid within 30 days from date of billing, arrangements may be made by the property owner, or owners, with said City wherein the bill may be paid on an installment basis within one year from date of billing, with interest charged thereon at the rate of b% per annum. SECTION 4. That in the event said paving bill is not paid by any person, or persons, and in lieu of compliance with Section 3. item B above, within 30 days after billing date said property is subject to a lien for the amount owed, plus 6% interest, and said interest rate shall continue until the paving bill has been paid in full. SECTION 5. That all ordinances or parts of ordinances in conflict herewith be, and the same are hereby repealed. SECTION 6. That this ordinance shall take effect immediately upon its passage and approval by the Mayor. The above Ordinance was read in full and passed by vote of the City Council of the City of Edgewater, Florida, at the regular meeting of said council held on October 18, 1965. Upon motion duly made, seconded and carried, the requirement of reading said Ordinance upon second reading was waived and the Ordinance was ordered put upon final passage.
