2018-R-24 - FDEP & St Johns permit reduction RESOLUTION NO.2018-R-24 A RESOLUTION OF THE CITY OF EDGEWATER, FLORIDA REQUESTING THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION AND THE ST. JOHN'S RIVER WATER MANAGEMENT DISTRICT TO REDUCE PERMIT APPLICATION FEES; REQUESTING A REDUCTION OF THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION ANNUAL WASTEWATER REGULATORY AND SURVEILLANCE FEE FOR FISCAL YEAR 2018-2019; REQUEST OTHER APPLICABLE FEE REDUCTIONS OR WAIVERS NOT SPECIFICALLY DESCRIBED; REPEALING RESOLUTIONS IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY AND APPLICABILITY AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the requirements contained in Chapter 218.075, Florida Statutes, allows a reduction or waiver of permit processing fees for municipalities with a population of 25,000 or less and certification by that municipality that the cost of permit processing fee is a fiscal hardship;and WHEREAS, the City of Edgewater certifies that it is a municipality with a population of 25,000 persons or less; and WHEREAS,the City of Edgewater further certifies that it qualifies for permit processing fee reductions and waivers for the Fiscal Year beginning October 1, 2018 through September 30, 2019 due to the following factor(s): per capita taxable value is less than the statewide average for the current fiscal year. NOW, THEREFORE, be it resolved by the City Council of the City of Edgewater, i Florida: i r Section 1. The City Council hereby authorizes staff to request that the Florida Department of Environmental Protection and the It. John's River Water Management District reduce their permit application fees for public purpose projects for which the City of Edgewater 1 #2018-R-24 is a permit applicant to a fee of$100.00 per permit, or if the current permit application fee is less than $100.00 by 50%, for the Fiscal Year beginning October 1, 2018 and ending September 30, 2019. Section 2. The City Council hereby authorizes staff the City Manager or his designee to request that the Florida Department of Environmental Protection reduce their Annual Wastewater Regulatory and Surveillance Fee to zero dollars ($0.00) for the Fiscal Year beginning October 1,2018 and ending September 30,2019. Section 3. The City Council hereby authorizes staff the City Manager or his designee to request that the Florida Department of Environmental Protection reduce or waive other applicable fees not specifically listed herein for the Fiscal Year beginning October 1, 2018 and ending September 30,2019. Section 4. Conflicting Provisions. All resolutions or parts of resolutions in conflict herewith are hereby repealed. Section 5. Severability. If any portion of this resolution is for any reason held or declared to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this resolution. If this resolution or any provisions thereof shall be held to be inapplicable to any person, property or circumstance, such holding shall not affect its applicability to any other person, property or circumstance. Section 6. Adoption and Effective Date.
