AN ORDINANCE OFNTHE CITY OF B GEWATER, VOLUSAA ���
COUNTY, FLORIDA, PROVIDING FOR THE AMENDMENT
OF ORDINANCE NO. 337 BY AMENDING SUB -PARAGRAPH
E OF SECTION 1 DEFINING RESIDENCE, SECTION 2
THEREOF DEALING WITH SERVICE CHARGES, SECTION 6
THEREOF DEALING WITH PREPARATION OF TRASH, AND
SECTION 7 THEREOF DEALING WITH LOCATION OF
CONTAINERS; REPEALING ALL ORDINANCES AND PARTS
OF ORDINANCES IN CONFLICT HEREWITH; AND PRO-
VIDING WHEN THIS ORDINANCE SHALL TAKE EFFECT.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA:
SECTION 1. That Sub -paragraph (e) of Section
1 of Ordinance No. 337 is amended to read as follows:
11(e) Residence. The word "residence" shall apply
to a s ng e TWly unit. Structures having a
multiplicity of living units shall be counted as
many residences as there be separate living units."
SECTION 2. That Section 2 of Ordinance No.
337 be and it is amended to read as follows:
"SECTION 2. Service Charge. The City of Edgewater
s a ma ntain and operate a service for the col-
lection and disposal of garbage and trash and all
persons, firms, or corporations whose premises are
served thereby shall pay to the said City for the
use of such service on the basis of the following
rates:
Residence
- $1.50 per unit.
Motor Courts
- $1.50 for motor courts with 5
units or Less;
$3.00 for motor courts with more
than 5 units.
Businesses
- $1.50 where the owner lives upon
the premises, such as beauty parlors,
real estate, insurance, contractors,
etc.;
$3.00 for gas stations with or without
living quarters and other businesses
not included in any other category
herein.
Trailer Parks
- $1.00 per trailer whose garbage and
trash is deposited in a central loca-
tion;
$1.50 per trailer where garbage and
trash is deposited other than in a
central location. The owner of a
trailer park shall be billed on the
above basis. Each owner of a trailer

park shall declare the number of
occupied trailers in their park once
each month and shall furnish this
information to the City at the City
Hall on or before the 15th of each
month. The City may at any time,
through its employees, check the use
of said park and if there is a dis-
crepancy between the owners declara-
tion of use and the check thereof by
the City, the City*s check will prevail
except that any owner may present evi-
dence to support his declaration at the
next succeeding City Council meeting
after receiving notice of said discre-
pancy. At such meeting or any adjourn-
ment thereof, the Council after hearing
all the evidence shall decide the correct
number of units for which said trailer
park is to be charged for the month in
question. where no declaration is filed
as required, the trailer park shall be
billed on the basis of the maximum number
of trailers which said park can accommo-
date as laid out.
Multiple family dwellings or structures - The owner shall
be billed. $1.00 per living unit where
garbage and trash is deposited in a cen-
tral location; $1.50 per living unit where
garbage and trash is deposited other than
in a central location.
Said fee shall be collected by the City of Edgewater, by
affixing the same to the monthly statements for the use
of water, providing however, that separate statements shall
be rendered to all persons, firms or corporations which do
not receive a monthly water statement. The above stated
fee shall be payable in advance, the first of said payments
being due and payable as billed It is
expressly provided, however, that the above escr bed rates
shall not affect those persons, firms or corporations who
have paid their garbage and trash fees in advance and that
the accounts paid in advance shall remain good and valid
on the basis of former rates until expiration of said advance
payments, after which the said person, firm or corporation
shall then commence paying the above mentioned rates. No
advance payments at the present rates shall be accepted
after the reading of this ordinance.
The charges and fees made by this ordinance are due
and payable for this service and its availability to the
user, whether such service is used or not."
SECTION 3. That Section 6 of Ordinance No.
337 is amended to read as follows:
"SECTION 6. Preparation of Trash. All trash other than
tree ii=s shall be placed in containers for the purpose
of being picked up. Tree limbs shall be neatly stacked
in piles not exceeding four (4) feet in height., four (4)
- 2 -
feet in width, or eight (8) feet in length. Trash
which is not prepared as required herein will not be
picked up. No more than one stack of limbs of the
above dimensions or more than one 20-gallon container
of trash shall be prepared for pick-up at any one
time. Trash over this amount shall be arranged for
pick-up by a contractor at the owner's expense."
SECTION 4. Section 7 of Ordinance No. 337
Is amended to read as follows:
"SECTION 7. Location of Containers. Garbage cans
anref asi' containers when not in use shall be kept
away from the front of any building. No garbage or
trash containers shall be kept or maintained upon
or adjacent to any street, sidewalk, parkway, or
front yard, and shall not be placed within five
(S) feet of the property line. No garbage can or
trash container shall be deposited upon any ad-
joining lot or premises, whether vacant or improved,
occupied or unoccupied, or in any street, alley or
park in the City. Trash not required to be in trash
containers, and trash containers filled for pick-up,
may be neatly placed near, but not upon, the roadway
so as to be convenient and accessible for collection."
SECTION S. All ordinances or parts of
ordinances in conflict herewith be and the same are hereby
repealed.
SECTION 6. That this ordinance take
effect immediately upon its passage and approval by the
Mayor.
The above Ordinance was read in full and
passed by unanimous vote of the City Council of the City of
Edgewater, Florida, at the regular meeting of the Council
held on July 15th, 1963
Upon motion duly made, seconded and
carried, the requirement of reading said ordinance upon second
reading was waived and the Ordinance was ordered put upon
final passage.
Passed by vote of the City Council of the
City of Edgewater, Flo:ida, at the regular meeting of said Council
on the 15th day of July , 1963, and approved
