306... — ORDINANCE #306 — --1 AN ORDINANCE TO PROVIDE FOR THREE CLASSES OF GENERAL CONTRACTORS TO BE DESIGNATED AS CLASS A GENERAL CONTRACTORS; CLASS B GENERAL CONTRACTORS AND CLASS C.GENERAL CONTRACTORS; AND DEFINING SAID CLASSES; PROVIDING EXAMINA- TION FEES FOR GENERAL CONTRACTORS. IN CLASS A, GLASS B, AND CLASS C; DESIGNATING CHIEF BUILD- ING OFFICIAL AS CHIEF EXAMINER OF GENERAL CON- TRACTORS; PROVIDING FOR REGULAR MEETINGS OF THE CHIEF EXAMINER OF GENERAL CONTRACTORS; AND PROVIDING THE TIDE AND METHOD OF GIVING EXAMINA- TIONS FOR GENERAL CONTRACTORS; PROVIDING COMITY BETWEEN MUNICIPALITIES AND CITIES USING SIMILAR TESTS. BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA. Section 1. Classes of General Contractors There is hereby created three classes of General Contractors to be known as Class A General Contractors, Class B General Contractors, and Class C General Contractors. Class A General Contractors shall be permitted to do all types of building construction in the City. Class B General Contractors shall be permitted to build, alter, repair or make additions to single or double family residences only and build- ings accessory thereto andcustomarily incidental and subordinate thereto. Class C General Contractors shall be permitted to build small commercial buildings not exceeding five thousand square feet in size. Section 2. Chief Building Official designated Chief of Examiners -- Meetings. (a) There is hereby appointed and designated a Chief of Examiners of General Contractors who shall be the Chief Building Official of the City of Edgewater, Florida. (b) Said Chief of Examiners of General Contractors shall conduct regular examinations on the fourth Monday in the months of January, April, July and October of each year. Special examinations may be called at any time by the Chief of Examiners upon the request of the City Council of the City of Edgewater, Florida. Section 3. Same - Examination of Applicants (a) The Chief of Examiners of Gen on � r shall examine all applicants desiring to work at the trade or business of DATE y/ BY .0 30 6 general contracting or general construction in the city either as Class A General Contractors, Class B General Contractors, or as Class C General Contractors. (b) Applicants for the examinations hereinafter provided for shall be made to the Chief Building Official in writing on forms to be established and furnished by him and shall be accompanied by an application fee of Seventy-five 075.00) Dollars for Class A General Contractors, Seventy-five ($75.00) Dollars for Class B.General Contractors and Fifty ($50.00) Dollars for Class C General Contractors. (c) Each applicant shall submit to an examination in writing which shall be prepared and graded by the Building Department, General Extension Division, University of Florida, to test the quali- fications of the applicant to perform general contracting work in the City and the familiarity of the applicant with the Building Code and other laws and ordinances governing building construction in the city. (d) Regular examinations for both Class A General Con- tractors, Class General Contractors and Class C General Contractors shall be held on the fourth Monday in the months of January, April, July and October of each year. (e) Special Examinations may be authorized at any time by the Chief of Examiners upon the request of the City Council of the City of Edgewater, Florida, provided application therefor is made and the applicant deposits with said application the regular application fee together with all costs to be incurred by the city in the giving and grading of said special examinations. (f) All applications for any examination must be filed with the chief building official not less than two weeks prior to the date of the examination. (g) Applicant shall be required to answer correctly a minimum of seventy-five per cent (75) of the q� s/T s 110s,d examination to pass such examination. When applaan _ such examination and if satisfied with the competency of such applicants, the said chief of Examiners shall thereupon issue certificates of competency to such who have passed which certificates shall show that such applicants are qualified to apply for such licenses as may be required and to engage in or work at the business of general contracting either as Class A, General Contractors, Class B General Contractors or as Class C General Contractors, depending upon which of these examinations the applicant took. Section 4, Same - Granted without examination to certain persons. All persons now holding occupational licenses as general contractors in the city shall be issued a certificate of competency as a Class A General Contractor which shall be considered as a renewal of certificate of competency. Any person who has at any time subse- quent to January 1, 1962, held a general contractors license in the city and who now is in the armed forces or may hereafter become a member of the armed forces, and whose occupational license was valid and in effect at the time he entered the armed forces, shall, if appli- cation is made within six (6) months after his being discharged from the armed forces, be granted a certificate of competency as a Class A General Contractor as a renewal of certificate of competency upon payment of the occupational license. Section 5. Engaging in business, prerequsites It shall be unlawful for any person, firm or corporation not holding a certificate of competency as herein provided and an occupational license as a general contractor to work at or engage in or carry on the business of general contracting within the corporate limits of the city. It shall also be unlawful for any person, firm or corporation holding acertificate of competency as A Class B General Contractor to engage in any kind of construction except to build, alter, repair or make additions to single or double fam si lDly and buildings accessory thereto and customarily incidental and subordinate DATE thereto. It shall also be unlawful for any person, rm or coporation BY — holding a certificate of competency as a Class 0 GHneral Contractor ti.. to engage in any kind of construction except to build small commercial buildings not exceeding five thousand square feet in size. Section 6.That all Ordinances or parts of Ordinances in conflict herewith be and the same are hereby repealed. Section 7. That this Ordinance shall take effect immedi- ately upon its passage and approval by the Mayor. Section 8. Comity - In those cities and municipalities which use similar grading tests as provided by the General Extension Division, University of Florida, all licensed contractors in such cities and municipalities shall be granted the privilege to engage in the contracting business in the City of Edgewater, Florida, according to the licenses held by such contractor, by paying to the City of Edgewater, Florida, an occupational license fee according to the occupational ordinance of the City of Edgewater, Florida, without examination; pro- vided, however, that such cities and municipalities recognize licenses of contractors licensed to do business in the city of Edgewater, Florida. Section 9. Nothing herein containedshall be deemed to conflict with or repeal the present existing occupational licenses or the fee charged thereunder of the City of Edgewater, Florida. The above Ordinance was read in full and passed by unanimous vote of the City Council of the City of Edgewater, Florida, at the regular meeting of the Council held on March 19, 1962. Upon motion duly made, seconded and carried, the requirement of reading said Ordinance upon second reading was waived and the Ordinance was ordered put upon final passage. - Passed by vote of the City Council of the City of Edgewater, Florida, at the regular meeting of said Council on the 19th day of March, 1962, and approved as provided by law, the vote of .said Council being as follows: A+emu, �v Mayor Approved this /9 -d day of March, 1962.
