264REFS 344 PAGE 12 ORDINANCE NO. 264_ AN ORDINANCE VACATING THAT PART OF KUMQUAT DRIVE BETWEEN SIXTEENTH AND SEVENTEENTH STREETS IN FLORIDA SHORES, IN THE CITY OF EDGEWATER, VOLUSIA COUNTY, FLORIDA, AND PROVIDING FOR THE REVERSION OF THE ABANDONED PORTLON OF SAID KUMQUAT DRIVE TO THE ABUTTING PROPERTY OWNERS. IiIHEREAS, the City Council of the City of Edgewater, Florida, did on the 2nd day of May, 1960, pass a resolution entitled as follows, to -wit:- "A RESOLUTION DECLARING THE INTENTION OF THE CITY OF EDGEWATER, FLORIDA, TO VACATE THAT PART OF KUMQUAT DRIVE BETWEEN 16TH AND 17TH STREETS IN FLORIDA SHORES, AND PROVIDING FOR THE SERVING OF NOTICE UPON THE ABUTTING PROPERTY OWNERS, AND THE TIME AND PLACE AT WHICH OBJECTIONS CAN BE HEARD BEFORE THE CITY COUNCIL"; and', WHEREAS, In accordance with the aforesaid resolution, the abutting property owners on that portion of Kumquat Drive between 16th and 17th Streets, Florida Shores in the City of Edgewater, Volusia County, Florida, were served with true copies of said resolution as provided for by said resolution; and, WHEREAS, a hearing was held by the City Council of the City of Edgewater, Florida, on May 16, 1960 at 7:30 o'clock P. M. as provided for by said resolution for the purpose of hearing objections to the vacation of that part of Kumquat Drive between 16th and 17th Streets, Florida Shores, in the City of Edgewater, Volusia County, Florida; NOW, THEREFORE, BE IT ENACTED BY THE PEOPIE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That that part of Kumquat Drive between Sixteenth and Seventeenth Streets in Florida Shores in the City of Edgewater, Volusia County, Florida is hereby vacated and abandoned. -& •?Ga3 / RECS 344 PACE 1 3 l_ SECTION 2. Those portions of that part of Kumquat Drive lying between 16th and 17th Streets, in Florida Shores, Edgewater, Volusia County, Florida, shall revert to the abutting property owners as orovided by operation of law. SECTION 3. This ordinance is enacted pursuant to the provisions of Section 112, Chapter 27532, Laws of Florida, 1951. SECTION All ordinances or parts of ordinances in conflict herewith be and the same hereby are repealed. SECTION 5. This ordinance shall take effect immediately upon its passage and approval by the Mayor. The above ordinance was read in full and passed by vote of the City Council of the City of Edgewater, Florida, at a regular meeting of said Council on June 20, 1960. Upon motion duly made, seconded and carried, the requirement of reading said ordinance upon second reading was waived and the ordinance was ordered put upon final passage.
