253ORDINANCE NO. 253 AN ORDINANCE AMENDING S ECTIONS 5 AND 6 of ORDINANCE NO. 147 OF THE CITY OF EDGEWATER, FLORIDA, ENTITLED, "AN ORDINANCE PROVIDING FOR THE LICENSING OF ALL DOGS WITHIN THE OORPORATE LIMITS OF THE CITY OF EDGEWATER, FLORIDA, PROHIBITING DOGS FROM RUNNING AT LARGE WITHIN THE CORPORATE LIMITS DURING CERTAIN PERIODS, AND AUTHORIZING THE IMPOUNDING AND DESTRUCTION OF DOGS AND PROVIDING A PENALTY AND REPEALING ALL ORDINANCES 1N CONFLICT THEREWITH". 44,�A' BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: _w SECTION 1. That Section 5 of Ordinance No. 147 of the City of Edgewater, Florida, is hereby amended to read as follows: SECTION . IMPOUNDING. It shall be the duty of every police o car, poundmaster or duly designated official of the New Smyrna Beach - Edgewater Humane Society to apprehend any dogs found running at large contrary to the provisions of Section 4 and to impound such dog in the city pound or other suitable place. The poundmaster, (or some other designated officer) upon receiving any dogs, shall make a complete registry, entering the breed, color and size of such dog and whether licensed. If licensed, he shall enter thename and address of the owner and the number of the license tag. Licensed dogs shall be separated from unlicensed dogs. SECTION 2. That Section 6 of Ordinance No. 147 of the City of Edgewater, Florida, is hereby amended to read as follows: SECTION 6. NOTICE TO OWNERS FOR REDEMPTION. Not later than two days after impounding any dog, the owner shall be notified, or if the owner of the dog is unknown, a written notice shall be posted for two days at the City Hall in the City of Edgewater, Florida, describing the dog and the time and place of taking. The owner of any dog so impounded may reclaim such dog upon payment of the license fee, if unpaid, and of all costs and charges incurred by the City of Edgewater, Florida, for impounding and maintenance of said dog, or costs Incurred by the New Smyrna Beach - Edgewater Humane Society for board and maintenance. The following charges shall be paid: For impounding any dog $1.00 For keeping any dog .50 per day For giving notice to the owner 1.00 SECTION 3. That all ordinances or parts of ordinances in conflict herewith be and the same hereby are repealed. SECTION Lt. That thisordinance shall take effect immediately upon its passage and approval by the Mayor. The above ordinance was read in full and passed by vote of the City Council of the City of Edgewater, Florida, at a regular meeting held January 4, 1960. *-XSJ Upon motion duly made, seconded and carried, the requirement of reading said ordinance upon second reading was waived and the ordinance was ordered put upon final passage.
