222wE�5 184 PAA45 ORDINANCE NO. 222 AN ORDINANCE VACATING THAT PART OF FRANCES DRIVE ADJACENT TO AND WEST OF LOTS 5, 11, 18, 19 AND 20, INDIAN RIVER ESTATES, PER MAP IN MAP BOOK 8, PAGE 248, PUBLIC RECORDS OF VOLUSIA COUNTY, FLORIDA, AND PROVIDING FOR THE REVERSION OF THE ABANDONED PORTION OF SAID FRANCES DRIVE AS AFORESAID TO THE ABUTTING PROPERTY OWNERS. WHEREAS, the City Council of the City of EdgewatexAD FF p did on March 2, 1959 pass a resolution entitled as follows, to -with:.. "A Resolution Declaring the Intention of the City of Edgewater, Florida, to Vacate that Part of Frances Drive Adjacent To and West of Lots 5, 11, 18, 19 and 20, Indian River Estates, As Per Map Book 8, Pagge 248, Public Records of Volusia County, Florida, and Provid- ing for the Serving of Notice Upon the Abutting Property Owners and the Time and Place at Which Objections May Be Heard Before the City Council," and WHEREAS, in accordance with the aforesaid resolution, two of the abutting property owners of that portion of Frances Drive adjacent to and West of Lots 5, 11, 18, 19 and 20, Indian River Estates as aforesaid were served by publication as provided for by said resolution and, WHEREAS, said resolution was published for one publication in the New Smyrna Beach News as provided for in said resolution and, WHEREAS, a hearing was held by the City Council of Edgewater, Florida on March 16, 1959 at 7:30 p.m. as provided for by said resolution for the purpose of hearing objections to the vacation of that part of said Frances Drive, adjacent to and West of Lots 5, 11, 18, 19 and 20, Indian River Estates, as per Map Book 8, page 248, Public Records of Volusia County, Florida, as aforesaid. Now therefore, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1: That portion of Frances Drive adjacent to and West of Lots 5, 11, 18, 19 and 20, Indian River Estates, per map in Map - Book 8, page 248, Public Records of Volusia County, Florida, is hereby vacated and abandoned. SECTION 2: That portion of Frances Drive as aforesaid shall revert to the abutting property owners as provided by operation of law. 'ORN 184 FAG446 SECTION 3: This ordinance is enacted pursuant to the prov- isions of Section 112, Chapter 27532, Laws of Florida, 1951. SECTION 4: All ordinances or parts of ordinances in con- flict herewith be and the same hereby are repealed. SECTION 5: This ordinance shall take effect immediately upon its passage and approval by the Mayor. The above ordinance was read in full and passed by vote of the City Council of the City of Edgewater, Florida, at a regular meeting on March 16, 1959. Upon motion duly made, seconded and carried, the requirement of reading said ordinance upon second reading was waived and the ordinance was ordered put upon final passage. Passed by vote of the City Council of the City of Edgewater, Florida, at a regular meeting of said Council held on the 16th day of March, A.
