AN ORDINANCE REGULATING THE REMOVAL OF
GARBAGE AND TRASH IN THE CITY OF EDGEWATER,
VOLUSIA COUNTY, FLORIDA, AND PROVIDING FOR
THE PAYMENT OF A CHARGE FOR THE REMOVAL
THEREOF BY THE CITY OF EDGEWATER, FLORIDA,
AND PRESCRIBING PENALTIES FOR THE VIOLATION w

BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA:
SECTION 1. The word "garbage" as used herein, includes used
tin cans, used bottles, wrapped accumulations of animal or
vegetable matter that attend the preparation and decay of meats
and vegetables, including table and kitchen refuse.
SECTION 2. The word "trash" includes discarded papers, card-
board boxes, discarded metallic or wooden items, ashes, discarded
rags, shrubbery and grass cuttings, excepting therefrom limbs,
trunks and stumps of trees and refuse from any new construction or

F& SECTION 3• That the City of Edgewater, Florida, shall main-
�-3 tain and operate a service for the collection and disposal of
trash, including garbage, and all persons, firms and corporations
whose premises are served therebyshall pay to the City of Edgewater
for the use of such service as per schedule set out below:
Residential dwelling, $5.00 per year or until the proposed
water system is installed.
Commercial establishments, exceptingmotels and trailer
parks, $5.00 per year or until the proposed water
system is installed.
Motels, $7.50 per year or until the proposed water system
is installed.
.0 Trailer parks, 1 to 6 trailers inclusive, $7.50 per year
or until the proposed water system is installed.
Trailer parks, 7 to 15 trailers, $10.00 per year or until
the proposed water system is installed.
Trailer parks, 16 or more trailers, $15.00 per year or
until the proposed water system is installed.
Said fee shall be collected by the City Clerk of the City of Edgewater,
and such payment shall be made at the City Hall and shall be payable

in advance. The aforesaid collection charge shall cover a period
of time from March 1, 1958 to the commencement of operation of the
proposed city water system.
SECTION 4. No person, firm or corporation shall dispose of
garbage as defined in this ordinance save through the garbage dis-
posal service of the City of Edgewater.
SECTION 5. All garbage shall be wrapped or placed in paper
bags so that it is dry and convenient to handle. All trash, includ-
ing garbage, shall be placed convenient _:tb removal by the City
Collectors, but none shall be placed so that it will block the right
of way or impede the flow of traffic on any street or sidewalk. All
garbage shall be placed in covered garbage cans limited in size to
not more than 20 gallons capacity. All trash shall be placed in con-
tainers of not more than 20 gallons capacity. No garbage cans or
trash containers shall be left on city property after the same have
been emptied by city employees.
SECTION 6. The charges and fees made by this ordinance are due
and payable for the service and its availability to the user, whether
such service is used or not. All trash, other than garbage, may be
burned, buried or used by the owrer, provided that if burned, same
shall be burned in accordance with the following section regulating
burning.
SECTION 7. From and after the passage of this ordinance it
shall be unlawful for anyone to set fire to or burn paper, trash,
or other combustible material in the City of Edgewater, Florida,
unless the same is burned in a covered and protected receptable,
or unless the person or persons setting fire to or burning said
paper, trash or other combustible material shall be and remain
personally present within the lot where same is being burned and
within sight of the fire until same is totally consumed or the
fire extinguished.
SECTION 8. From and after the passage of this ordinance it
shall be unlawful for any person -to set fire to any brush, weeds,

grass, woods, trees or other growth on any lot or lots, tract or
tracts of land within the City of Edgewater, Florida, without having
first notified the Fire Chief or Lieutenant of the City of Edgewater,
Florida, of his or her intention to set fire to same.
SECTION9. This ordinance is enacted in order to provide for
the public health, morals, welfare, sanitation and safety of the
people of the City of Edgewater, Florida, and is effective this
date.
SECTION 10. Any person, firm or corporation violating any pro-
visions of this ordinance shall, upon conviction in the Municipal
Court of Edgewater, Florida, of said violation, be fined the sum
not exceeding Fifty ($50.00) Dollars or imprisoned for a period of
not exceeding five (5) days, or both such fine and imprisonment at
the discretion of the Court.
SECTION 11. Each violation of this ordinance shall be a separate
offense for each day the same continues.
SECTION 12. All ordinances or parts of ordinances in conflict
herewith be, and the same hereby are repealed.
SECTION 13. Should any part of this ordinance be held invalid
for any reason, all remaining parts shall be held v slid. The in-
validity of any word, phrase, clause or section shall not invalidate
the entire ordinance. Should this ordinance be held invalid as to
non -users of garbage service, said invalidity shall not affect the
validity of this ordinance as to users of said service.
The a bove ordinance was read in full and passed by vote of
the City Council of the City of Edgewater, Florida, at a regular
meeting held March 5, 1958•
Upon motion duly made, seconded and carried, the requirement
of reading said ordinance upon second reading was waived and the
ordinance was ordered put upon final passage.

Passed by vote of the City Council of the City of Edgewater,
Florida, at a regular meeting of said Council held March 5, 1958
and approved as provided by law, the vote of said Council being
as follows:
