165ORDINANCE NO. 165
AN ORDINANCE SETTING MINIMUM BUILDING GRADES
FOR THE FLOORS OF HOMES IN CERTAIN AREAS OF
THE CITY OF EDGEWATER WHERE LANDS ARE SUBJECT
TO FLOODING.
WHEREAS, certain lands In Edgewater are low, have poor drainage, and
are subject to flooding, and in order to prevent the building of homes
thereon which will in the future be damaged by flooding, NOW, THEREFORE,
BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER:
Section 1: No building permit for the construction of any house on any
lot, piece, or parcel of ground shall issue where the Building Inspector
shall find that said lot Is subject to flooding, except in compliance
with this Ordinance.
Section 2: The findings of the Building Inspector that a lot, piece, or
parcel of ground is subject to flooding shall be based upon a past his—
tory of flooding within the preceding ten years, or lack of natural or
artificial drainage of the lot, piece, or parcel of ground.
Section 9: Upon such a finding, the Building Inspector shall set a
minimum grade for the lot, piece, or parcel of land for which application
is made, which grade shall determine the minimum floor level of any house
to be erected thereon, and said grade shall be sufficiently high, after
a consideration of the natural or artificial drainage, or past history
of flooding, as to protect any house erected thereon from damage by
flooding above the floor level.
Section 4: This Ordinance shall take effect Immediately upon its passage
and approval by the Mayor, and is supplementary to all other building
requirements of the City of Edgewater.
Section 5: Any person aggrieved by the findings of the Building Inspec—
tor as to either (a) The lot, piece, or parcel of land being subject
to flooding or having poor natural or artificial drain eV ) The
minimum grade level necessary to build thereon,he
ruling of the Building Inspector to the City Council o the City of Edge-

water, and present evidence to the City Council of the City of Edge-
water, which shall either reverse the findings of the Building Inspec-
tor, affirm the findings of the Building Inspector, or make its own
findings.
Section 6: All Ordinances or parts of Ordinances in conflict herewith

The above Ordinance was read in full and passed by the vote of the
City Council of the City of Edgewater, Florida, at a special meeting
held on the 30th day of July, A. D. 1957.
Upon motion duly made, seconded and carried, the requirement of reading
said Ordinance upon second reading was waived, and the Ordinance was
ordered put upon final passage.
Passed by the vote of the City Council of the City of Edgewater, Florida,
at a special meeting of said Council held on the 30th day of July, A. D.
1957, and approved as provided by law, the vote of said Council on roll
call being as follows:
