129ORIDNANCE NO; 129 AN ORDINANCE DEDICATING CERTAIN DESCRIBED LANDS OWNED BY THE CITY OF EDGEWATER, FLORIDA, FOR PUBLIC USE. BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, ADOPTED Section 1: The following described land , to -wit: A tract of submerged and overflow land in Indian River North, Volusia County, Florida, more particularly de- scribed as follows: From the Northeast corner of Section 33 Township 17 South, Range 34 East, run North 37050' �i0" West, a distance of 358.35 Peet to "IWV Munument #44"; thence North 240 51' 10" West, a distance of 953.93 feet to an intersection with the easterly prolongation of the south line of Park Avenue, a 50 Ft. Street as now layed out; thence North 660 45' 50" East, along the said easterly prolongation of the south line of Park Avenue, a distance of 120 feet, more or less, to the westerly high water mark of the Indian River North and the Point of Beginning of this description* thence continuing North 660 45' 50" East, a distance of t50 feet, more or less, to the west line of the 500 Ft. right of way of the Intra- coastal Waterway; thence North 260 14' 43" West along the said west right of way line of the Intracoastal Water- way, a distance of 200 feet, more or less, to an Inter- section with the easterly prolongation of the north line of Lot 4-"R", Assessor's Sub. of the Alvarez Grant, as recorded 1n Plat Book 3, Page 137, Publig Records of Volusia County, Florida; thence South 66 45' 50" West, along the said easterly prolongation of the north line of Lot 4-11R11, a distance of 690 feet, more or less, to the aforesaid westerly high water mark of the Indian River North; thence southerly along the said high water mark, a distance of 210 feet, more or less, to the Point of Beginning. Said Parcel containing 3.1 acres, more or less, be, and the same is, hereby dedicated by its owner, the City of Edgewater, Florida, to public use, and the said City of Edgewater agrees never to sell or convey said land or any part thereof for any private use or purpose. Section 2: The above described land be, and the same is, hereby to be used for constructing a city park, dock, for boating and bath- ing, and for other recreational purposes, but this section is not a complete enumeration of or a limitation of the uses to which the above described property shall be put. Section 31 This Ordinance is a covenant with those who may in reliance hereupon donate moneys, services, or materials to the - 1 - development of the above described property. Section 4: This Ordinance shall take effect immediately upon its passage and approval by the Mayor. Section 5: All ordinances or parts of ordinances in conflict here- with be, and the same are, hereby repealed. The above Ordinance was read in full and passed by the vote of the City Counsll of the City of Edgewater, Florida, at a regular meeting on the 13th day of August, A. D. 1956. Upon motion duly made, seconded and unanimously carried, the re- quirement of reading said Ordinance upon second reading was waived, and the Ordinance was ordered put upon final passage. Passed by the vote of the City Council of the City of Edgewater, Florida, at a regular meeting of said Council held on the 13th day of August, A.
