127ORDINANCE NO. 127 AN ORDINANCE AUTHORIZING THE CITY OF NEW SMYRNA BEACH TO ERECT, CONSTRUCT AND MAIN- TAIN ITS ELECTRICAL SYSTEM IN THE CITY OF EDGEWATER. BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: Section 1: That the City of New Smyrna Beach shall have the right of ingress and egress over and upon the public streets, ways and property of the City of Edgewater for the purpose of con- structing, maintaining and servicing electrical equipment, free from interference by the City of Edgewater, or any person or per- sons, acting through, by or under it. Section 2: That the City of New Smyrna Beach shall have the right and privilege to erect poles and other electrical equipment at all necessary and proper places, within the corporate limits of the City of Edgewater, and shall have the right to trim or remove any trees, shrubbery or other growth which may interfere with the extension, construction or maintenance of electrical equipment, provided however that this right and privilege shall not in anywise extend to the private property of any property owner in the corpo- rate limits of the City of Edgewater, but shall apply only to those properties of a public nature, over which the City of Edgewater may have control. Section 3: This Ordinance shall take effect immediately upon its passage and approval by the Mayor. The above Ordinance was read in full and passed by the vote of the City Council of the City of Edgewater, Florida, at a regular meeting on the 30th day of July, A. D. 1956. Upon motion duly made, seconded and unanimously carried the reo_uirement of reading said Ordinance upon second reading was waived, and the Ordinance was ordered put upon final passage.
