118ORDINANCE NO. 118 AN ORDINANCE REQUIRING A PERT!IT TO MOVE OR OTHERWISE TRANSPORT ANY HOUSE, DWELLING, OR OTHER BUILDING ON THE STREETS, AVENUES, OR ALLEYS OF THE CITY OF EDGEWATER, FLORIDA, AND FIXING THE AMTHOD OF DETER147NING THE FEES FOR SUCH PERMIT, PROVIDING WHEN THIS ORDINANCE SHALL BECO14E EFFECTIVE, AND PRO- VIDING FOR A BOND WHEREAS the moving or otherwise transporting of houses, dwell- ings, or other buildings on the streets, avenues, or alleys of the City of Edgewater, Florida, costs the City of Edgewater considerable sums of money in furnishing extra police in the handling of traffic and in the repairing of damage to the streets of the City of Edgewater, Florida; NOW, THEREFORE, in order that the cost to the City of Edgewater, Florida, as afore set forth shall be borne by those directly receiving the benefit of the services, to -wit, the persons, partnerships, or corporations moving or transporting or causing to be moved or trans- ported said houses, dwellings, or other buildings on the streets, ave- nues, or alleys of Edgewater, Florida, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: Section 1. That no person, partnership, or corporation shall move or otherwise transport or cause to be moved or otherwise transported any house, dwelling, or other building, on the streets, avenues, or alleys of Edgewater, Volusia County, Florida, without first having received a PEPMIT TO MOVE OR OTHERWISE TRANSPORT A HOUSE, DWELLING, OR OTHER BUILDING,^;From the City Clerk. Section 2. Tint the request for such permit shall be made In writing to the City Clerk not less than ten (10) days prior to the date of moving or otherwise transporting and said request for permit shall set out in full the date the house, dwelling, or other building, is to be moved or otherwise transported, the exact location of the hose, dwelling, or other building, the exact route to be followed in the moving or otherwise transporting, and the approximate time the house, dwelling, or other building shall be on the streets, avenues, or alleys of Edgewater, Florida. - 1 - Section 3. That the City Clerk shall, upon receiving said request for permit, as soon as is practical, but on or before the date set forth in the request for permit for moving or otherwise transporting, cause the City Building Inspector to inspect the house, dwelling, or other building, and the route to be used in moving or otherwise transporting, and considering the approximate time the house, dwelling, or other building shall be on the streets, avenues, or alleys of Edgewater, shall determine the cost to the City of Edgewater, Florida. Section 4. That the fee for the permit shall be the cost as determined by the City Building Inspector and shall be paid by the applicant at the time of receiving the permit. Section 5. That any person violating the provisions of this Ordinance by failing to make application and by failing to obtain such permit prior to the moving or otherwise transporting of any house, dwelling, or other building on the streets, avenues, or alleys of the City of Edgewater, Florida, shall, upon conviction thereof be punished by a fine not exceeding $100.00 or imprisonment for a term of 30 days, or by such fine and imprisonment in the discretion of the Municipal Judge. Section 6. That all Ordinances or parts thereof in conflict herewith, or contrary he -veto, be and the same are hereby repealed. Section 7. Irl addition to the fee required for a permit, the applicant shall post a bond of $100.00 with the City Cler'_; of the City of Edge- water, said bond to be approved by said City Clerk, conditioned to pay any damages which may be sustained by the streets, avenues or alleys of the City of Edgewater, Florida, in the moving or otherwise transport- ing of said house, dwelling, or other building. within one day after said house, dwelling, or other building has been moved, the City Build- ing Inspectop shall inspect the route over which the said house, dwelling, or other building was moved, and estimate what damage , if any, has been sustained by the streets, avenues, or alleys of the City of Edge- water, Florida. Said bond shall be refunded to the extent that the streets, avenues or alleys of the City of Edgewater, rlorida, are not damaged, and forfeited to the extent of the cost of repairing any streets, - 2 - -C avenues, or alleys damaged by said moving. Section 8. That this Crdinance shall take effect immediately upon its passage. The above Ordinance was read in full and passed by the vote of the City Council of the City of Edgewater, Florida, at a regular meeting on the 21st day of May, A.D. 1956. Upon motion duly made, seconded and unanimously carried, the require- ment of reading said Ordinance upon second reading was waived, and the Ordinance was put upon final passage.
