96ORDINANCE NO. 96 AN ORDINANCE REGULATING SIGNS, BILLBOARDS, AND PROVIDING CERTAIN REQUIREMENTS AS TO SIZE, HEIGHT, AND LOCATION, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGMiATER, FLPXDd" Section 1: Definitions2 d W �,; a e term "sign" shall mean and include every sign, billboard, ground sign, wall sign, roof sign, illuminated sign, projecting sign, temporary sign, marquee, awning, canopy, and shall include any announcement, declaration, demonstration, display illustration or insignia used to advertise or promote the interests of any person when the same is placed out of doors in view of the gameral public. b) The term "person" shall mean any person, firm, corporation, partner- ship, association, or organization of any kind, Section 2; It shall be unlawful to erect or maintain any sign in the City of Edgewater, Florida, except signs on the premises owned or leased by persons than conducting a business thereon, which advertise the business actually or presently carried on or conducted on said premises, and except signs not exceeding six(6) square feet in area indicating or designating the direction to or location of a place of business then carried on and conducted in said City; however, not more than two(2) such signs pertaining to the same business shall be permitted or maintained with, the limits of the City of Edgewater, Florida. Section 3: Exempted from Section 2 of this Ordinance are the following; a)real estate signs not exceeding 6 square feet in area advertising the sale, rental or lease of the premises upon which said signs are located; %rofessional name plates not exceeding one square foot in area; c Bulletin boards for public, charitable, or religious institutions when the same are located on the premises of said institutions; d)signs denoting the architect, engineer or contractor, when placed upon work under construction. e)traffic or other municipal signs, legal notices, railroad signs, danger, and such other temporary, emergency or nonadvertising signs as may be a�)proved by the City Council. fall signs lawfully existing on the date of the passage of this Ordinance; however, such signs as now exist but which would otherwise be illegal by the terms of this ordinance shall not be maintained or improved, and if destroyed, shall not be rebuilt. Section : No sign shall be erected at the intersection of an, streets in such a manner as to obstruct free and clear vision; or at any location, where, by reason of the position, shape, or color, it may interfere with, obstruct the view of, or be confused with any authorized traffic sign or signal. Section 5: Nothing in this Ordinance repeals or eliminates any previously existing Ordinance requiring a permit to erect a sign, or restricting signs to certain zoned areas, or providing for a setback of signs a certain distance from any street. -page 1- Section 6: All Ordinances or parts of Ordinances in conflict herewith be, and the same are, hereby repealed. Section 7: This Ordinance shall be enforced by the Building Inspector removing any signs in violation of this Ordinance ten days after giving notice by letter to the owner of the sign, if the same be known, or by posting a written notice on said sign if the owner be unknown, or if the address of the owner be unknown. Section 8: Anyone violating the terms of this Ordinance shall be subject, upon conviction in Municipal Court, to a fine not exceeding $50.00, or imprisonment not exceeding 30 days; each day a sign is maintained in violation of this Ordinance shall be a separate offense. The above Ordinance was read in full and passed by the vote of the City Council of the City of Edgewater, Florida, at a regular meeting of said Council held on the 12th day of December, A. D. 1955. Upon motion duly made, seconded and unanimously carried the requirement of reading said Ordinance upon second reading was waived, and the Ordinance was ordered put upon final passage.
