.JINANCE REGULATING AND PRESCRIBING RYQUIMMT:
FOR PSTAURANTS AND EATING PLACES IN TEE CITY OF EDG.,
VOLUSIA COUN-Y, FLORIDA, R?'.QUIRING PERMITS FOR THE
OPERATION OF RESTAURANTS AND EATING PLACES, PROVIDING
PENALTIES FOR THE VIOLATION OF THIS ORDINANCE.
RESTAURANTS AND EATING PLACES;
Section 1. De£initionst-
(a) Restaurantst- The term "restaurants" shall mean, as used
in this chapter, any hotel, dining room, public restaurant, cafeteria,
cafe, public dining room, lunch counter, stationary dining car, soda
fountain, sandwich stand, luncheonette or other establishment where
food or drink for consumption on the premises is prepared for sale
or sold.
(b) Cooking Utensilst- Cooking utensils shall include all
kitchenware, glassware, utensils, and other containers with which
food or drink is prepared and cooked or stored, and does not come
in contact with patrons of the establishment and is not used in
any connection with the eating of food.
(a) Eating Dtensilst- Eating utensils shall include all
tibl'ewnra; glassware, crockery, knives, forks and spoons or other
containers or articles that come in contact with the patrons of
the establishment or employees or other persons in eating the
food or drink.
(d) Baoflericidal Treatment:- A bactericidal treatment is
the application of a prsceas for the destruction of bacteria, which
does not adversely affect the health of the food or drink consumer,
and which is effective in the destruction of bacteria. The most
usual bactericidal agencies of this class are hot water or steam
or chlorine or some compound releasing free chlorine.
(a) Employees:- The term "employees" shall mean any person
who handles food or drink during preparation or serving, or who
comes in contact with any eating or cooking utensil, or who is
employed at any time in a room in which food or drink is prepared
or served.
(f) Person:- The word "person" shall mean person, firm,
corporation or association.
$action 2t No restaurant or eating place shall be operated
or maintained in the City of Edgewater until permit for the opera-
tion and maintenance thereof has been obtained from the City Clerk.
No such permits hhall be issued by the City Clerk until after
inspsctidn: by and certification from the County Fealth Officer
of Volusia County, Florida that said such restaurants or eating
places have been inspected and found to meet the requirements of
the Board of Fealth of Volusia County, Florida. Permits shall be
issued annually without charge to the owner or operator of any
restaurant or eating place in the City of Edgewater operation and
maintaining a restaurant or eating place in compliance with the
terms of this ordinance for which an occupation license has
been obtained as required by the ordinance of the City of Edgewater.
All permits shall be posted in a conspicuous place in the restaurant
or eating place for which such permit is issued. Permits shall
be revoked by the Chief of Police of the City of Edgewater for
violation of any of the provisions and requirement of this ordi-
nance. .Written notice of such revocation, together with the grounds
therefor, signed by the Chief of Police shall be given to the
owner or manager of such restaurant or eating place, and a copy
therefor, shall be filed with the City Clerk. No restaurant or eating
place shall be operated or maintained after its permit has been revoked
as aforesaid.

Section 3:- Food- - All food and drink served in any restaurant
or eating place shall be clean, wholesome and free from spoilage.
Upon a finding after inspection by the Volusia County Board of Health
Inspector that any food and/or materials used for food is or are
unwholesome and not in compliance with this ordinance, the Chief of
Police shall condemn and destroy all food found unwholesome or not
in compliance with the provisions thereof. All milk, milk products,
ice bream and other frozen desserts shall be of the best grade avail-
able in the community or of a grade approved by the County Inspector.
Milk and milk products shall be served from the original containers
in which they were received from the distributors; provided that
this requirement shall not apply to cream served to patrons for coffee
and cereals. All oysters and clams shall be from sources approved
by the State Board of Health, or, if from outside the state, from a
producer certified by U. S. Public Health Service.
Section 4: Walls and Ceilings: Walls and ceilings of s1l.
restaurants ar eating places shall be of such materials as to be
easily cleaned and shall be kept in a clean condition.
Section 5: Floors: The floors of all rooms in which food or
drink is stored, prepared or served, or in which utensils are
washed, shall be of such construction as to be easily cleaned,
shall be smooth and shall be kept cleaned and in good repair.
Kitchens floors shall be impervious to water.
Section 6: Lighting: All rooms in which food is stored, pre-
pared or eaten, and all toilets and lavatories, shall be well
lighted, both with natural 'and artificial light. In dining rooms,
kitchens or where food is prepared, the lighting shall be such
that a person with normal vision can read ordinary newspaper print
eighteen inches from the eyes.
Section 7: Ventilation: All rooms in which food is eaten,
coo4ed or prepared and all toilets and washrooms shall be vented
to outside atmosphere, and where any opening does not provide
direct access to outside atmosphere, mechanical ventilators shall
be used to exhaust and renew the air.
Section B: Construction of utensils and Eouioment: All eating
and cooking utensils and all show display cases or windows,
counters, shelves, tables, refrigerating equipment, sinks and other
equipment or utensils used in connection with the operation of a
restaurant shall be so constructed as to be easily cleaned and
shall be kept in good repair.
Section 9: Cleaning of Eouipment: All equipment, including
display cases or windows, counters, shelves, tables, refrigerators,
stoves, hoods and sinks, shall be kept free from dust, dirt, in-
sects and other contaminating material. All cloths , towels, aprons,
clothing, etc., used by chefs, waiters and other employees shall
be kept clean. Table cloths shall be clean and all patrons served
with a fresh clean napkin. Individual paper napkins may be used.
Single service containers shall be used only once.
Section 10: Cleaning of Cooking Utensils: Cooking utensils
after each use shall be thoroughly washed with soap or other effect-
ive cleansing agent, and hot water (not less than 110 degrees F.).
After rinsing, they must be either subjected to live steam in a
close compartment for at least five minutes, or immersed for not
less than two minutes in water, the temperature of which is not
less than 170 degrees F. Large pieces of equipment that cannot be
immersed shall be rinsed thoroughly with boiling water. All cooking
utensils, except those used for frying, shall bhow no visible
signs of grease when handldd with the hands. Separate tanks must
be used, one for washing and one for rinsing.

Section llt Cleaning and Sterilization of Eating Utensilst
All eating utensils must be thoroughly washed with soap or other
effective cleansing agent, in water whose temperature is not less
than 110 degrees F. after each use, rireed and then subjected to
one of the following processes:
(a) Exposure for at least 5 minutes to live steam in a
clAsed compartment.
(b) Immersion for at least 2 minutes in hot water, the
temperature of which is not less than 170 degrees F.
(c) Immersion for at least 2 minutes in a chlorine solu-
tion which shall be made up at a strength of not less then 100
parts per million, and which shall not be used after its strength
has been reduced below 50 parts per million.
(d) Treatment by any other bactericidal process approved
by the Inspector of the Volusia County Board of Health.
When a chlorine or other chemical treatment is used, a
three -compartment washstand shall be provided and used, the first
compartment to be for washing, the second for rinsing, and the
third for chlorine or chemical immersion. The three compartments
need not be combined in one fixture, so long as a separate com-
partment is available for each operation.
Section 121 Storage and Handling of Utensilet After bacteri-
cidal treatment, no utensil shall be stored except in a clean
dry place protected from flies, dust or other contamination, and
no utensil shall be handled except in a manner, insofar as practi-
cable, to prevent contamination. Single service utensils shall
be purchased only in sanitary containers and stored in a clean
dry place until used. Sterilized utensils shall not be wiped dry.
Section 13: Re£rieerationt All perishable food or drink,
including cream -filled pastries, shall be kept at or below 50
degrees F. except when being prepared or served.
Section 14: Flies and other Insects: All parts of the res-
taurant shall be kept free from flies or other insects. All win-
dows, doors and other openings to outer air shall be tightly and
effectively screened with screens not larger than 16 mesh. Screens
shall be kept in perfect repair. Doors shall be self -closing
and open outward.
Section 151 Storage and Display of Food and Drinkt All
food and drink shall be so stored and displayed as to be protected
from dust, flies, vermin, handling droplet inflection, overhead
leakage and other contamination.
Section 161 Animals and Foods: No dogs, cats or other animals
or fowls shall is kept or allowed in any room in which food or
drink is prepared, eaten or served.
Section 171 Poisonous Materials: No article, polish or
other substance containing any cyanide preparation shall be tiled
for the cleansing or polishing of eating or cooking utensils.
No material poisonous to man shall be used in eliminating rate
or insects, except as approved by the Inspector of the Volusia
County Board of Health.
Section 181 Cleanliness of Bnployeest All employees shall
wear clean outer garments, and shall keep their hands clean at
all times when handling food, drink, utensils or equipment.
Section 19. Premises: The surroundings of all restaurants
shall be kept clean and free of litter or rubbish. None of the
operations connected with a restaurant shall be conducted in any
boom used for domestic purposes, nor shall anyone sleep in any
rooms used for cooking, storing, preparing or eating food. Ade-
quate lockers or dressing rooms shall be providdd for
clothing. Soiled linen, coats and aprons shall
containers provided for this purpose.

Section 20t Health ofDnnloyeest (a) No person suffering
from a communicable disease, or who is known to be, or is suspected
of being a carrier of organisms causin4a communicable disease,
shall In employed in a restaurant nor shall bd permitted to remain
on the premises. Each employer shall keep in his possession a
certificate in writing for each employee, by a health officer
approved by the Florida State Board of Health, or by a registered
medical physician, stating that the employee has been given a
thorough physical examination, including a Wasserman or other
blood test, or smears, for syphillis, tuberculosis, gonorrhea,
or other communicable disease, and that said employee or person _
was not found to be suffering from any disease in a communicable
stage. No certificate shall be issued until such a physical examina-
tionhas been given, nor until a negative report shall have been
received from the laboratory making examinations of the blood
or other specimens taken at the time of the examination and found
to be non -communicable. When issued, such certificate shall show
the date of the examination, and no certificate shall be accepted
as being in compliance with this ordinance after a period of three
months from the date of any examination. A copy of each laboratory
renort shall be furnished the Chief of Police within five days
of its receipt from the laboratory.
(b) Certificates shall be prepared only on forms supplied
by the County Inspector. Both the employer and the employee
shall be held responsible for the violation of any of the reRuire-
ments of this section.
Section 21s Toilet Facilities$ Toilet facilities of all
restaurants or eating places shall comply in all respects with
the ordinances of the City of Edgewater in reference to public
toilets and the failure of any restaurant of eating place to
comply with such requirements shall be aufficient grounds for the
revocation of the permit of any restaurant or eating place.
Section 22- Garbage Disposals All garbage, trash or refuse
of any restaurant or eating place shall be disposed of in the
manner prescribed by the ordinances of the Cit� of Edgewater regu-
lating the disposal or garbage and the failure to comply with the
requirements of such ordinances shallbs sufficient grounds for the
revocation of the permit of any restaurant or eating place.
Section 232 It shall be the duty of the Chief of Police to
enforce the terms and provisions of this ordinance and to make
inspection of all restaurants and eating places in the City of
Edgewater at least once every three months. The chief of Police
shall have the right to enter upon the premises of any restaurant
or eating place at any time such restaurant or eating place is
open for business and shall have access to all portions of such
restaurant or eating place to examine and inspect such restaurant
or eating place and all equipment and facilities therein. It
shall be unlawful for the owner, operator, manager or any
employee of any restaurant or eating place to refuse admission
to theChiefof Police at any time such restaurant or eating place
is open for business.
Section 24. Penalties: Any person, persons, firm or corp-
oration acting either as owner, manager or employee of any res-
taurant who shall be guilty of a violation of thid ordinance shall
upon conviction in the Municipal Court be subject to a fine of
not more than Cne Hundred Dollars($100.00) or imprisonment for
not more than thirty days (30 days) or both, in the discretion
of the Municipal Judge.
Section 25: If any section, subsection or part of this ordinance
shall for any reason be held or declared to be unconstitutional

Section 26: All ordinances or parts of ordins in con-
flict herewith be and the same are hereby repealed.BY
Section 27: This ordinance shall become effective ten(IO)
days after its passage and adoption by the City Council of the

City of Edgewater, and two (2) copies of this ordinance shall be
posted at two (2) public places in the City of Edgewater, one of
which shall be public bulletin board at the City Ball.
The Above Ordinance was read in full and passed by the vote of
the City Council of the City of Edgewater, Florida ai{a regular
meeting on the y3 day of July, A.D. 1952.
Upon motion duly made, seconded and unanimously carried
the requirements of reading said ordinance upon second reading
was waived, and the ordinance was ordered put upon final passage.
Passed by the vote of the City Council of the City of
Edgewater, Florida, at a regular meeting of said Council held
on the Aa day of July, A.D. 1952 and approved as provided by
law, the vote of said Council on roll call being as follows:
