costs accrued subsequent to this judgment are not paid, the Clerk of Court shall sell the

Petitions shall be foreclosed of ail estate or claim in the property, and defendant(s) right of
redemption as prescribed by section 45.0315 Florida Statutes (2013) shall be terminated,
except as to claims or rights under chapter 718 or chapter 720, Florida Statutes, if any. Upon
the filing of the certificate of title, the person named on the certificate of title shall be let into
possession of the property.
& Attorneys' Fees. The Court finds, based upon the affidavits presented and upon inquiry of
counsel for the Plaintiff, that the flat fee of $3625.00 is reasonable and appropriate for the
Plaintiffs counsel's attorney's fees. Furthermore, the Court finds, based upon the affidavits
presented and upon inquiry of counsel for the Plaintiff, that 10.00 hours were reasonably
expended by Plaintiffs counsel and that and hourly rate of $175.00 is appropriate.
PLAINTIFF'S COUNSEL CERTIFIES THAT THE ATTORNEY FEE AWARDED DOES
NOT EXCEED ITS CONTRACT FEE WITH PLAINT FF. The Court finds that there are no
reasons for either reduction or enhancement pursuant to Florida Patient's Compensation
Funds v. Rowe, 472 So. 2d 1145 (Fla. 1985), and the Court therefore has awarded reasonable
attorney's fees in the amount indicated in paragraph I of this Judgment.

THIS CAUSE came before the undersigned Special Magistrate on October 3. 2018 after
due notice of noncompliance to the Respondent. The Special Magistrate, after having heard
testimony under oath received evidence and heard arguments of counsel (if any), the
Respondent_being")— not being present, there upon issues this Findings of Fact, Conclusion of
Law and Order as follows:
I. FINDINGS OF FACT
1. The Respondent is the owner of the property described as follows:

On August 12. 2018. said Code Enforcement Officer became aware of the following viotation(s)of
the Land Development Code/Code of Ordinances of the City of Edgewater.
Violation Detail Sec.10-80 Outdoor Storage-Residential
2. That on August 13. 2018, said Code Enforcement Officer notified the above-
captioned individual of said violations and gave the above-captioned individual until
August 23 2018,to correct the violations.
3. That said violation(s) described in paragraph above continued beyond the time
specified for correction by the Code Enforcement Officer requested a hearing.
4. That the Code Enforcement Officer, through its clerical staff, scheduled a hearing
and written notice of such hearing was handdelivered, mailed, or posted as provided
by Section 162.12, Florida Statue.
5. That on October 3. 2018 a hearing was held pursuant to Section 162.07, Florida
Statue.
6. That on basis of the testimony at the hearing on October 3 2018 this Special
Magistrate found the following conditions existed at the above-described property.

II. CONCLUSION OF LAW
7. Between August 13. 2018, and October 3. 2018 the above-captioned individual
and/or entity has violated the following Sections of the City Code: Section 10-80
Outdoor Storage-Residential.
III. ORDER
8. It is the Order of the Special Magistrate that the above-captioned individual and/or
entity shall be found in violation. No daily fines are to be accessed, as the property
is now in compliance.
9. It is the further Order of the Special Magistrate that this case shall be review at the
Hearing on October 3. 2018 fi the property located at the above-mentioned
individual and/or entity is subject to a citation fine of$75.00.
Based on the above Findings of Fact, Conclusions of Law, the Special Magistrate hereby orders
that the Respondent comply with all the rules set forth as stated in Florida Statute 767.12 by
October 17, 2018.
