15ORDINANCE NO. /S AN ORDINANCE REGULATING OUTDOOR AND OUTSIDE ADVERTISING SIGNS OF HOTELS, APARTMENT HOUSES, ROOMING HOUSES, MOTOR COURTS, TOURIST CAMPS, TRAILER CAMPS, MOTELS, TOURIST COURTS AND LIRE ESTABLISHMENTS; REQUIRING SUCH SIGNS WHEN ROCM RATES FOR SAID ESTABLISHMENTS ARE POSTED THEREON TO HAVE POSTED BOTH t,DNIMUM AND MAXIMUM RATES FOR ACCOUPIODA- TIONS IN TYPE AND MATERIAL OF EQUIVALENT SIZE AND PROMINENCE ON SAID SIGNS, AND CERTAIN OTHER DATA EXPLANATORY THEREOF; AND FURTHER REQUIRING SUCH ESTABLISHMENTS TO HAVE AVAILABLE ACCWMODATIONS TO MEET THE POSTED RATES; AND PRESCRIBING PENALTIES FOR THE VIOLATION OF TEIS ORDINANCE. HE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. Definitions. (a) "Outdoor" or "Outside signs" when used in this ordinance shall mean any sign visible to passersby whether the same be located within or with- out buildings. (b) "Room rates" when used in this ordinance shall mean the rates at which rooms or other accommodations are rented to occupants. (a) "Owner or operator" shall be taken to mean the plural of such words. "Operator" shall include tenants, managers or any person in charge of the operation of hotels, apartment houses, rooming houses, motor courts, tourist camps, trailer camps, motels, tourist courts and like establishments. The words "Operator or Owner" shall include natural persons, firma and corporations. SECTION 2. Scope. This ordinance shall apply to operators and owners of hotels, apartment houses, rooming houses, motor courts, tourist camps, trailer camps, motels, tourist courts and like establishments, and to such establishments. SECTION 3. Requirements for outdoor and outside advertising signs.. It shall be unlawful for any owner or operator of any establishment within the scope of this ordinance, located within the City limits of the City of Edge- water, Florida, to post or maintain posted on any outdoor or outside advertising sign pertaining to such establishments, any rates for accommodations in such establishments unless the sign shall- have posted thereon both the minimum and maximum room, apartment or other rental unit rates for all aecommodations offered for rental, all posted rates and descriptive data required by this ordinance being further required to be in type and material of the same size and prominence as the aforesaid data stating the number of rooms available in each price level where such sign indicates varying rates. This ordinance shall not be held to be complied with by signs stating the rate per person or bearing the legend "and up." Such signs shall also state in type end material of the same size and prominence as the aforesaid data the dates or period of time during which said posted rates are available. SECTION Q. Accommodations must be available. It shall be unlawful for any owner or operator of any establishments within the scope of this ordinance within the City limits of Edgewater, Florida, to post or maintain posted on outdoor or outside advertising signs rates for accommodations in any such establishment unless there shall be available in any such establishment vacant accommodations for iimsediate occupancy to meet all y'�! -1- of the posted rates on said advertising signs. SECTION 5. Misleading, false or fraudulent signs prohibited, It shall be unlawful for any owner or operator of any establish- ment within the scope of this ordinance, within the City limits of the City of Edgewater, Florida, to post or maintain outdoor or outside advertising signs in connection with any such establishment which shall have thereon any misleading, false or fraudulent representations. SECTION 6. Construction of ordinance. Nothing contained in this ordinance shall be construed so as to require establishments within the scope of this ordinance, to have outdoor or outside signs. This ordinance, however, shall be liberally construed so as to prevent misleading, false or fraudulent representations being placed upon out- door or outside signs pertaining to such establishments. Nothing in this ordinance shall be construed to repeal or affect in any manner whatsoever any requirement contained in the zoning or other ordinances of the City of Edge- water, Florida, SECTION 7. Penalties, Any person violating any of the terms or provisions of this ordinance shall upon conviction thereof in the Municipal Court, be punished by a fine in a sum not exceeding $200.00 or by imprisonment in the City Jail for a term not exceeding ninety (90) days or by both such fine and imprisonment in the discretion of the Municipal Judge. SECTION 8. That all ordinances or parts of ordinances in conflict herewith be, and the same are, hereby repealed. SECTION 9. This ordinance shall take effect immediately upon its passage and approval by the Mayor. The above ordinance was read in full and passed by the vote of the City Council of the City of Edgewater, Florida at a regular meeting on the 23rd day of April, A. D. 1952. Upon motion duly made, seconded and carried the requirement of reading said ordinance upon second reading was waived, and the ordinance was ordered put upon final passage. Passed by the vote of the City Council of the City of Edgewater, Florida, at a regular meeting of said Council held on the 23rd day of April, A.
