10ORDINANCE NO. 10 AN ORDINANCE PRESCRIBING PPM=UISTTES FOR THE ISSUANCE OF AN OCCUPATIONAL LICENSE FOR FORTUNE TELLERS, PALMISTS, ASTROLOGISTS OR OTHER OCCUPATIONS PROFES`:ING TO FOR^SEE, PREDICT OR RECALL FUTURE OR PAST EVENTS BY ANY P PHYSICAL OR SPIRITUAL MEANS IN THE CITY OF EDGEWATER, FLORIDA, �'" PRESCRIBING PENALTIES FOR FAILURE TO COMPLY WITH THE SAME, BE TT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1, That no occupational license shall be issued to any person, firm or corporation in the City of Edgewater, Florida, engaged in the business of fortune-telling, astrology, palmistry, or other occupation professing to foresee, predict or recall future or past events by any physical or spiritual means until such person, firm or occupation shall furnish the City Clerk of said city the following information: (a) The place or places of residence of the person, firm or corporation applying for said license for five (5) years immediately preceding application therefor, (b) The address and nature of business engaged in for five (5) years immediately preceding the date of application, (c) The names and present addresses of all persons, whether adults or minors, connected with or associated with the proposed business or occupation. SECTION 2, Upon receipt of the data set forth in Section 1 hereof, the City Clerk shall forthwith direct an inquiry to the Sheriff of the county and the Chief of Police at each city where applicants have resided and done business for five (5) years immediately prior to the date of application for license for the purpose of ascertaining the general reputation of such applicant, the criminal record, if any, of said applicant, and the nature of any complaint received by such officers in connection with previous business enterprises. SECTIM 3. Upon receipt of answers to the inquiries set forth in Section 2 hereof, in the event the applicant has any previous criminal record or if the general reputation of said applicant is poor, or if complaints have been registered against him in the conduct of his business, such application shall be denied and said applicant shall not be permitted to engage in the aforesaid business or businesses in the City of Edgewater, Florida. SECTICH 4. Should the answers to the inquiries set forth in Section 2 hereof show that applicant has no previous criminal record, that his general reputation is good, and that no complaints have been made against him, the applicant shall then proceed to the Volusia County Bureau of Identification in the Office of the Sheriff of Volusia County, Florida, for the purpose of finger -printing and Identification, and the City Clerk shall request said Bureau of Identification of Volusia County, Florida, for its report on said applicant. SECTICN 5. Should said report from the Bureau of Identification of Volusia County be favorable, the applicant and all persons connected with said business shall then proceed to a duly licensed and qualified physician residing in Volusia County, Florida, for the purpose of obtaining a health certificate certifying that the applicant and all persons connected with said business and occupation are free from any contagious and communicable disease or infection. - 2 - SECTION b. Should the applicant or applicants for such license comply with the foregoing provisions of this ordinance* then and in that event the City Clerk of the City of Edgewater shall issue an occupational license or licenses for such business upon the payment of the fee prescribed by the City Council of the City of Edgewater* Florida. However* should said applicant or applicants fail to meet the requirements as herein set forth* such license shall not be issued; and any person* firm or corporation found guilty of engaging in such business or occupation without fully complying with said requirements shall be fined not more than One Hundred Dollars ($100.00) or imprisoned for not more than thirty (30) days* or both. SECTION 7. That all ordinances or parts of ordinances in conflict herewith be* and the same are* hereby repealed. SECTION S. This ordinance shall take effect immediately upon its passage and approval by the Mayor. The above ordinance was read in full and passed by the vote of the City Council of the City of Edgewater* Florida at a regular meeting on the 9th day of January* A. D. 1952. Upon motion duly made* seconded and carried the requirement of reading said ordinance upon second reading was waived* and the ordinance was ordered put upon final passage. Passed by the vote of the City Council of the City of Edgewater* Florida* at a regular meeting of said Council held on the 9th day — 3 — e of January, A.
