4. CITIZEN COMMENTS
Michael Visconti, 316Pine Breeze Dr: suggested a new motto for the city "Edgewater the City of
Parks"and a flag pole at State Road 442 and USI.
Charles Bradley, 31 Pelican Drive: complimented the cities refuse and maintenance workers for the
great job they do. He also complained about the speed on USI stating that he believes the speed limit
should be 45 MPH instead of55 MPH.
Elizabeth Laveme, 1810 Hibiscus Drive:discussed a canal clean up she recently attended
Bob Andrejkovics, 331 Admiralty Court. suggested a donation drive to get a flag pole installed at
State Road 442 and US1.
Steven Wright, 669 Coral Trace Blvd: requested that a sidewalk be installed from Coral Trace Blvd
to Cow Creek Road on the North side.

Councilwoman O'Keefe reported.'nothing at this time.
Councilman Conroy reported. Jet Bucannon thanked the Council for Whistle Stop Park. Councilman
Conroy discussed a census upcoming this year which has 2300job openings avatlible in Volusia
County The YMCA has created a taskforce and they are looking into ways to upgrade amenities.
Councilwoman Power reported attending: the TPO meeting, the Team Volusia meeting and the
Police Awards Banquet.
Councilwoman Yaney reported attending. the Chamber of Commerce Economic Development Board
Meeting and has been spending time with each department head through her orientation
Mayor Thomas reported: presenting a Proclamation to the New Smyrna Beach Tourism Department,
attended the Police Awards Banquet and the 10th anniversary of the Halifax Hospice Center.

a. City Clerk
Robin Matusick reported: the Council of the upcoming City Clerk's Conference June 23rd through
June 26th outside of St. Augustine that she and Kelsey will be attending. Our new employee Haley
Walker will be in our office for assistance and I will be receiving a-mails and messages.
Informed Council of the Budget and Utility Workshop on June 24th at 4:00pm at which Bonnie
Brown will be in attendance. Councilwoman Power informed Council that she will not be in
attendance at that Workshop.
Also provided an update on the Oak Lynn Cemetery.
b. City Attorney
Aaron Wolfe reported.- In the Case of John Ingles vs City of Edgewater - this is the case where the
Plaintiff is seeking an injunction to prevent Code Enforcement action by the City related to docking
his boat on his property. There was a hearing on May 8th where I had moved to dismiss the
Amended Complaint and that motion was granted so the Judge dismissed the case with prejudice,
meaning we won the care and that an Order was entered on May 10th and they have 30 days from
that date to appeal to the Circuit Court. There has been no appeal as of today's date.
In the Fire Association Case, they did ask for an extension on the discovery which I granted and they
just produced their discovery in the last couple of days and I am going through their discovery
responses to determine the next step in the btigation.
C. City Manager
Glenn Irby reported.- that the City is about to enter into a busy fiscal time of year, we will be
reporting to the Council at some point and we have meetings scheduled with Directors beginning this
week and it will go until no later than September 30th. It's not pretty but we will get there.
12. CITIZEN COMMENTS
Elizabeth Laverne, 1820Hibiscus Drive: requested that Council approve a powerpoint presentation
on the ]8th Canal Issue. She would like to have John McGully and Steve Beaman present the
powerpoint at the next meeting. Council determined that she could have her presentation during the
August meeting and no longer than 15 minutes.

2) Oak Lynn Cemetery Update - the State Investigator Gene Brin mer and I met
Massey in an effort to resolve ongoing matters with the cemetery, where he volunteered
to consolidate the area used & donate a portion of the property to an association like the
VFW, etc to oversee the cemetery & volunteer association, however Mr. Brimmer was
informed that the volunteer association was not interested.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EDGEWATER, FLORIDA, CREATING A CITY
MANAGER ADVISORY BOARD, PROVIDING FOR THE
PURPOSE AND DUTIES OF SAID COMMITTEE;
APPOINTING MEMBERSHIP AND DEFINING THE ROLE
OF CITY STAFF WITH RELATION TO THE
COMMITTEE; REPEALING ALL RESOLUTIONS IN
CONFLICT HEREWITH AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City Council is desirous to create a City Manager Advisory Committee
that will coordinate with the City Council, Interim City Manager, City Attorney and Staff, in an
effort to review applications submitted and assist in the interview process in the search for a new
City Manager and submit recommendations to the City Council;
WHEREAS, the City Council recognizes the importance of citizen/resident input in the
process of the search for a City Manager and has encouraged same by electing to utilize
citizens/residents delegated by each Council member in an effort to unify the participation of all
residents/citizens relating to the possible search and application process for a City Manager; and
WHEREAS, the City Council wishes to complete the search and selection process for a
new City Manager within a six (6) month period. The term of the City Manager Advisory
Committee will be for a term beginning on the date of acceptance of this resolution with
termination on 07/01/2019 or earlier if a City Manager is hired.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Edgewater,Florida:
Section 1. The City Council hereby establishes a City Manager Advisory Committee, for
the express purpose of reviewing, studying and assisting in the interview process (if needed) in
2019-R-01 I
the search for a new City Manager and to report the City Manager Advisory Committee
recommendations to the City Council and residents/citizens/employees of the City.
Section 2. The Committee shall consist of five (5) members who are
residents/citizens/employces of the City of Edgewater and who shall be appointed by Council in
the following manner:

Mayor Mike Thomas City- Wide
Councilwoman Christine Power District 1
District 2 VACANT District 2
Councilwoman Megan O'Keefe District 3
Councilman Gary Conroy District 4
Upon acceptance and taking of oath of office, each member shall be entitled to the duties
and responsibilities of the position. Only such persons who are registered voters/electors and
reside within the City of Edgewater on the effective date of this resolution shall be entitled to
membership of this Committee.
Section 3. The Mayor and members of the City Council shall serve in an ex officio
capacity with the Interim City Manager and City Attorney and/or City Clerk/Paralegal serving in
an advisory capacity to the Committee. In addition, the Committee may summon such other
employee of the City to assist them in completion of their tasks.
Section 4. The Committee shall meet at such regular times as they may agree or at the
call of the Chairman and shall review, suggest and/or assist in the interview process for the new
City Manager. The Committee will only have advisory duties and will only make non-binding
recommendations to the City Council. Recommendations shall be submitted to the City Council

with sufficient time for their review and for the interview process. The City Council shall make
the final determination for a City Manager.
Section 5. The Committee shall elect from its members a Chairman and Vice Chairman
to call and preside over meetings of the Committee. In addition thereto, the City will provide a
staff person as secretary to the Committee. The City shall provide adequate assistance to the
Committee that it may perform all duties imposed by this Resolution.
Section 6. All meetings of the Committee shall be public and the records thereof shall be
open to inspection. All members of the Committee shall be subject to the provisions of Chapter
286, Florida Statutes,relating to public meetings and records;public inspections and penalties.
Section 7. The Committee is requested to complete their review and submission of
potential applicants within a four(4) to six (6) month period of time from the date of adoption of
this Resolution.
Section 8.All resolutions or parts of resolutions in conflict herewith are hereby repealed.

The following are staffs responses to your entails and concems.
The following is in response to the 5/20/19 email
1. The zoning application requests that the City include the Public ROW for rezoning. The transmittal letter
from Parker Mynchenberg included with the application does include the ROW in the project description;
however,the proposed Ordinance and Zoning Map do not include the ROW.
2. The number of seats in the restaurant is shown to be 156 and 168 which is correct? The Site Plan was
originally submitted on August 21, 2018 and has been revised several times; the most recent Site Plan
submitted on April 12,2019 indicates a 156 seat restaurant
3. The water and sewer demand calculation does not include a determination of sufficient fire flow to the site.
Installation of the fire sprinkler system will require a separate permit Line size win be determined by the
Fire Engineer at that time,which may be different from the current site plan. Fire flow does not have any
impact on sewer demand
4. The lift station that receives this additional peak wastewater flow is likely substandard and has overflowed
into the Thorhallsson home several times. 1 saw no mention of a determination that the sewer collection
system can handle this increased wastewater flow. The wastewater collection system has sufficient
capacity to receive the increase in flow from the proposed development. The receiving Lift Station was
refurbished in October of 2013. Historic issues which resulted in back-ups at the Thorhallsson property
were corrected several years ago with the installation of a check valve.
5. The 100-year flood elevation is identified on the survey as elevation 6 feet. I find no mention of
compensating storage in the engineering report.The land development code(section 21-42.04)directs that
no compensating storage can occur below the 100-year flood elevation and the City must use the "cup for
cup" for creation of new storage. The same section of the code also states no compensating storage shall
occur in retention ponds A review indicates this site does not comply with the Code. Response from
Engineer of Record: "It has been our past experience with permitting projects near the intracoastal
waterway (ICW) that the St Johns River Water Management District (SJRWMD) as well as the Florida
Department of Environmental Protection (FDEP) do not apply the design criteria for 100-yr flood plain
impacts. Their reasoning is that the receiving water body functions as a boundary condition. For
development along the ICW,a boundary condition can be defined as a node in which no matter how much
volume is introduced, it will not raise the elevation of that receiving water body. The Edgewater Marina
project was recently permitted by the FDEP without requiring 100-yr compensatory storage. It was
important to the FDEP and the City to accommodate offsite Flows and assure that they are routed to the
ICW,however,a specific area set aside for flood plain impacts was not a requirement"

Response from City Engineer: FDEP issued an Environmental Resource Permit on 11/15/2018 for the
proposed work I confirmed with the signatory on the permit, Nathan Hess - Program Administrator for
Permitting,that FDEP includes consideration of floodplain impacts as part of their review process. Mr.Hess
stated that the issuance of their permit represents a determination that the proposed work would not
cause or contribute to adverse impacts in the Floodplain.Section 21-53.02 states "it is the intent of the City
to accept stormwater permits issued by SJRWMD in lieu of a City required permit", in this case FDEP was
the issuing agency via an operating agreement with SJRWMD.
6. The land development code (section 21-53.04 (h)) states that no exfiltration system is permitted in
Edgewater. If there is no other manner for incorporating stormwater,soil boring must be completed in the
area of the exfiltration trench. A review of the boring sites contained in the soils engineer's reports
indicated the sites for the boring were not the three pond or along the proposed exfiltration trenches.
Please have the Flood Plain Administrator review these issues. The City Engineer has reviewed the plans
and all associated calculations and finds them to be acceptable.
7. In summary, approximately 350 feet of 15-inch RCP pipe deliver stormwater to three pond which have a
single direct outfall to the Indian River. The engineered stormwater system provides for pollution
abatement and discharge attenuation of runoff generated onsite, including from Boston Road ROW. The
design also accommodates existing offsite flow which currently routes overland along Boston Road ROW to
the Indian River.
The following is in response to the 5/21/19 email
1. At the recent P&Z hearing (Edgewater Marina) Parker Mynchenberg P.E. indicated that a stormwater
permit has/would be issued by FDEP for the marina. The FDEP has stated in a previous pre-application
meeting dated 4-18-2016, that the use of Boston ROW for lomtion of stormwater ponds would require a
legal agreement/memorandum or the City would have to be a co-applicant My question is as follows: has
the City completed a legal agreement for use of the Boston ROW for stormwater or has the City made
application as a co-applicant Those attending the meeting at FDEP include Mr. Kowalski, Jack Brown,
Darren Lear, Randall Coslow P.E.,Tracey Barlow,John Palmer(ACOE) and Bill Cross (developer's engineer
of record at the time). A Non-Exclusive Use Agreement is being drafted and shall be executed by the City
and Developer upon adoption of the SPUD Agreement The Use Agreement between the City and Developer
shall specify that the Developer is responsible for maintenance of the proposed improvements within the
ROW.
2. l have recently learned the submerged land lease (number 640002544) issued by the State of Florida for
2001 S. Riverside Drive has expired and considered revoked/cancelled/rescinded. The owner/applicant
will have to initiate a new application for a submerged land lease but keeping in mind that the submerged
land will continue to belong to the State of Florida and remain in its care,custody and control.Furthermore,
perhaps you were unaware that the expired lease contained language that prohibits any uses other than
commercial boating with no fueling facilities or waste pump station for commercial moorings and expiring
as of August 2018. Since all docks, mooring facilities and uses have been removed,the State of Florida has
revoked the expired lease permanently. Currently there are no plans for any development within the
submerged land. Development would be permitted separately.The fuel tank indicated on the site plan shall
also be permitted separately. The location of said fuel tank may be adjusted based on Life Safety/Fire Code
requirements.
3. As stated previously, there is a plat (1946) of this area that designates the Boston Road as a Public road
dedicated to the public Forever. The city of Edgewater, thereby, is considered the custodian and cannot
arbitrarily give the ROW to whomever it chooses because all of our lots of record depicted in this plat are
part of the Public Forever. Boston Road is not being vacated or deeded to the Developer; the City and
Developer will enter into a Non-Exclusive Use Agreement which permits the use and access of Boston Road
as well as improvements to the roadway and stormwater system reducing stormwater impacts on adjacent
properties.

The following is in response to Mrs.Thorhallsson's concern
1. As an adjacent property owner to the proposed Edgewater marina, 1 request that my name be added to the
appeal.This is based on the potential risk of loss of commercial use of my property,also known to the city
as the Seven Mile Fish Camp. Other challenges regarding safe and reasonable access to my property, the
increased potential for property Flooding and impact on the community have already been
identified. Access to 205 Boston Road has been addressed on the Site Plan and in the Non-Exclusive Use
Agreement The access points have been designed to send stormwater into the adjacent ponds; a slight
pitch is included in the design to allow the public stormwater to remain on public property and not drain to
the adjacent residential property.

My name is Maryann Thorhallsson and I live at 205 Fast Boston Road in Edgewater,immediately north of the
proposed mstaurant/retail/rental/marina at 2001 South Riverside Drive. I have lived here for 43 years and my

The original 1946 Plat of Riveredge Acres, includes many properties along Riverside Drive and U.S. 1,and the
specific roadways identified—Riverside Drive, U.S. 1 and Boston Road. It is clearly stated on this Plat that "all
Roads and Drives shown hereon(are dedicated)to the use of the Public forever."If this is valid,legal and
binding, then how can the developers gain private business use of this dedicated ROW roadway?
If the stipulations of this Plat still hold, then how were the developers permitted to state to me at a city meeting
in front of planning and zoning, interim city manager, and engineer,that my family's vehicles would be towed
away if they were not properly parked in my"allowed"parking spaces. I have a big family and lots of friends
after 43 years in this community.No city official spoke up in my defense at that meeting assuring me that this
was a public use roadway forever.
The most serious concern to me is losing unlimited and immediate access to the Boston Road ROW. This poses
a direct threat to health and safety issues in my immediate household. My daughter,who resides at this address,
is an on-call home health Nurse. She is on call sometimes seven days a week. She has to have immediate access
to Boston Rd. when called. My sixteen year old granddaughter who spends a great deal of time at my house,has
a rare vascular disorder known as Arteriovascular Malformation Syndrome. This causes spontaneous
hemorrhaging, that requires immediate emergency attention. In addition,my disabled husband has been
suffering from Parkinson's Disease for over 12 years,which is a progressive neurodegenerative disease. There
are times he can walk and times when he is wheelchair bound. We need to get quick medical attention if he
sustains a fall or other medical emergency. Emergency vehicles have to have rapid and unencumbered access to
my house. Under the current plan,there is no guarantee of immediate and unencumbered access due to the loss
of Boston Road ROW. This is unacceptable.
Contrary to the title of the article printed in the May 25ih,2019 Hometown News,I am not opposed to a
community-appropriate commercial development of 2001 S. Riverside Drive. Residential plans as well would
be most welcome. I am asking that both the city and the developers look a little more carefully at this out of
proportion development proposal. There has been no real dialogue about the significant inconveniences to my
family—easy vehicle access onto my property, garbage,mail,deliveries,vital emergency vehicle access, or
construction vehicle access for necessary upkeep on a 60 year old house. I am told that provisions will be trade
for these residential amenities,but there has been no mention of such residential accommodations in the
developers'planned use of Boston Road ROW.
I propose that the developers go back to the drawing board, a reasonable, ethical and community-minded
drawing board,and limit their construction plans to the property that they actually purchased, leaving Boston
Road open for free public use as it was intended. I ask that the city consider the public safety issues that arise
with this proposed business use of Boston Road ROW. I invite you to visit the site in question and look at the
reality and potential community impact of this proposal. Thank you.

Your application for a Department of the Army permit has been assigned number
SAJ-2016-00987. A review of the information and drawings provided shows the
proposed work is to remove the existing concrete fill east and south of the proposed
seawall along the shoreline, remove a concrete boat ramp and a vertical bulkhead
within the canal south of the property, install a new concrete seawall and rip-rap along
the east side, install a new concrete seawall along the canal, and maintenance dredge
the canal to minus five feet (-5') NGVD with the removal of approximately 485 cubic
yards of spoil material (upland disposal). The project is located at 2001 S. Riverside
Drive in Edgewater, Volusia County, Florida.

Your project, as depicted on the enclosed drawings, is authorized by two Nationwide
Permits (NWP): NWP —13 is for the placement of the seawall and rip-rap revetment for
shoreline stabilization, and NWP —35 is for the maintenance dredging of the canal. In
addition, project specific conditions have been enclosed. This verification is valid until
18 March 2017. Please access the U.S. Army Corps of Engineers' (Corps)
Jacksonville District's Regulatory webpage to access web links to view the Final
Nationwide Permits, Federal Register Vol. 77, dated February 21, 2012, specifically
pages 10270— 10290, the Corrections to the Final Nationwide Permits, Federal
Register 77, March 19, 2012, and the List of Regional Conditions. The website address

Please be aware this web address is case sensitive and should be entered as it
appears above. Once there you will need to click on "Nationwide Permits." These files
contain the description of the Nationwide Permit authorization, the Nationwide Permit
general conditions, and the regional conditions, which apply specifically to this
verification for NWP 13 and 35. Enclosed is a list of the six General Conditions,which

apply to all Department of the Army authorizations. You must comply with all of the
special and general conditions and any project speck condition of this authorization or
you may be subject to enforcement action. In the event you have not completed
construction of your project within the specified time limit, a separate application or re-
verification may be required.
The following special conditions are included with this verification:
1. Self-Cerfification of Compliance: Within 60 days of completion of the work
authorized, the attached"Self-Certification Statement of Compliance"must be
completed and submitted to the U.S,Army Corps of Engineers. Mail the completed
form to the Regulatory Division, Special Projects and Enforcement Branch, PO Box
4970, Jacksonville, Florida 32232.
2. Cultural ResourceslHistoric Properties:
a. No structure or work shall adversely affect impact or disturb properties listed
in the National Register of Historic Places (NRNP) or those eligible for inclusion in the
NRNP.
b. If during the ground disturbing activities and construction work within the
permit area, there are archaeologicallcultural materials encountered which were not the
subject of a previous cultural resources assessment survey (and which shall include,
but not be limited to: pottery, modified shell, flora, fauna, human remains, ceramics,
stone tools or metal implements, dugout canoes, evidence of structures or any other
physical remains that could be associated with Native American cultures or early
colonial or American settlement), the Permittee shall immediately stop all work and
ground-disturbing activities within a 100-meter diameter of the discovery and notify the
Corps within the same business day(8 hours). The Corps shall then notify the Florida
State Historic Preservation Officer(SHPO)and the appropriate Tribal Historic
Preservation Officers)(THPO(s))to assess the significance of the discovery and
devise appropriate actions.
c. Additional cultural resources assessments may be required of the permit area
in the case of unanticipated discoveries as referenced in accordance with the above
Special Condition ; and 0 deemed necessary by the SHPO, THPO(s), or Corps, in
accordance with 36 CFR 800 or 33 CFR 325, Appendix C (5). Based, on the
circumstances of the discovery, equity to all parties, and considerations of the public
interest, the Corps may modify, suspend or revoke the permit in accordance with 33
CFR Part 325.7. Such activity shall not resume on non-federal lands without wntten
authorization from the SHPO for finds under his or her jurisdiction, and from the Carps.

d. In the unlikely event that unmarked human remains are identified on non-
federal lands, they will be treated in accordance with Section 872.05 Florida Statutes.
All work and ground disturbing activities within a 100-meter diameter of the unmarked
human remains shall immediately cease and the Permittee shall immediately notify the
medical examiner, Corps, and State Archeologist within the same business day(8-
hours). The Corps shall then notify the appropriate SHPO and THPO(s). Based, on
the circumstances of the discovery, equity to all parties, and considerations of the public
interest, the Corps may modify, suspend or revoke the permit in accordance with 33
CFR Part 325.7. Such activity shall not resume without written authorization from the
State Archeologist and from the Corps.
3. Turbidity Barriers: Prior to the initiation of any of the work authorized by this
permit the Permittee shall install floating turbidity barriers with weighted skirts that
extend to within one foot of the bottom around all work areas that are in, or adjacent to,
surface waters. The turbidity barriers shall remain in place and be maintained until the
authorized work has been completed and all erodible materials have been stabilized.
4. Protected Species: The permittee shall comply with the"Standard Manatee
Conditions for In-Water Work—2011" designed to protect the endangered West Indian
Manatee provided in Attachment 2 of this permit.
5. Sea Turtle &Smalltooth Sawfish: The permittee shall comply with National
Marine Fisheries Service's"Sea Turtle and Smalltooth Sawfish Construction Conditions,
dated March 23, 2006 and provided in Attachment 3 of this permit.
6. Assurance of Navigation and Maintenance:The Permittee understands and
agrees that, if future operations by the United States require the removal, relocation, or
other alteration, of the structures or work herein authorized, or if in the opinion of the
Secretary of the Army or his authorized representative, said structure or work shall
cause unreasonable obstruction to the free navigation of the navigable waters, the
Permittee will be required, upon due notice from the Corps of Engineers, to remove,
relocate, or after the structural work or obstructions caused thereby, without expense to
the United States. No claim shall be made against the United States on account of any
such removal or alteration.
7. Regulatory Agency Changes: Should any other regulatory agency require
changes to the work authorized or obligated by this permit, the Permittee is advised that
a modification to this permit instrument is required prior to initiation of those changes. It
is the Permittee's responsibility to request a modification of this permit from the Cocoa
Regulatory Office.

8. Dredged Material Disposal: The Permittee shall place dredged material in the
self-contained, upland disposal she as detailed on the attached permit drawings in
Attachment 1. The Permittee shall maintain the upland disposal site to prevent the
discharge of dredged material and associated effluent into waters of the United States.
This letter of authorization does not give absolute Federal authority to perform the
work as specified on your application. The proposed work may be subject to local
building restrictions mandated by the National Flood Insurance Program. You should
contact your local office that issues building permits to determine 'rf your site is located
in a flood-prone area, and if you must comply with the local building requirements
mandated by the National Flood Insurance Program.

1. The time limit for completing the work authorized ends on date identified in the
letter. If you find that you need more time to complete the authorized activity, submit
your request for a time extension to this office for consideration at least one month
before the above date is reached.
2. You must maintain the activity authorized by this permit in good condition and in
conformance with the terms and conditions of this permit. You are not relieved of this
requirement if you abandon the permitted activity, although you may make a good faith
transfer to a third party in compliance with General Condition 4 below. Should you wish
to cease to maintain the authorized activity or should you desire to abandon it without a
good faith transfer, you must obtain a modification of this permit from this office, which
may require restoration of the area.
3. If you discover any previously unknown historic or archeological remains while
accomplishing the activity authorized by this permit, you must immediately notify this
office of what you have found. We will initiate the Federal and state coordination
required to determine if the remains warrant a recovery effort of if the site is eligible for
listing in the National Register of Historic Places.
4. If you sell the property associated with this permit you must obtain the signature of
the new owner in the space provided and forward a copy of the permit to this office to
validate the transfer of this authorization.
5. If a conditioned water quality certification has been issued for your project, you must

SEA TURTLE AND SMALLTOOTH SAWFISH CONSTRUCTION CONDITIONS
The Permittee shall Comply with the following protected species construction conditions:
a. the permittee shall imstruct all personnel associated with the project of the potential presence of
these species and the need to avoid collisions with sea turtles and s nalhooth sawfish. All
construction personnel are responsible for observing water-related activities for the presence of
these species.
b. The permittee shall advise all construction personnel that them are civil and criminal penalties for
harming,harassing,or killing sea to des or smatitoothh sawfish,which are protected under the
Endangered Species Act of 1973.
C. Siltation barriers shall be made of material in which a xa turtle m smAhae h sawfish cannot
become entangled,be properly secured,and be regularly monitored to avoid protected species
entrapment. Barriers may not block sea tur le or smalhooth sawfish entry to or exit from
designated critical habitat without prim agreement from the National Marine Fisheries Service's
Protected Resources INvisioo.,St.Petersburg,Florida.
d. All vessels associated with the construction pmject shall operate at"no wake/idle'speeds at all
times while in the construction area and while in water depths where the drall of the vessel
provides less than a four-foot clearmce from the bottom. All vessels will preferentially follow
deep-water routes(e.g.,marked channels)whenever possible.
e. If a sea matte or srnallmoth sawfisb is seen within 100 yards of the active daily
mnstructum1drelgiug operation or vessel movement,all appropriate precautions shall be
implemented to ensure its pnatectioa. These precautions shall include cessation of operation of
my moving equipment elosm than 50 beet of a sea mute m s nantooth sawfish. Opmation of any
mechanical construction equipment shall cease immediately if a sea tunle or smalltooth sawfish is
seen within a 50-R radius of the equipment. Activities may not resume until the protected species
has departed the project area of its own volition.
f Any collision with amPor injury to a sea bade or smalltooth sawfish shall be reported
immediately to the National Marine Fisheries Service's Protected Resources Division(727-824-

STANDARD MANATEE CONDITIONS FOR IN-WATER WORK
2011
The permittee shall comply with the following conditions intended to protect manatees from
direct project effects:
a. All personnel associated with the project shall be instructed about the presence of
manatees and manatee speed zones, and the need to avoid collisions with and injury to
manatees. The permittee shall advise all construction personnel that there are civil and
criminal penalties for harming, harassing, or killing manatees which are protected under
the Marine Mammal Protection Act, the Endangered Species Act, and the Florida
Manatee Sanctuary Act
b. All vessels associated with the construction project shall operate at"Idle Speed/No
Wake'at all times while in the immediate area and while in water where the draft of the
vessel provides less than a four-foot clearance from the bottom. All vessels will follow
routes of deep water whenever possible.
C. Siltation or turbidity barriers shall be made of material in which manatees cannot
became entangled, shall be properly secured, and shall be regularly monitored to avoid
manatee entanglement or entrapment. Barriers must not impede manatee movement.
d. All on-site project personnel are responsible for observing water-related activities for the
presence of manatee(s). All in-water operations, including vessels, must be shutdown if
a manatee(s)comes within 50 feet of the operation. Activities will not resume until the
manatee(s) has moved beyond the 50-foot radius of the project operation, or until 30
minutes elapses if the manatee(s) has not reappeared within 50 feet of the operation.
Animals must not be herded away or harassed into leaving.
e. Any collision with or injury to a manatee shall be reported immediately to the Florida Fish
and Wildlife Conservation Commission (FWC) Hotline at 1-886-4043922. Collision
and/or injury should also be reported to the U.S. Fish and Wildlife Service in Jacksonville
(1-904731-3336) for north Florida or in Vero Beach (1-772-562-3909) for south Florida,
and emailed to FWC at ImoeriledSoeaes(' mvFV�C.com.
t Temporary signs concerning manatees shall be posted prior to and during all in-water
project activities. All signs are to be removed by the permittee upon completion of the
project Temporary signs that have already been approved for this use by the FWC
must be used. One sign which reads Caution:Boaters must be posted. A second sign
measuring at least BY2" by 11" explaining the requirements for"Idle Speed/No Wake"
and the shut down of in-water operations must be posted in a location prominently
visible to all personnel engaged in water-related activities. These signs can be viewed

INTRODUCTION
Zev Cohen and Associates, Inc.(ZCA),Arbor Services was retained by the City of Edgewater to provide
confirmation of species identification and a Historic Tree confirmation for trees that were removed by the
owner prior to obtaining a permit.
The subject trees were located at 2001 South Riverside Drive, as depicted on the attached Tree
Assessment Map.
The City of Edgewater defines a Historic Tree in Section 21-55.05 as follows:
21-55.05-Historic Trees
Historic trees shall only be removed upon approval of a Tree Removal Permit granted by the City
Council. Historic trees are those listed in Section 21-55.06 that reach 36-inches DRH with the
exception of the Laurel Oak. (Emphasis added(

OBSERVATIONS
The property was visited on January 18, 2016. One subject tree was confirmed to be a live oak
(&ercus virginiana)with a bifurcated trunk at 42"yielding two separate Specimen Trees at DBH,
one elliptical in shape with an average diameter of 30.5^and the other 34.5".The identification was
easily made as the tree exhibits characteristic live oak habits and morphology.
The live oak was located at the northwest comer of the property near the previous structure. Based on
Google Street View images from 2014, the subject tree appeared to be in good health. The trunk of the
oak was bifurcated just below breast height and both resulting codominant stems appeared healthy. In
addition,it appears previous trimming efforts were done properly.
The second subject tree was a red cedar(Jumaeras silicicola) with a DBH of 24". Once again, the
identification was easily made using typical characteristic and morphology.
The red cedar was also located at the northwest corner of the property near the previous structure and live
oak. Based on Google Street View images from 2014,the subject tree appeared to be in good heahh No
other evidence was available to further evaluate the tree's health.
CONCLUSION
The subject trees evaluated were determined to be Specimens Trees according to Edgewater's LDC.
While the live oak was substantial with a diameter below bifurcation of 44S", it was less than 36"D8H
and does not meet the definition of a historic tree as defined in the City's LDC.It does however meet the
definition of a Specimen Tree and should be evaluated as such. In addition,the codominant stems of the
oak both measure greater than 18"so the tree represents two Specimen Trees in total.
In addition to the oak tree(sX another specimen tree, 24" red cedar, was removed. The red cedar also
meets the definition of a Specimen Tree and should be evaluated as such. This tree was also in good
health and images are enclosed.
Information in this report is for consideration and determinatiore am based solely on professional
experience, formal education, methodologies of the International Society of Arboriculture (ISA) and
identification resources used in common professional practice in the field of botany and arboriculture in
the state of Florida.

21-55.10-Enforcement
a. The Development Services Director, Building Official, Code Enforcement Officer or
designee shall issue a stop-work order to any person found in the act of cutting down,
destroying,damaging or removing trees in violation of this Section.
b. Historic/specimen trees removed in violation or this Section shall be replaced at a ratio of 2
inches per inch of caliper lost. In lieu of physical replacement, City Council may impose a
fee of$37.00 per cross sectional square inch lost or combination thereof.
SECTION 21-56 PARKING AND LOADING REQUIREMENTS
21-56.01. -Comprehensive Plan Reference
Chapter 163.3202, P.S. requires adoption of land development regulations to include safe and
convenient off-street parking and loading provisions. The provisions of Section 21-57 - Parking
and Loading Requirements are consistent with and implement the Comprehensive Plan contained
in the Future Land Use Element and Utilities Element.
Properties located in the Indian River Boulevard Corridor Overlay arc also subject to the
regulations contained in Article XVIII for parking and loading design layout.
21-56.02 - Off-Strecl Parking Standards
a. All required off-street parking shall be located a minimum of len feet(10') behind the right-

INTRODUCTION
Zev Cohen and Associates, Inc.(ZCA), Arbor Services was remind by the City of Edgewater to provide
confirmation of species identification and a Historic Tree confirmation for trees that were removed by the
owner prior to obtaining a permit.
The subject trees were located at 2001 South Riverside Drive, as depicted on the attached Tree
Assessment Map.
The City of Edgewater defines a Historic Tree in Section 21-55.05 as follows:

Historic trees shallonly be removed upon approval of a Tree Removal Permit granted by the City
Council. Historic trees are those listed in Section 21-55.06 that reach 36-inches DRH with the

OBSERVATIONS
The property was visited on January 18, 2016. One subject tree was confirmed to be a live oak
(Quercus virginiana)with a bifurcated trunk at 42"yielding two separate Specimen Trees at DBH,
one elliptical in shape with an average diameter of 30.5" and the other 34.5".The identification was
easily made as the tree exhibits characteristic live oak habits and morphology.
The live oak was located at the northwest comer of the property near the previous structure. Based on
Google Street View images from 2014,the subject tree appeared to be in good health. The trunk of the
oak was bifurcated just below breast height and both resulting codominanl stems appeared healthy. In
addition,it appears previous trimming efforts were done properly.
The second subject tree was a red cedar(Juniperus smaicofa) with a DBH of 24". Once again, the
identification was easily made using typical characteristic and morphology.
The red cedar was also located at the northwest comer of the property new the previous structure and live
oak Based on Google Street View images from 2014,the subject tree appeared in be in good health. No
other evidence was available to further evaluate the tree's health.
CONCLUSION
The subject trees evaluated were determined to be Specimens Trees according On Edgewater's LDC.
While the live oak was substantial with a diameter below bifurcation of 44.5", it was less than 36"DBH
and does not meet the definition of a historic tree as defined in the City's LDC. It does however meet the
definition of a Specimen Tree and should be evaluated as such. In addition,the codominant stems of the
oak both measure greeter Oran 19"so the tree represents two Specimen Trees in total.
In addition in the oak tree(s), another specimen tree, 24" red cedar, was removed. The red cedar also
meets the definition of a Specimen Tree and should be evaluated as such. This Iree was also in good
health and images are enclosed.
Information in this report is for consideration and determinations are based solely on professional
experience, formal education, methodologies of the International Society of Arboriculture (ISA) and

PROJECT LOCATION
The activities authorized by this permit are located at 2001 S. Riverside Drive,Edgewater,FL 32141 in
Volusia County.
PROJECT DESCRIPTION
The permittee is authorized to:
• Remove historic concrete fill east of the proposed seawall along the shoreline of the Indian River
North, a Class III Waterbody;
• Remove a concrete boat ramp and a concrete vertical bulkhead within a man-made canal adjacent to
the Indian River North;
• Install a new concrete seawall faced with rip-rap along the Indian River North;
• Install a new concrete seawall along the top of bank of a man-made canal; and
• Maintenance dredge a man-made canal.
Authorized activities are depicted on the attached exhibits.
AUTHORIZATIONS

Environmental Resource Permit
The Department has determined that the activity qualifies for an Environmental Resource Permit Therefore,
the Environmental Resource Permit is hereby granted,pursuant to Part IV of Chapter 373,Florida Statutes
(F.S.),and Chapter 62-330,Florida Administrative Code(F.A.C.).
Sovereignty Submerged Lands Authorization
The activity is located on sovereignty submerged lands owned by the State of Florida. It therefore also requires
authorization from the Board of Trustees of the internal Improvement Trust Fund(Board of Trustees),pursuant to
Article X,Section 11 of the Florida Constitution,and Section 253.77,F.S.
As staff to the Board of Trustees under Sections 253.002,F.S.,the Department has determined that the activity
qualifies for and requires a lease modification, as long as the work performed is located within the boundaries as
described and is consistent with the terms and conditions herein.
As staff to the Board of Trustees of the Internal Improvement Trust Fund(Board of Trustees)under Sections
253.002,F.S., the Department has determined that the activity qualifies for and requires a Letter of Consent, as long
as the work performed is located widen the boundaries as described and is consistent with the terms and conditions
herein.
During the term of this Letter of Consent you shall maintain satisfactory evidence of sufficient upland interest
as required by paragraph 18-21.004(3)(6),Florida Administrative Code If such interest is terminated or the
Board of Trustees determines that such interest did not exist on the date of issuance of this Letter of Consent,
this Letter of Consent may be terminated by the Board of Trustees at its sole option. If the Bond of Trustees

terminates this Letter of Consent,you agree not to assert a claim or defense against the Board of Trustees
arising out of this Letter of Consent.
Federal Authorization
Your proposed activity as outlined on your application and attached drawings does not qualify for Federal
authorization pursuant to the State Programmatic General Permit and a SEPARATE permit or authorization
may be required from the Corps.A copy of your permit application has been forwarded to the Corps for their
review. The Corps will issue their authorization directly to you or contact you if additional information is
needed If you have not heard from the Corps within 30 days from the date your application was received at
the local FDEP Office,contact the Corps at the Cocoa Beach ACOE Regulatory Office and contact number
321.504-3771,for status and further information.Failure to obtain Corps authorization prior to
construction could subject you to federal enforcement action by that agency.
Authority for review-an agreement with the USACOE entitled"Coordination Agreement Between the U.S.
Army Corps of Engineers(Jacksonville District)and the Florida Department of Environmental Protection,or
Duly Authorized Designee,State Programmatic General Permit",Section 10 of the Rivers and Harbor Act of
1899,and Section 404 of the Clean Water Act.
Coastal Zone Management
Issuance of this authorization also constitutes a finding of consistency with Florida's Coastal Zone
Management Program,as required by Section 307 of the Coastal Zone Management Act.
Water Ouality Certification
This permit also constitutes a water quality certification under Section 401 of the Clean Water Act,33 U.S.C.
1341.
Other Authorizations
You are advised that authorizations or pen-nits for this activity may be required by other federal,state,
regional,or local entities including but not limited to local governments or municipalities. This permit does
not relieve you from the requirements to obtain all other required permits or authorizations.
The activity described may be conducted only in accordance with the terms,conditions and attachments
contained in this document Issuance and granting of the permit and authorizations herein do not infer,nor
gusmntee,nor imply that future permits,authorizations,or modifications will be granted by the Department.
PERMIT CONDITIONS

activities,and to ensure the work is conducted in conformance with all the terms,conditions,and drawings
herein. If you are using a contractor,the contractor also should read and understood these conditions and
drawings prior to beginning any activity. Failure to comply with these conditions,including any mitigation

requirements,shall be grounds for the Department to revoke the permit and authorization and to take
appropriate enforcement action. Operation of the facility is not authorized except when detemaned to be in
conformance with all applicable rules and this permit and sovereignty submerged lands authorization,as
described.
SPECIFIC CONDITIONS-PRIOR TO CONSTRUCTION
1. A floating turbidity apron/curtain shall be installed around the entire project site prior to construction
and shall remain in place until construction is completed and turbidity within the work area has returned
to background levels. The turbidity barrier shall be inspected at least on a daily basis to ensure that it is
functioning properly.
SPECIFIC CONDITIONS—CONSTRUCTION ACTIVITIES
2. The project shall comply with applicable state water quality standards,including
a 62-302.500-minimum criteria for all surface waters at all places and at all times,
b. 62-302.500-Surface waters: general criteria,and
C. 62-302.400-Class III Waters—Recreation-Propagation and maintenance of a healthy,
well-balanced population of fish and wildlife.
3. Turbidity must be controlled to prevent violations of water quality pursuant to Role 62-302.530(69),
Florida Administrative Code. Turbidity shall not exceed 29 Nephelometric TurbidityUnits above
natural background conditions.
4. There shall be no stock piling of tools,materials(i.e., lumber,pilings,and debris)within waters/waters
of the state unless specifically approved in this permit. Any and all construction debris shall be
removed from wetlands/waters of the state within 14 days of completion of the work authorized by this
Permit.
5. Construction equipment shall not be repaired or refueled in waters of the state.
6. The riprap shall be$ee of sediment,debris and toxins or otherwise deleterious substances. Riprap shall
have a diameter of at last 12 inches to 3 feet.
7. There shall be a filter cloth/erosion control liner installed between the rip-rap material and the existing
ground.
S. Any proposed new structures or modifications to existing structures that are along the shoreline,in-
water or within wetlands at this commercial parcel will require a modification to this permit or a new
permit prior to any construction activities. Failure to do so may result in enforcement action by the
Department.
9. Any fill material used behind the seawall shall be clean fill and free of vegetative matter,trash,garbage,
toxic or hazardous waste or any other materials the Department considers unsuitable.
10. The limits of the wetlands within the man-made canal shall be delineated by silt fencing The permittee
bears the responsibility of notifying all construction workers that the silt fencing represents the limits of

the dredging activity. The permittee shall bear the responsibility of keeping all construction workers
and equipment out of the adjacent wetlands where work has not been permitted for impacts.
SPECIFIC MANATEE CONDITIONS
11. All personnel associated with the project shall be instructed about the presence of manatees and
manatee speed zones,and the need to avoid collisions with, and injury to manatees. The permittee shall
advise all construction personnel that there are civil and criminal penalties for harming,harassing,or
killing manatees which are protected under the Marine Mammal Protection Act, the Endangered
Species Act,and the Florida Manatee Sanctuary Act.
12. All vessels associated with the construction project shall operate at"Idle Speed/No Wake"at all times
while in the immediate area and while in water where the draft of the vessel provides less than a four-
foot clearance from the bottom. All vessels shall follow routes of deep water whenever possible.
13. Siltation or turbidity barriers shall be made of material in which manatees cannot become entangled,
shall be properly secured, and shall be regularly monitored to avoid manatee entanglement or
entrapment. Barriers shall not impede manatee movement.
14. All on-site project personnel are responsible for observing water-related activities for the presence of
manatees. All in-water operations, including vessels,shall be shut down if a manatee comes within 50
feet of the operation. Activities shall not resume until every manatee has moved beyond the 50-foot
radius of the project operation, or until 30 minutes has elapsed wherein a manatee has not reappeared
within 50 feet of the operation. Animals shall not be herded away or harassed into leaving.
15. Any collision with or injury to a manatee shall be reported immediately to the FWC Hotline at 1-888-
404-FWCC. Collision and/or injury should also be reported to the U.S. Fish and Wildlife Service in
Jacksonville (1-904-731-3336)for north Florida or Vero Beach (1-772-562-3909)for south Florida.
I6. Temporary signs concerning manatees shall be posted prior to and during all in-water project activities.
All signs are to be removed by the permittee upon completion of the project. Awareness signs that have
already been approved for this use by the Florida Fish and Wildlife Conservation Commission(FWC)
must be used. One sign measuring at least 3 ft. by 4 ft. which reads Caution:A•Jmrnree Area must be
posted. A second sign measuring at least 8 1/2" by 1 I" explaining the requirements for"Idle Speed/No
Wake'and the shutdown of in-water operations most be posted in a location prominently visible to all

17. No later than 60 days after permit issuance,permanent manatee educational steps must be installed by
the permittee. In the event the signs fade,become damaged or outdated,they must be replaced and
maintained for the life of the facility. The on-site locations and types of signs must be acceptable to the
Florida Fish and Wildlife Conservation Commission, which should be contacted at
ImpefiledSpecies@myfwc.com.The types of signs,sign vendors,and the process for FWC approval

GENERAL CONDITIONS FOR INDIVIDUAL PERMITS
The following general conditions are binding on all individual permits issued under chapter 62-330,F.A.C.,
except where the conditions are not applicable to the authorized activity,or where the conditions must be
modified to accommodatepmject-specific conditions.
18. All activities shall be implemented following the plans,specifications and performance criteria
approved by this permit.Any deviations must be authorized in a permit modification in accordance with
Role 62-330.315,F.A.C.Any deviations that are not so authorized may subject the permittee to
enforcement action and revocation of the permit under Chapter 373,F.S.
19. A complete copy of this permit shall be kept at the work site of the permitted activity during the
construction phase,and shall be available for review at the work site upon request by the Agency staff.
The pemrittee shall require the contractor to review the complete permit prior to beginning
construction.
20. Activities shall be conducted in a manner that does not cause or contribute to violations of state water
quality standards.Performance-based erosion and sediment control best management practices shall be
installed immediately prior to,and be maintained during and after construction as needed,to prevent
adverse impacts to the water resources and adjacent lends. Such practices shall be in accordance with
the Stare of Florida Erasion and Sediment Control Designer andRevierverManual(Florida
Department ofEnvironmental Protection andFlorida Department of Transportation June 2007), and
the Florida StormwaterErosion andSedimeniation Controllnspector'sManual(Florida Department
of Environmental Protection, Nonpoint Source Management Section, Tallahassee, Florida,July 1008),
which are both incorporated by reference in subparagraph 62-330.050(9)(6)5.,F.A.C.,unless a project-
specific erosion and sediment control plan is approved or other water quality control measures are
required as part of the permit.
21. At least 48 hours prior to beginning the authorized activities,the permittee shall submit to the Agency a
fully executed Form 62-330.350(1),"Construction Commencement Notice;'[October 1,20131, which
is incorporated by reference in paragraph 62-33 0.3 50(l)(d),F.AC.,indicating the expected start and
completion dates.A copy of this form may be obtained from the Agency,as described in subsection 62-
330.010(5),F.A.C.If available,an Agency website than fulfills this notification requirement may be
used in lieu of the form.
22. Unless the permit is transferred under Rule 62-330.340,F.A.C.,or transferred to an operating entity
under Rule 62-330.310,F.A.C.,the permittee is liable to comply with the plans,terms and conditions of
the permit for the life of the project or activity.
23. Within 30 days after completing construction of the entire project,or any independent portion of the
project,the permittee shall provide the following to the Agency,as applicable:
a. For an individual,private single-family residential dwelling unit,duplex,triplex,or quadmplex
—"Construction Completion and Inspection Certification for Activities Associated With a
Private Single-Family Dwelling Unif'[Form 62-330.310(3)];or
b. For all other activities—"As-Built Certification and Request for Conversion to Operational
Phase"[Form 62-330.310(1)].

e If available,an Agency website that fulfills this certification requirement may be used in lieu
of the forth.
24. If the final operation and maintenance entity is a third party:
a Prior to sales of any lot or unit served by the activity and within one year of permit issuance,or
within 30 days of as-built certification, whichever comes first,the permittee shall submit,as
applicable,a copy of the operation and maintenance documents(see sections 12.3 thru 12.3.3
of Volume I)as filed with the Department of State,Division of Corporations and a copy of any
easement,plat,or deed restriction needed to operate or maintain the project,as recorded with
the Clerk of the Court in the County in which the activity is located.
I. Within 30 days of submittal of the as-built certification,the permittee shall submit"Request
for Transfer of Environmental Resource Permit to the Perpetual Operation Entity"[Form 62-
330.310(2)]to transfer the permit to the operation and maintenance entity,along with the
documentation requested in the form. If available,an Agency website that fulfills this transfer
requirement may be used in lieu of the form.
25. The permittee shall notify the Agency in writing of changes required by any other regulatory agency
that require changes to the permitted activity,and any required modification of this permit must be
obtained prior to implementing the changes.
26. This permit does not:
It Convey to the permittee any property rights or privileges,or any other rights or privileges other
than those specified herein or in Chapter 62-330,F.A.C.;
b. Convey to the permittee or create in the pemuttee any interest in real property,
C. Relieve the permittee from the need to obtain and comply with any other required federal,state,
and local authorization,law,rile,or ordinance;or
EL Authorize any entrance upon or work on property that is not owned,held in easement,or
cumolled by the pemuttee.
27. Prior to conducting any activities on state-owned submerged lands or other lands of the state,title to
which is vested in the Board of Trustees of the Internal Improvement Trust Fund,the permittee must
receive all necessary approvals and authorizations under Chapters 253 and 258,F.S. Written
authorization that requires formal execution by the Board of Trustees of the Internal Improvement Trust
Fund shall not be considered received until it has been fully executed.
28. The permittee shall hold and save the Agency harmless from any and all damages,claims,or liabilities
that may arise by reason of the construction,alteration,operation,maintenance,removal,abandonment
or use of any project authorized by the permit
29. The permittee shall notify the Agency in writing:
a Immediately if any previously submitted information is discovered to be inaccurate;and
b. Within 30 days of any conveyance or division of ownership or control of the property or the
system,other than conveyance via a long-term lease,and the new owner shall request transfer
of the permit in accordance with Rule 62-330.340,F.A.C. This does not apply to the sale of

lots or units in residential or commercial subdivisions or condominiums where the stormwater
management system has been completed and converted to the operation phase.
30. Upon reasonable notice to the permittee,Agency staff with proper identification shall have permission
to enter,inspect,sample and test the project or activities to ensure confomuty with the plans and
specifications authorized in the permit.
31. If any prehistoric or historic artifacts,such as pottery or ceramics,stone tools or metal implements,
dugout canoes,or any other physical remains that could be associated with Native American cultures,
or early colonial or American settlement are encountered at any time within the project site area, work
involving subsurface disturbance in the immediate vicinity of such discoveries shall cease_The
permittee or other designee shall contact the Florida Department of State,Division of Historical
Resources,Compliance and Review Section,at(850)245-6333 or(800)847-7278,as well as the
appropriate permitting agency office. Such subsurface work shall not resume without verbal or written
authorization from the Division of Historical Resources. If unmarked human remains are encountered,
all work shall stop immediately and notification shall be provided in accordance with Section 872.05,
F.S.
32. Any delineation of the extent of a wetland or other surface water submitted as part of the permit
application,including plans or other supporting documentation,Mall not be considered binding udess a
specific condition of this permit or a formal determination under Rule 62-330.201,F.A.C.,provides
otherwise.
33. The permittee shall provide routine maintenance of all components of the stormwater management
system to remove trapped sediments and debris. Removed materials shall be disposed of in a landfill or
other uplands in a manner that does not require a permit under Chapter 62-330,F.A.C.,or cause
violations of state water quality standards.
34. This permit is issued based on the applicant's submitted information that reasonably demonstrates that
adverse water resource-related impacts will not be caused by the completed permit activity.If any
adverse impacts result,the Agency will require the permittee to eliminate the cause,obtain any
necessary permit modification,and take any necessary corrective actions to resolve the adverse impacts.
35. A Recorded Notice of Environments] Resource Permit may be recorded in the county public records in
accordance with subsection 62-330.090(7),F.A.C. Such notice is not an encumbrance upon the
property.
SPECIAL CONSENT CONDITIONS
36. The applicant agrees to indemnify,defend and hold harmless the Board of Trustees and the State of
Florida from all claims,actions, lawsuits and demands in any form arising out of the authorization to
use sovereignty submerged lands or the applicant's use and construction of structures on sovereignty
submerged lands. This duty to indemnify and hold harmless will include any and all liabilities that are
associated with the structure or activity including special assessments or taxes that are now or in the
future assessed against the structure or activity during the period of the authorization.
37. Failure by the Board of Trustees to enforce any violation of a provision of the authorization or waiver
by the Board of Trustees of any provision of the authorization will not invalidate the prevision not

enforced or waived,nor will the failure to enforce or a waiver prevent the Board of Trustees from
enforcing the unenforced or waived provision in the event of a violation of that provision.
38. Applicant binds itself and its successors and assigns to abide by the provisions and conditions set forth
in the authorization. If the applicant or its successors or assigns fails or refuses to comply with the
provisions and conditions of the authorization,the authorization may be terminated by the Board of
Trustees after written noticeto the applicant or its successors or assigns. Upon receipt of such notice,
the applicant or its successors or assigns will have thirty(30)days in which to correct the violations.
Failure to correct the violations within this period will result in the automatic revocation of this
authorization.
39. All costs incurred by the Board of Trustees in enforcing the terms and conditions of the authorization
will be paid by the applicant Any notice required bylaw will be made by certified mail at the address
shown on page one of the authorization. The applicant will notify the Board of Trustees in writing of
any change of address at least ten days before the change becomes effective.
40. This authorization does not allow any activity prohibited in a conservation easement or restrictive
covenant that prohibits the activity.
GENERAL CONDITIONS FOR SOVEREIGNTY SUBMERGED LANDS AUTHORIZATION
Any use of sovereignty submerged lands is subject to the following general conditions are binding upon the
applicant and are enforceable under Chapter 253,F.S.
41. Sovereignty submerged lands may be used only for the specified activity or use. Any unauthorized
deviation from the specified activity or use and the conditions for undertaking that activity or use will
constitute a violation. Violation of the authorization will result in suspension or revocation of the
applicant's use of the sovereignty submerged lands unless cured to the satisfaction of the Board of
Trustees.
42. Authorization under Rule I8-21.005,F.A.C.,conveys no title to sovereignty submerged lands or water
column,nor does it constitute recognition or acknowledgment of any other person's title to such land or
water.
43. Authorizations under Rule 18-21.005,F.A.C.,may be modified,suspended or revoked in accordance
with its terms or the remedies provided in Sections 253.04,F.S.and Chapter 18-14,F.A.C.
44. Structures or activities will be constructed and used to avoid or minimize adverse impacts to resources.
45. Construction, use,or operation of the structure or activity will not adversely affect any species which is
endangered,threatened or of special concern,as listed in Rules 68A-27 003,68A-27.004,and 68A-
27.005,F.A.C.
46. Structures or activities will not unreasonably interfere with riparian rights. When a court of competent
jurisdiction determines that riparian rights have been unlawfully affected,the structure or activity will
be modified in accordance with the court's decision.
47. Structures or activities will not create a navigational hazard.

48. Structures will be maintained in a functional condition and will be repaired or removed if they become
dilapidated to such an extent that they are no longer functional.
49. Structures or activities will be constructed,operated,and maintained solely for water dependent
purposes.
50. The applicant agrees to indemnify,defend and hold harmless the Board of Tnistees and the State of
Florida from all claims,actions,lawsuits and demands in any form arising out of the authorization to
use sovereignty submerged lands or the applicant's use and construction of structures on sovereignty
submerged lands. This duty to indemnify and hold harmless will include any and all liabilities that are
associated with the structure or activity including special assessments or taxes that are now or in the
future assessed against the structure or activity during the period of the authorization.
51. Failure by the Board of Trustees to enforce any violation of a provision of the authorization or waiver
by the Board of Trustees of any provision of the authorization will not invalidate the provision not
enforced or waived,nor will the failure to enforce or a waiver prevent the Board of Trustees from
enforcing the unenforced or waived provision in the event of a violation of that provision.
52. Applicant binds itself and its successors and assigns to abide by the provisions and conditions set forth
in the authorization. If the applicant or its successors or assigns fails or refuses to comply with the
provisions and conditions of the authorization,the authorization may be terminated by the Board of
Trustees after written notice to the applicant or its successors or assigns. Upon receipt of such notice,
the applicant or its successors or assigns will have thirty(30)days in which to correct the violations.
Failure to correct the violations within this period will result in the automatic revocation of this
authorization.
53. All costs incurred by the Board of Trustees in enforcing the terms and conditions of the authorization
will be paid by the applicant. Any notice required by law will be made by certified mail at the address
shown on page ane of the authorization. The applicant will notify the Board of Trustees in writing of
any change of address at least ten days before the change becomes effective.
54. This authorization does not allowmy activity prohibited in a conservation easement or restrictive
covenant that prohibits the activity.
NOTICE OF RIGHTS
This action is final and effective on the date filed with the Clerk of the Department unless a petition for an
administrative hearing is timely filed under Sections 120.569 and 120.57,F.S., before the deadline for filing a
petition. On the filing of a timely end sufficient petition,this action will not be final and effective until further
order of the Department. Because the administrative hearing process is designed to formulate final agency
action,the filing of a petition means that the Department's final action maybe different from the position taken
by it in this notice.

DRAWINGS AND INFORMATION CHECKLIST
Following Is a list of information that is to be verified and/or submitted by the Registered
Professional or Permittee:
1. All surveyed dimensions and elevations shall be certified by a registered Surveyor or Mapper under
Chapter 472,F.S.
2. The registered professional's cerification shall be based upon on-site observation of construction
(scheduled and conducted by the registered professional of record or by a project representative
under direct supervision) and review of as-built drawings,with field measurements and verification as
needed, for the purpose of determining if the work was completed in accordance with original
permitted construction plans,specifications and conditions.
3. If submitted.the as-buiit drawings are to be based on the permitted construction drawings revised to
reflect any substantial deviations made during construction. Both the original design and constructed
condition must be clearly shown. The plans need to be clearly labeled as "as-built" or "record"
drawings that clearly highlight (such as through 'red lines" or "clouds) any substantial deviations
made during construction.As required by law, all surveyed dimensions and elevations required shall
be verified and signed, dated and sealed by an appropriate registered professional. The following
information,at a minimum,shall be verified on the as-built drawings, and supplemental documents if
needed,
a. Discharge structures - Locations, dimensions and elevations of all, including weirs, orifices,
gales,pumps,pipes,and oil and grease skimmers;
b. Detention/Retention Area(s)— Identification number,size in acres, side slopes ftv), dimensions,
elevations, contours or cross-sections of all, sufficient to determine stage-storage relationships of
the storage area and the permanent pool depth and volume below the control elevation for
normally wet systems,
C. Side bank and underdrain filters,or ezfiltration trenches-locations,dimensions and elevations of
all. Including clean-outs, pipes, connections to control structures and points of discharge to
receiving waters;
d. System grading - dimensions, elevations, contours, final grades or cross-sections to determine
contributing drainage areas, flow directions and conveyance of runoff to the system discharge
point(s);
e. Conveyance-dimensions, elevations,contours,final grades or cross-sections of systems utilized
to divert off-site n i around or through the new system;
f. Benchmark(s)-location and description(minimum of one per majorwater control structure);
g. Datum- All elevations should be referenced to a vertical datum clearly identified on the plans,
preferably the same datum used In the permit plans.
4. Welland mitigation or restoration areas - Show the plan view of all areas, depicting a spatial
distribution of plantings conducted by zone (If plantings are required by permit),with a list showing all
species planted in each zone, numbers of each species, sizes,date(s) planted and identification of
source of material; also provide the dimensions, elevations, contours and representative cross-
sections depicting the construction.
5. Any additional information or outstanding submittals required by permit conditions or to document
permit compliance,other than long-ten monitoring or inspection requirements.

As a Coalition that's mission is to protect the Mosquito Lagoon section of the Indian River Lagoon,we
are very concerned about the new restaurant and retail shop that is being proposed for the property
located on the waterfront on Riverside Drive. We are opposed to the city giving licensing rights for
the eastern end of Boston Road to Aski Development. U.C. and we are also opposed to the proposed
rezoning request. Personally, as a neighbor that lives just north of the proposed development at 208
Virginia Street. a development of this size is not in keeping with the neighborhood character of the area.
As an environmentalist. I have been very upset with the large concrete seawall that has replaced
mangroves. As you know,the Indian River Lagoon has experienced extensive ecological destruction
over the last dozen years and to restore it to health many things need to happen and restoring living
shorelines is part of the solution. The fifty foot setback for building next to the lagoon was established
to protect the lagoon and granting permission for this large building to be built 15' from the water's
edge should not be allowed especially with the U.S. Geological Survey's"mid-range" projections that
"sea levels could rise as much as 19" by 2050. Our group has been doing regular lagoon cleanups and
this project will add to the ongoing trash that ends up in the mangroves and spoil islands.
The recent defeat of the proposed Half Cent Sales Tax Increase was a clear message that citizens are
very upset about the out of control development that is rapidly changing the character of Volusia
County. The proposed restaurant and bait shop is another example of the kind of projects that the vast
majority of citizens oppose. Please require the development to work within the existing zoning
regulations of Edgewater.

Dear Edgewater City Council and Interim City Manager Glenn Irby,
On behalf of the Edgewater Environmental Alliance,
We would like to state our opposition to the planned development under the agenda of Ordinance No.
2018-0-33 for 2001 South Riverside Drive.This proposed development goes against the alliance's
mission to protect the Mosquito Lagoon.
In 2016,the owner was issued a 'stop work order from the city because the required city and state
permits had not been applied for or issued prior to demolition and construction,which is not a positive
track record.We cannot in good faith support this initiative.Mangroves and historic trees were illegally
removed.There have been a series of code violations throughout this project.
The City's Comprehensive Plan states that there shall be a 50-foot setback from the mean high water for
any development along the Indian River.This is specifically for water quality,shoreline protection,
protection from flooding and prevention of runoff.The whole proposed construction site is below the
100 year flood zone and lack of the 50-foot setback will force storm water runoff into the Indian
River/Mosquito Lagoon as well as onto adjacent properties.This requirement exists both in the Land
Development Code and the Comprehensive Plan.The council may waive the Land Development Code
but may NEVER waive or change the Comprehensive Plan and must work within the confines of the
Comprehensive Plan.
The Coastal element also states that there shall be a maximum of 30%impervious area within a 100-foot
setback from the mean high water line of the Indian River which is also forthe aforementioned
protections.The proposed master plan for the Edgewater Marina depicts far less area for setbacks and
an excessive amount of impervious area within 100 feet of the Indian River. All told therewill beat
least 94 feet of impervious area and the anticipated negative impacts on the Lagoon is undeniable.
The Land Development Code does not allow for a developer to create a major stormwater protection
project on the Indian River.This code was specifically established to preserve water quality,shoreline
protection,protection from flooding and prevention of runoff.The developer will have you believe that
they are treating the stormwater but they are not.They will be contaminating the Lagoon in untold and
immeasurable quantities. The plan proposed allows for underground exfiltration which has the exact
same impact on the Lagoon as septic tanks.
Additionally,as our members are out on the canals and Lagoon almost every weekend doing clean-ups,
there is concern over an increase in litter on the waterway.The proximity of the dumpster to the Lagoon
and products from the restaurant/bar going into the Lagoon cause unease and undue burden on behalf
of the residents and the City of Edgewater.We are worried that this development will be another'hot

spot'for our volunteers to monitor and clean. Memorial Day weekend alone produced an unusually
excessive amount of litter at the parks in Edgewater and along Riverside Drive.Additional pockets of
neglect have been identified throughout the City of Edgewater in need of clean up.
