2ORDINANCE NO. 2. AN ORDINANCE PROVIDING FOR THE RULES AND REGULATIONS FOR THE OPERATION OF MOTOR VEHICLES WITHIN TRti CITY LIMITS OF THE CITY OF EDGEWATER, FLORIDA AND PROVIDING FOR PENALTY FOR THE VIOLATION OF ANY PROVISIONS EEREOF.v °.,..� BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. ADOPTION OF STATE LAW. All the provisions and, requirements of Florida Statutes, 1949, section 317.01 to 317.96, in regard to regulation of traffic on highways, insofar as such provisions are applicable to the driver of a vehicle, except those which by their very nature could have no application in a city, are hereby adopted as and made a part of this ordinance as fully as though set out herein. SECTION 2 USE OF STREETS BY PEDESTRIANS. STOPPING IN STREET. No vehicle, unless �i^n"an emergency, or to allow another vehicle or pedestrian to pass, shall be d\uble—parked in any street. No vehicle shall stop in 1. any street so as to'obstruct a crossing and shall not stop or stand within the intersection of dVv street. SECTION 4. DRIVING ON SIDEWALK. It shall be unlawfull to drive any vehicle in the city within any sidewalk area except at a temporary or permanent driveway. SECTION 5. DRIVING PAST BARRICADES. It shall be unlawful to drive any vehicle or animal past, aroung or over any barricade lawfully placed upon any street by the city which has been closed by such barricade, except upon consent of persond authorized to give such consent. SECTION 6. CROSSING FIRE HOSE. It shall be unlawful to drive any vehicle over any unprotected hose of the fire division of the city when such hose is in use at any fire in the city without the consent of the fire department officer in command. SECTION 7. DRIVING TO RIGHT OF PARKWAYS, ETC., DIVIDING STREETS. On a street divided longitudinally by a parkway, sunken way or viaduct, all vehicles shall keep to the right of such division. SECTION 8. STOPPING, ETC„ UPON APPROACH OF MaRGENCY VEHICLESi RIGHT OF WAY OF CERTAIN VEHICLES. Upon the approach of vehicles of the fire department, police patrol cars and all ambulances, all other vehicles shall stop as near the curb as possible and wait for same to pass. vehicles of the police and fire departments and funeral processions shall have the right of way on all streets. SECTION 9. STOPPING TO TAKE ON OR LET OFF PASSENGERS. Whenever motor vehicles shall stop to take on or let off passengers, such stop shall only be made in compliance with parking provisions of this chapter. When absolutely necessary, vehicles may draw up as near the right-hand curb as possible at street intersections and remain stopped only long enough to let passengers alight or enter vehicles. No vehicles shall be permitted to hold up traffic unnecessarily. SECTION 10, UNLAWFUL RIDING. It shall be unlawful for any person to ride on the radiator, hood, bumpers, fenders, running boards or any other part of the outside of any automobile, while said automobile is operated upon any of the public streets or thoroughfares within the city. SECTION 11, SAME - VIOLATIONS. Any person riding on the hood, radiator, fenders, bumpers, running boards or any other part of the outside of any automobile in violation of section 10 and the person operating any automobile upon which any person is so riding shall be deemed guilty of a violation of section 10. SECTION 12, sU" TURNS PROHIBITED ON CERTAIL STREETS. No sUs turns shall be permitted on U.S. Highway fl, or Riverside Drive. SECTION 13, DESIGNATING LIMITED PARKING AREAS, ONE-WAY STREETS AND THROUGH STREETS. The Chief of Police may designate certain places wherein vehicles can park only a limited time on any street in the city and the manner of such parking may be indicated by signs, lines, or other marking devices. The Chief of Police may also designate one-way streets, no parking areas, and through streets when properly marked. SECTION 14, ILLEGAL PARKING. It shall be unlawful in the city to park any motor vehicle at any time upon any public street under the circumstances listed below: (a) FOR PRIhL1RY PURPOSE OF ADVERTISING. For the primary purpose of advertising the same for sale, or for advertising thereon, or for advertising therefrom without a written permit from the traffic bureau of the city. (b) AT AN ANGLE. At an angle, except on those places where official signs or markings plainly indicate that angle parking is permitted. (c) ON BRIDGES. ETC. On bridges and elevated structures, unless signs indicate parking is permitted. (d) IN BUS STAiIDS ETC. In bus stands or terminals, or loading or unloading zones, except busses operating therefrom. (e) IN CROSSWALKS. Within any crosswalk, or so as to obstruct the same. (f) NEAR CROSSWALKS AT INTERSECTIONS Within twenty feet of any crosswalk bordering any street intersection or any posted bus stop. (g) NEAR OTEER VEHICLES. So that there shall be less than two feet clearance between it and another vehicle at both front and rear of same. (h) MORE THAN TWELVE INCHES FROI4 CURB. So that the front or rear wheel, or both such wheels, on the side of the vehicle nearest the side of the street shall be more than twelve inches from the curb, side or sidewalk of any street, all of which shall be paved. (i) OBSTRUCTING DRIVEWAYS. In front of any public or private driveway, or so as to obstruct same. (j) NPAR FIRE HYDRANTS. Within ten feet of any fire hydrant, except at fire hydrants where taxicab, bus for -hire or sightseeing car steads have been established by the department of public safety, such vehicle may park or be narked when in service and when the drivers thereof are within or are not more than ten feet away from same. (k) NEAR FIFE STATICII DRIVEVlAYS. Within twenty feet of any drive -way entrance leading to any fire station, or on the side of any street opposite the entrance to any fire station, within a distance of seventy-five feet from such entrance, provided that proper signs have been erected and when such amount of space shall be reserved and marked by signs. (1) IN INTERSECTIONS. Within any intersection. (m) WITH LIGHTS ON. During the nightime, if headlights are lighted, unless such headlights shall be depressed or dimmed. (n) IN NARROW STMTS. In any manner so as to prevent the free passage of any other vehicle when with its loed the vehicle passing shall not be more than nine feet in width. (o) ON ONE-WAY STREETS. On a designated one-way street so as to head the vehicle in the direction opposite to the direction which traffic is legally required to travel. (p) IN PARKWAYS. In any parkway on the side of any street or in or adjacent to any parkway situated in the center of any such street in the city, except where official signs or markings indicate parking is permitted. (q) ON RAILROAD TRACES. On any railroad track or within ten feet of the nearest rail of any railroad crossing, except where traffic control signs or signals would be obstructed thereby, and then not less than fifty feet from such signals. (r) ON ROArWAY OF STREET NOT ENTIRELY PAVED. Where there shall be no curb or sidewalk, and a portion of the street shall not be paved, so that more than twelve inches of the paved roadway shall be occupied by any such parked vehicle; provided, however, that upon streets where the space between any paved roadway and the side of such street shall be beautified and on which grass or shrubbery shall be planted by or with the approval of the city, vehicles shall not drive into or park within such space. (s) IN SCHOOL ZONES, HAZARDOUS OR CONGESTED PLACES. In any school zone, hazardous or congested place, where official signs indicate parking to be prohibited. (t) ON SIDEWALKS. On any sidewalk or sidewalk area, or so as to obstruct same. (u) WHERE SIGNS PROHIBIT. Where official signs prohibit parking. (v) NEAR STREET EXCAVATIONS OR OBSTRUCTIONS. Alongside of, or opposite to, any street excavation or obstruction when such parking shall obstruct traffic, or interfere with any construction or repair work. (w) IIS TAXI-STAIIDS. In any taxi -stand, sightseeing stand or for -hire cars when in service and the drivers of same are in attendance thereof. (x) NEAR TRAFFIC CONTROL SIGNALS AND SIGNS. Within thirty feet of any flashing beacon, stop sign or traffic control signal located at the side of the roadway. (y) ON LEFT SIDE OF STREET. With its left side to the curb, except on one-way streets where parking is permitted on both sides, and except on two-way streets where parking is permitted on one side of the street only. (z) UNATTENDED VEHICLES. Leave the vehicle unattended, without first having stopped the motor, locked the ignition and removed the ignition key, or without setting the emergency brake thereon. SECTION 15, HINDERING VEHICLE OF ANOTHER BEING PARKED. It shall be unlawful for any person in the city to stop his vehicle in a manner so as to hinder or prevent another vehicle which has previously stopped in compliance with the provisions of this ordinance, when it is the obvious intention of the driver of such other vehicle to back into a parking space. SECTION 16. IIToTjuDING VEHICLES ILLEGALLY PARKING. Members of the police division shall be vested with the authority, and it shall be their duty, to impound any unoccupied vehicle parked in violation of any of the parking regulations of the city and to release such vehicle to the duly identified owner thereof, mbject, however, to the payment of a court fine and to the payment of storage, towing and other impounding charges. SECTION 17, PERPffTS REWIRED FOR PARADES. It shall be unlawful for any persons to parade any public street of the city without having first obtained in writing the consent of the mayor of the city, authorizing such parade. In the absence of (/the mayor from C/ia the city, such consent may be granted by the city provided, however, that the provisions of this section shall not apply to funerals, fire companies or regular organized companies of the state militia or United States troops. SECTION 18, TRAINS OBSTRUCTING STREETS. No train, train of cars, or cars shall be permitted to obstruct and stand upon any public street in the city for a period of time of more than five minutes. SECTION 19, RED FLAG OR LIGHT ON LONG LOAD. It shall be unlawful to o-oerate a vehicle on the streets in the city when the loadcarried by such vehicle extends more than three feet beyond the end of such vehicle, unless a red flag or red light, depending upon whether the time shell be day or night, shall have been placed on the back end of such load. SECTION 20. Penalty: Any person who shall violate any of the provision of this Ordinance shall, upon conviction thereof be punished by a fine of not less than Ten ($10.00) or more than Two hundred fifty ($250.00) dollars or by imprisonment of not less than Five (5) or more than Thirty (30) days or by both such fine and imprison- ment, in the discretion of the Judge of the N.unicipal Court. SECTION 21. That all Ordinances or parts of Ordinances in conflict here- witli be and the same are hereby repealed. The above ordinance was read in full and passed by the unanimous vote of the City Council of the City of Edgewater, Florida at a regular meeting on the ` day of �� A. D., 1951. Upon motion duly made, seconded and unanimously carried, the require- ment of reading said ordinance upon second reading was waived and the ordinance was ordered put upon final passage. Passed by the unanimous vote of the City Council of the City of Edgewater, Florida, at a regular meeting of said Council held on the -24- day of A.
