1960-14RESOLUTION
A RESOLUTION DECLARING THAT THE CITY COUNCIL OF THE
CITY OF EDGEWATER, VOLUSIA. COUNTY, FLORIDA CONSENTS TO
AND AGREES TO ENTER INTO AN AGREEMENT WITH THE FLORIDA
EAST COAST RAILWAY COMPANY WHEREIN THE CITY OF EDGEWATER
IS GIVEN THE RIGHT AND PRIVILE TO CONSTRUCT, INSTALL
AND MAINTAIN A SUBGRADE 6-INCH GALVANIZED IRON WATER
PIPE ACROSS AND UNDER THE TRACK OF THE RAILWAY.
DE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA,
a municipal corporation of the State of Florida:
1. That the said City Council consents to and agrees to enter into an
agreement with J. Turner Butler and William A. Hallowes, as Trustees
of the property of Florida East Coast Railway Company, and not individually,
wherein and whereby said City of Edgewater is given the right and privilege
to construct, install and maintain a subgrade 6-inch galvanized iron water
pipe across and under the track of the Railway at the location more
particularly described in agreement attached hereto and as per Railway's
Plan Corr. File 128-1 dated December 6, 1960, attached hereto and made a
part hereof.
2. That the Mayor, with the attestation of the Deputy Clerk, be and they
are each hereby authorized and directed to execute the said agreement for
and on behalf of the City of Edgewater, a municipal corporation of the
State of Florida.
3. That this resolution shall take effect immediately upon its passage.
The above and foregoing Resolution was introduced by Councilman Seng
who moved this resolution be adopted, which motion was duly seconded by
Councilman Smith and upon a roll call vote taken, the same was
declared adopted this 28th day of December, A. D. 1960. Vote of said
Council on roll call being as followst-
