1962-20A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF EDGEYIATER, FLORIDA, TO MAKE PUBLIC STREET IM- PROVEMENTS BY SPECIAL ASSESSMENTS; DECLARING THE NATURE OF THE PROPOSED IMPROVEMENTS; DESIGNATING THE STREETS TO BE SO IMPROVED; FIXING THE PART OR PORTION OF THE EXPENSES THEREOF TO BE PAID BY SPECIAL ASSESSMENTS; INDICATING THE MANNER IN WHICH SAID SPECIAL ASSESSMENTS SHALL BE MADE; WHEN SAID ASSESSMENTS ARE TO BE PAID; AND DESIG- NATING THE LANDS UPON WHICH THE SPECIAL ASSESSMENTS SHALL BE LEVIED; AND FIXIP:G THE TOTAL ESTIMATED COSTS OF THE IMPROVEMENTS. BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: Section 1. That pursuant to Section 170.03 of the General Statutes of the State of Florida, the City Council of the City of Edgewater, Florida, hereby declares its intent to make the following public street improvements in the City of Edgewater, Florida, and to defray two thirds of the expense thereof by special assessment against all lotsand lands adjoining and contiguous or bounding and abutting upon such improvements or specially benefited thereby and further designated by the assessment plat hereinafter provided for, said streets being described as follows, to -wit: Streets To Be Improved Type of Improvements 1. Monson Drive & Riverview Oil and seal 2. 2/10's of a mile of Knapp Avenue, Pave between U.S. #1, #nd telephone pole past last house of said street 3. 400 feet of Ocean Avenue, from Pave Railroad to Flagler Avenue 4. Alice Street to Lake Street, thence Pave South to Flagler, thence North on Flagler to place of beginning 5. Hotel Avenue Oil and seal 6. Fernard Avenue Oil and seal 7. Virginia Avenue Pave 8. Evergreen Drive, in Florida Shores Pave �961;62 #20 Streets To Be Improved Type of Improvement g. Magnolia Avenue and Neptune Drive Pave 10. Orange Avenue Oil and seal 11. Riverside Drive to Highway Pave 12. Snyder and Hart Avenue to Pine Bluff Pave Street 13. Old County Road to Pearl Street Shell 14. Pearl Street to U.S. ,Y1 8hell 15. Valencia Drive Shell and oil Section 2. That the nature of the proposed improvements t the streets to be improved are set forth above in Section 1 of this resolution. Section 3. That the portion of expense for the improvements set forth in Section 1 above shall be defrayedin the following manner: One third (1/3) by the City of Edgewater, Florida, and two thirds (2/3) by all lots and lands and-3ands adjoining and contiguous or bounding and abutting the above described streets. It being the intention of the City Council of the City of Edgewater, Florida, to assess each abutting property owner or owners one third (1/3) of the two third s costs of said improvements. If the same person or persons shall own land or lands abutting upon both sides of said improvements, then such abutting owner or owners shall be assessed two thirds of said improve- ments abutting his land or lands. Section 4. Said assessments shall be made upon the assess- ment plat which shall be kept by the City Clerk of the City of Edgewater, Florida, and shall be based upon the actual costs to the city which costs shall be computed by the City Clerk and the department head under whose authority and directions said improvements were made. Section 5. Said assessments shall be paid within sixty days after said improvements have been satisfied or completed by the department head under whose authority and directions said improvements were made to the City Clerk. Upon receipt of such certificate, the City Clerk shall note on the assessment plat the date of such completion and shall forthwith, by certified mail, return receipt requested, notify such abutting property owner of the amount due the city by said property owner and the due date for the payment of such assessment. If one property owner owns more than one piece or parcel of land subject to assessment, one notice as above provided to such person shall be suffi- cient. section 6. The total estimated costs of the improvements is Section 7, The City Cleric of the City of Edgewater, Florida, be and she is directed to publish this resolution in the New Smyrna 3each News once a week for two consecutive weeks. Section S. That a public hearing date upon said resolution Is hereby designated as Monday, May 7, 1962, at the hour of 7:30 P.M. in the Community Center Hall, in the City of Edgewater, Volusia County, Florida, all those property owners desiring to object to said assessments and improvements are hereby notified to appear at said time and place to voice any objections they have to the same. Section 9. This resolution shall take effect immediately upon its final adoption by the City Council and its approval by the Mayor. The above and foregoing resolution was presented by Councilman Sen. , who moved its adoption, said motion being seconded by Councilman Palmateer and upon Poll Call vote, the said resolution was duly declared, adopted at the regular meeting of said Council held on the 16th day of April, A.D., 1962, the vote of said Coun- cil on said Roll Call being as follows:
