1961-18A RESOLUTION DECLARING THE INTENTION OF THE CITY OF EDGEWATER, FLORIDA, TO VACATE THAT PART OF CONNECTICUT AVENUE AS SHOWN ON PLAT OF HAWKS PARR COMPANY'S SUBDIVISION AS RECORDED IN MAP BOOK 1, PAGE 156, PUBLIC RECORDS OF VOLUSIA COUNTY, FLORIDA, LYING WEST OF THE WEST RIGHT-OF-WAY LINE OF U. S. HIGHWAY NO. 1, AND EAST OF THE SOUTH PRO- LONGATION OF THE WEST LINE OF THE EAST 10 FEET OF LOT 253 OF SAID HAWKS PARK COMPANY'S SUBDIVISION, AND PROVIDING FOR THE SERVICE OF NOTICE ON THE ABUTTING PROPERTY OWNERS AND THE TIME AND PLACE AT WHICH OBJECTIONS CAN BE HEARD BEFORE THE CITY COUNCIL. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That the City Council of the City of Edgewater, Florida, hereby declares its intention to vacate that part of Connecticut Avenue as shown on plat of Hawks Park Company's Sub- division as recorded in Map Book 1, page 156, Public Records of Volusia County, Florida, lying West of the West right-of-way line of U. S. Highway No. 1, and East of the South prolongation of the West line of the East 10 feet of Lot 253 of said Hawks Park Company's Subdivision. SECTION 2. That notice of this resolution shall be served upon all persons whose property abuts on that part of Connecticut Avenue as shown on plat of Hawks Park Company's Subdivision as recorded in Map Book 1, page 156, Public Records of Volusia County, Florida, lying West of the West right-of-way line of U. S. Highway No. 1 and East of the South prolongation of the West line of the East 10 feet of Lot 253, of said Hawks Park Company's Subdivision, by serv- ing a true copy of said resolution upon said persons and by publica- tion of this resolution for one publication in the New Smyrna Beach News, a newspaper of general circulation in the City of Edgewater, Florida, as to all persons who cannot be personally served. SECTION 3. That the City Council of the City of Edgewater, Florida, will hear objections to the vacating of that part of Con- necticut Avenue as shown on plat of Hawks Park Company's Subdivision as recorded in Map Book 1, page 156, Public Records of Volusia County, Florida, lying West of the West right-of-way line of U. S. Highway No. 1 and East of the South prolongation of the West line of the East 10 feet of Lot 253 of said Hawks Park Company's Subdivi- sion at the regular meeting of the City Council of the City of Edgewater, Florida, at the City Hall, Edgewater, Florida, on the 3rd day of April, 1961, at the hour of 7:30 o'clock P. M. SECTION k. That in the event the City Council of the City of Edgewater, Florida, passes an ordinance vacating that part of Con- necticut Avenue as shown on plat of Hawks Park Company's Subdivision as recorded in Map Book 1, page 156, Public Records of Volusia County, Florida, lying West of the West right-of-way line of U. S. Highway No. 1 and East of the South prolongation of the West line of the East 10 feet of Lot 253 of said Hawks Park Company's Subdivi- sion, that portion of Connecticut Avenue aforesaid shall revert to the abutting property owners as provided by operation of law. SECTION 5. That this resolution is enacted pursuant to the provisions of Section 112, Chapter 27432, Laws of Florida, 195i. The above and foregoing resolution was presented by Councilman Seng who moved its adoption, said motion being seconded by Councilman Beck and upon roll call vote, the said resolu- tion was duly declared adopted at the regular meeting of said Council held on the 20th day of March, 1961, the vote of said Council on said roll call being as follows: !, C.
