Lot Clearing Lien
I received the attached paperwork for placement of a $200.00 lien on the above-listed piece of
property supposedly owned by Thomas L. Maierle with A&M Financial Corp. as the mortgage
holder. In October 1998. the subject oroperty was transferred bv Certificate of Title to Jeff
T. Ferrell of Robersdale. Alabama.
Attached Code Enforcement paperwork reflects that on November 17, 1998 a courtesy letter was
reissued with a note that A&M Financial was the mortgage holder. On December 18, 1998 notes
state to issue a work order and on April 15, 1999 another note that Barb (Parks & Rec) was called
to have the area abutting Richport Lane cut.
The attached "Work Order/Per Code Enforcement" regarding lot clearing completed on April 19,
1999 regarding the subject property reflects the property owner is Thomas L. Maierle (incorrect
owner).
In paperwork supplied to our office, an Invoice (from the City Clerk's Office) in the amount of
$355.00 was mailed to Mr. Ferrell (correct owner) in Robersdale, Alabama for payment on an
outstanding invoice. On May 17, 1999, the City received a check in the amount of $3 5 5.00 from A
& M Financial Corp..

More and more cases have been coming forward for work or liens with incorrect property owners.
The City cannot place a lien on the property with an incorrect owner of record. Therefore, Code
Enforcement should research each case (even repeat violators) and verify all information prior to any
paperwork being generated (work orders, invoices, etc.). Once this process is initiated, hopefully
less errors will occur.
The attached paperwork is being returned to the City Clerk's Office along with a current printout
from the Property Appraiser's Office showing the current owner of record as of October 1998 to be
JeffT. Ferrell. Invoices for work performed on April 19, 1999 need to be re-invoiced to the correct
owner.
Code Enforcement should update their information regarding the owner of record on the subject
property and verify their information prior to forwarding incorrect documentation.

On December 18, 1998 a work order was issued to Jack Corder, Parks &
Recreation/Maintenance, to have the above subject property cut. As you are aware, lot
maintenance had recently been turned over to Mr. Corder's department. I never received a Work
Order/Per Code Enforcement from Mr. Corder's department which gives tlle particulars on the
maintenance performed, which is signed off by Mr. Corder. No reinspection was done at that
time.
On April 14, 1999, I received a complaint hom a female that the lot maintenance done by Parks
& Recreation/Maintenance had not been completed. I inspected the property on April 15, 1999,
and observed the rear of the property, which abuts Richport Lane, had not been cut. I contacted
Barbara of Parks & Recreation/Maintenance of the problem. The rear of the property was then
cut.
I have attached a copy of the disposition portion of the case, which shows the actions taken
regarding the property and I have also attached a copy of the original work order issued to Parks
& Recreation/Maintenance, a copy of the check the City received for the work done by the City.

information you may require.
