Hailey Vezza, 114 Orange Ave:discussed the Edgewater Animal Shelter and what we can do to help.
Bob Chew, 208 Virginia Sr: discussed the 1/2 cent sales taxes and how it could benefit the
community.
Gene Emter, 513Poriside Lane: congratulated newly elected Councilwoman Yaney, thanked Mayor
Thomas and Interim City Manager Glenn Irby for presenting the state of the city address. Also
thanked Brenda and Sam for presenting about the 1/2 cent sales tax. He also believes the Council
should be focusing on future city goals.
Michael Visconti, 316Pine Breeze Dr: thanked the City and Council for Whistle Stop Park and it
honored to have a sign representing his name.

thanked the City, the Council and the voters for Whistle Stop Park.
Elizabeth Lavette, 1810 Hibiscus Drive:discussed a recent conal clean up that she participated in.

6. CITY COUNCIL REPORTS
Councilwoman Yaney reported: attending the Crystal Apple Awards.
Councilwoman O'Keefe reported: touring Fire Station 55 and the Police Department. Reported
attending a CPR course at the Fire Department, social media training at UCF, the ribbon cutting at
Whistle Stop Park and the Health Hootenanny.
Councilman Conroy reported: that the Edgewater - New Smyrna Cemetary did a Veteran count and
has found 1,174 Veterans on the property going back to the Civil War and believes we should start
doing more to honor them.
Councilwoman Power reported.' attending Team Volusm Meetings, meeting with a utility rate
consultant and the TPO meeting. Discussed the County joining in on a law suit regarding the Oploid
epidemic.
Mayor Thomas reported: attending the Tatra fundraising event, discussed a conversation he had with
a Firefighter regarding overdoses and thanked Mrs. Lavatte for the work that she is doing to help
the Indian River Lagoon.

Kelsey Hanna reported that the Annual Police Awards Banquet is on Friday, May I77h and to let the
Clerks ice know if you plan on attending so you can be RSVP'd.
b. City Attorney
First - Edgewater Fire Rescue Association Case and in that case they are seeking a Declaratory
Judgment which would allow them to terminate certain contracts with the City which are open
ended. It is their position that they should be able to terminate those upon reasonable notice. The
City's position is that those are indefinite contracts and they should be in place as long as the
Edgewater Fire Association is supporting the Edgewater Fire Department and once it stops doing
that then that property should actually be deeded to the City. I filed an Answer and Affirmative
Defenses to the Complaint, also sent out written discovery asking for their documents and asking
them to answer certain written questions.
Also, your insurance company has decided to pick up the defense of the claim under a Reservation of
Rights Letter meaning that they don't feel there is any coverage for the claim as it is a non-monetary,
claim which is excluded under the polity but they will pay for the defense of the case so that's good
news.
2nd - John Ingles vs City of Edgewater - case seeking an Injunction which would prevent the City
from enforcing its Code Enforcement Action. The Plaintiff in the case was docking his boat in a
casual adjacent to his property and was cited for that Normally the proper procedure when you are
unhappy with a Cade Enforcement Action is to appeal that directly to the Circuit Court, instead they
are trying to get an injunction in county court to prevent the City from enforcing its Code. For those
reasons, I moved to dismiss the Complaint, which was granted by the Judge. The Judge gave them
Leave to Amend the Complaint to try to state a cause of action which they did. I then moved to
dismiss their Amended Complaint and that hearing is set for Wednesday.
