A RESOLUTION DECLARING THE INTENTION OF THE CITY
OF EDGEWATER, VOLDSIA COUNTY, FLORIDA TO VACATE
FLAGLER AVENUE AND RAILROAD STREET SOUTH OF THE
SOUTH LINE OF THE GERONIMO ALVAREZ GRANT AND OCEAN
AVENUE WEST OF THE RIGHT-OF-WAY OF THE FIARIDA EAST
COAST RAILROAD, AND PROVIDING FOR THE SERVICE OF
NOTICE UPON ABUTTING PROPERTY OWNERS AND THE TIME
AND PLACE AT WHICH OBJECTIONS CAN BE HEARD BEFORE
THE CITY COUNCIL.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA THAT:
1. The City Council of the City of Edgewater, Volusia County, Florida
hereby declares its intention to vacate Flagler Avenue and Railroad Street south
of the south line of the Geronimo Alvarez Grant and Ocean Avenue west of the
right-of-way of the Florida East Coast Railroad as shown on the official map
of the City of Edgewater, Florida.
2. Notice of this Resolution shall be served upon all persons whose
property abuts upon that portion of Flagler Avenue and Railroad Street which
lies south of the south line of the Geronimo Alvarez Grant and Ocean Avenue west
of the right-of-way of the Florida East Coast Railroad by serving a true copy
of this Resolution upon said persons, and by publication of this Resolution for
one publication in the "New Smyrna Beach News", said newspaper being a newspaper
of general circulation in the City of Edgewater, Florida as to all persons who
cannot be personally served.
3. The City Council of the City of Edgewater, Florida will hear ob-
jections to the vacation of Flagler Avenue and Railroad Street south of the
south line of the Geronimo Alvarez Grant and Ocean Avenue west of the right-of-way
of the Florida East Coast Railroad at the regular meeting of the City Council
of the City of Edgewater, Florida at the City Hall located in Edgewater, Florida
on January 14, 1953.
4. In the event the City Council of the City of Edgewater, Florida
passes an ordinance vacating Flagler Avenue and Railroad Street south of the
south line of the Geronimo Alvarez Grant and Ocean Avenue west of the right-of-way
of the Florida East Coast Railroad, those portions of the aforesaid streets
abandoned shall revert to the abutting property owner as provided by the
operation of Law.
5. This Resolution is enacted pursuant to the provisions of Sec-
tion 112, Chapter 27532, Laws of Florida 1951.
BE IT FURTHER RESOLVED THAT all Resolutions or parts of Resolutions
in conflict herewith be, and the same are hereby rescinded. And that this
resolution take effect immediately upon approval.
The above and foregoing Resolution was presented by Councilman
Hauehton , who moved its adoption, said motion being
seconded by Councilman Shaeffer ; and upon roll call
vote the said Resolution was duly declared adopted at the Heaularr:i :_c
meeting of said Council held the 24th day of December, A. D.
