03-15-2007 CITY OF EDGEWATER CITIZEN CODE ENFORCEMENT BOARD Thursday, March 15, 2007 2:00 P.M. COMMUNITY CENTER MINUTES CALL TO ORDER Chairperson Linda Johnson called the regular meeting of the Citizen Code Enforcement Board to order at 2:03 PM in the Community Center. ROLL CALL Members present: Linda Johnson, Ed Corn, Ben Delnigro, Alice Haldeman, Gene Mirabella, and Glenn Barnhill. Also present were Code Officer Mike McGrath, Attorney Glenn Storch and Board Secretary Shontella Jackson. Absent and excused: Jean Kayat notified the Board Coordinator on 3/12/07 at 10:18 am. APPROVAL OF MINUTES The Minutes for the regular meeting January 18, 2007 were presented to the MOTION by Ben Delnigro, SECOND by Gene Mirabella Board for approval. to adopt the minutes of Regular Citizen Code Enforcement Board on January 18, 2007 as written. MOTION CARRIED UNANIMOUSLY. SWEARING IN OF WITNESSES: Code Officer Mike McGrath. CASES IN COMPLIANCE: Code Officer Mike McGrath stated that the following cases are in compliance as of March 15, 2007:Case #2007-CE-1030 (A&B), 2529 Fern Palm., Edgewater, Florida; James E. Swartz. Violation of Section 21-35.01 (A) – outdoor storage/residential & Section 21-34.04 (B) – inoperable vehicle. Violation of Section 21-34.04 – Inoperable vehicles. Code Officer Mike McGrath presented the case summary to the Board. Code Officer Mike McGrath presented staff’s recommendation to find Morris E. & Betty Deturck Jtrs. in violation of Section 21-34.04 of the Land Development Code assessing a citation fine of $75.00 and an additional fine of $50.00 per day for each day the violation exists past March 16, 2007. Also for a lien to be placed on the property if not satisfied by March 21, 2007. No one was present to testify. The Board had a brief discussion.MOTION by Ed Corn, SECOND by Ben Delnigro that the Board finds Morris E. & Betty Deturck Jtrs. in violation of Section 21-34.04 of the Land Development Code assessing a citation fine of $75.00 and an additional fine of $50.00 per day for each day the property maintenance violation exists past March 16, 2007, and for a lien to be placed on the property if not satisfied by March 21, 2007. MOTION CARRIED UNANIMOUSLY. Case #2007-CE-100087, 2064 Guava Dr., Edgewater, Florida; Michael Cianciarulo. Violation of Section 21-36.03 – Outdoor storage/commercial. Code Officer Mike McGrath presented the case summary to the Board. Code Officer Mike McGrath presented staff’s recommendation to find Michael Cianciarulo in violation of Section 21-36.03 of the Land Development Code assessing a citation fine of $75.00 and an additional fine of $100.00 per day for each day the property maintenance violation exists past March 16, 2007; also for a lien to be placed on the property if not satisfied by March 21, 2007. No one was present to testify. The Board had a brief discussion.MOTION by Ben Delnigro, SECOND by Ed Corn that the Board finds Michael Cianciarulo in violation of Section 21-34.04 of the City of Edgewater Land Development Code assessing a citation fine of $75.00 and an additional fine of $100.00 per day for each day the violation exist past March 16, 2007 and for a lien to be placed on the property if not satisfied by March 21, 2007.MOTION CARRIED UNANIMOUSLY. BOARD DISCUSSION: Mr. Storch requested that the Board reconsider changing the Board meeting to the second Thursday of each month due to the County Council meeting date.
