COMMUNITY CENTER MINUTES CALL TO ORDER Chairperson Linda Johnson called the regular meeting of the Citizen Code Enforcement Board to order at 2:02 PM in the Community Center. ROLL CALL Members present: Linda Johnson, Ed Corn, Ben Delnigro, Alice Haldeman, Gene Mirabella, Glenn Barnhill and Jean Kayat. Also present were Code Officer Mike McGrath, Code Officer Robin Bell, Code Supervisor Angela DeSue, Attorney Glenn Storch and Board Secretary Shontella Jackson. APPROVAL OF MINUTES The Minutes for the regular meeting of October 19, 2006 were presented to the MOTION by Ed Corn, SECOND by Gene Mirabella to Board for approval. adopt the minutes of Regular Citizen Code Enforcement Board on October 19, 2006 as written. CASES IN COMPLIANCE: None. City of Edgewater Code Enforcement Board Minutes January 18, 2007 Page 1 of 4 NEW BUSINESS: Case #2006-CE-1039, 214 Flagler Ave. Edgewater, Florida; Elaine C. Graulich. Violation of Section 21-35.04 – Property maintenance. Code Supervisor Angela DeSue presented the case summary to the Board. Code Supervisor Angela DeSue presented staff’s recommendation to find Elaine C. Graulich in violation of Section 21-35.04 of the Land Development Code assessing a citation fine of $75.00 and an additional fine of $50.00 per day for each day the property maintenance violation exists past January 19, 2007. Also for a lien to be placed on the property if not satisfied by January 24, 2007. No one was present to testify. The Board had a brief discussion.MOTION by Ed Corn, SECOND by Glenn Barnhill that the Board finds Elaine C. Graulich in violation of Section 21-35.04 of the Land Development Code assessing a citation fine of $75.00 and an additional fine of $50.00 per day for each day the property maintenance violation exists past January 19, 2007, and for a lien to be placed on the property if not satisfied by January 24, 2007.MOTION CARRIED UNANIMOUSLY. Case #2006-CE-1008, 311 Joyce St., Edgewater, Florida; Vicki T. Phillips. Violation of Section 21-56.03 – Property maintenance. Code Robin Bell presented the case summary to the Board. Code Officer Robin Bell presented staff’s recommendation to find Vicki T. Phillips in violation of Section 21-56.03 of the Land Development Code assessing a citation fine of $75.00 and an additional fine of $50.00 per day for each day the property maintenance violation exists past January 19, 2007; also for a lien to be placed on the property if not satisfied by January 24, 2007. It is also recommended that the Board issue a Board Order requesting the City Manager approve the cutting of the grass by City Staff if the violation is not corrected by January 19, 2007 and that a lien is placed on the property. Strasser II in violation of Section 21-56.03 of the Land Development Code assessing a citation fine of $75.00 and an additional fine of $50.00 per day for each day the property maintenance violation exists past January 19, 2007; also for a lien to be placed on the property if not satisfied by January 24, 2007. It is also recommended that the Board issue a Board Order requesting the City Manager approve the cutting of the grass by City Staff if the violation is not corrected by January 19, 2007 and that a lien is placed on the property. Strasser II in violation of Section 21-56.03 of the Land Development Code assessing the $75.00 citation fine and an additional fine of $50.00 per day for each day the property maintenance violation exists past January 19, 2007. Also for a lien to be placed on the property if not satisfied by January 24, 2007. It is also recommended that the Board issue a Board Order requesting the City Manager approve the cutting of the grass by City Staff if the violation is not corrected by January 19, 2007 and that a lien is placed on the property.MOTION CARRIED UNANIMOUSLY. Case #2006-CE-100070, 1903 Mango Tree Dr., Edgewater, Florida; Thomas Belmonte Jr. Violation of Section 21-34.01 – Home Occupation. Code Officer Mike McGrath presented the case summary to the Board. Code Officer McGrath presented staff’s recommendation to find Thomas Belmonte Jr. in violation of Section 21-34.01 of the Land Development Code assessing a citation fine of $75.00 and an additional fine of $50.00 per day for each day the violation exists past January 19, 2007, and for a lien to be placed on the property if not satisfied by January 24, 2007. No one was present to testify. The Board had a brief discussion.MOTION by Ben Delnigro, SECOND by Ed Corn that the Board finds Thomas Belmonte Jr. in violation of Section 21-34.01 of the Land Development Code assessing the $75.00 citation fine and an additional fine of $50.00 per day for each day the violation exists past January 19, 2007 also for a lien to be placed on the property if not satisfied by January 24, 2007.MOTION CARRIED UNANIMOUSLY OLD BUSINESS: Election of Chair and Vice Chair City of Edgewater Code Enforcement Board Minutes January 18, 2007 Page 3 of 4 Chairperson Johnson opened the floor for discussion and nominations for chairperson and vice chairperson. The Board had a brief discussion. Glenn Barnhill nominated Linda Johnson to continue her role as Chairperson. No other nominations were presented. Gene Mirabella nominated Ben Delnigro for the Vice Chairman position. No other nominations were presented.MOTION by Glenn Barnhill, SECOND by Ed Corn that the Board re-elect Linda Johnson as Chairperson and elect Ben Delnigro as Vice Chairman to the Citizen Code Enforcement Board.
