180RESOLUTION 180 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA TO EXERCISE IT'SOPTION TO PURCHASE THE SEWAGE SYSTEM IN SILVER RIDGE SUBDIVISION IN THE CITY OF EDGEWATER, FLORIDA, EXCLUDING THEREFROM THE SEWAGE TREATMENT PLANT, FROM ALEXANDER CONSTRUCTION COMPANY AND THE SILVER RIDGE PRIVATE SERVICE CORPORATION, AND AUTHORIZING THE ACCEPTANCE BY THE CITY OF THE CONVEYANCE TO THE CITY OF THE SAID SEWAGE SYSTEM, EXCEPTING THE SEWAGE TREATMENT PLANT, AND AUTHORIZING THE ACCEPTANCE BY THE CITY OF AN EASEMENT FROM ALEXANDER CONSTRUCTION COMPANY OF AN EASEMENT FOR ROADWAY PURPOSES IN SILVER RIDGE SUBDIVISION IN THE CITY OF EDGEWATER, FLORIDA; AND AUTHORIZING ACCEPTANCE BY THE CITY OF A GRANT OR EASEMENT OR RIGHT TO USE THE SEWAGE TREATMENT PLANT IN THE SAID SILVER RIDGE SUBDIVISION SO AS TO FACILITATE THE MAINTENANCE AND OPERATION OF THE SEWAGE SYSTEM IN SILVER RIDGE SUBDIVISION BY THE CITY. WHEREAS, the City of Edgewater has heretofore been granted an option to purchase the sewage system in Silver Ridge subdivision in the City of Edgewater, Florida, and WHEREAS, it has been determined by the city that it would be in the best interest of the public for the city to acquire the said sewage system and to maintain and operate the same in Silver Ridge subdivision in the City of Edgewater, and WHEREAS, the city does intend to hook up the existing sewer system in Silver Ridge subdivision to the existing sewage system of the City of Edgewater as soon as practicable, and WHEREAS, the owner of the said subdivision has offered the use of the sewage treatment plant to the city until such time as the city can connect the existing sewage system in Silver Ridge subdivision to the existing city sewer system, and WHEREAS, the owner of Silver Ridge subdvision has offered to the city, at no cost to the city, a fifty foot easement for roadway purposes, so as to form a connecting link between Silver Ridge subdivision and Florida Shores, upon the condition that if the city does not use the said easement for roadway purposes, then it shall revert to the owner, and council WHEREAS, the city/is desirous of accepting said easement upon the condition stated. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER: Section 1. That the City of Edgewater does hereby exercise its option to purchase the sewage facilities and system in Silver Ridge subdivision, in the City of Edgewater, Florida, save and excepting therefrom the sewage treatment plant located therein. Section 2. That the City Council does hereby authorize the acceptance of the necessary conveyances from the owner of Silver Ridge subdivision to transfer to the City of Edgewater all sewage lines located in Silver Ridge subdivision, including all fittings and fixtures connected with pumping stations, together with all pumping stations and lift stations, together with all manhole covers and any and all other equipment necessary to maintain and operate the sewage system presently owned by Alexander Construction Company and/or Silver Ridge Private Service Corporation, but excluding therefrom the prefabricated sewage treatment plant located in Silver Ridge subdivision. Section 3. The city does hereby agree to maintain and operate and be liable for the said sewage system upon acceptance of delivery of the above referred to conveyances, and in consideration of the said conveyances, the city does agree to the following: a. That beginning with the operation of the said sewage system by the city, the city shall rebate ev s P611e14 e{ 10 yM.! annually^lo Alexander Construction Company,or until such time as the cost of installation of the sewage system has been repaid, whichever is the lesser, 20% annually of all revenue derived by the city from the operation of the said sewage system in Silver Ridge subdivision. b. The city does agree that for a period of ten years the Alexander Construction Company shall be entitled to receive all sewage tap -in fees resulting from connections to the city sewage system by private owners of lots in Silver Ridge subdivision,where wye connections are present on existing lines only. C. That although the city shall not own or. acquire title to the sewage treatment plant in Silver Ridge subdivision, Alexander Construction Company and/or the Silver Ridge Private Service Corporation shall grant to the city the right to enter upon, use, maintain and operate the said sewage treatment plant in order to facilitate the overall operation of the sewage system in Silver Ridge subdivision, provided however, that the city does agree to, at its earliest convenience, connect the existing sewage system in Silver Ridge subdivision to the existing sewage system of the City of Edgewater, Florida, and provided further, that the Alexander Construction Company shall have the right to sell the said sewage treatment plant,free of any and all claims of the city, at any time by ;giving the city ninety days written notice of intention to terminate the right of use of the said sewage treatment plant. Section 4. The city Council does hereby authorize the acceptance from Alexander Construction Company of a conveyance conveying to the city a fifty foot strip of land for street and roadway purposes from Alexander Construction Company so as to facilitate the connecting of Silver Ridge subdvision to Florida Shores at a point where the said street or roadway may be tied into Florida Shores at 25th Street in the City of Edgewater, Florida, the said conveyance to be accepted by the city with the condition that if the city does not, within a reasonable time, use the said land for roadway purposes, or attempts to use it at any time for other than roadway purposes, then the said land shall revert to Alexander Construction Company. Section 5. That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. Section 6. That this resolution shall take effect immediately upon its passage and approval by the Vice Mayor.
