193C RESOLUTION NO. 193 A RESOLUTION DECLARING THE RESULTS OF THE SPECIAL REFERENDUM ELECTION HELD IN THE CITY OF EDGEWATER, VOLUSIA COUNTY, FLORIDA ON THE 12TH DAY OF SEPTEMBER. A.D., 1967. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: Section 1. That from the canvass of the returns it is hereby declared that the result of the special referendum election held in the city of Edgewater, Volusia County, Florida, on September 12, 1967 is as follows: QUESTION NO. 1. Shall House Bill No. 1668 as amended by House Bill No. 12xx: An act amending Section 129 of Chapter 27532, Laws of Florida, special acts 1951 and Section 8 of Chapter 27532, Laws of Florida, special acts 1951 as amended by Chapter 20949, Laws of Florida, special acts 1953, and by Chapter 1310, Laws of Florida, special acts 1963 and by Chapter 1505, Laws of Florida, special acts 1965; being the charter of Edgewater, Volusia County, Florida, by providing that the terms of the Mayor and Councilmen shall be staggered beginning in 1967; providing a referendum therefor; and providing for an effective date be approved? Shall House Bill No. 1668 as amended by House Bill No. 12xx: An act amending Section 8 of Chapter 27532, Laws of Florida, special acts 1951, as amended by Chapter 29049, Laws of Florida, special acts 1953, and by Chapter 1310, Laws of Florida, special acts 1963, and by Chapter 1505, Laws of Florida, special acts 1965; being the charter of the City of Edgewater, Volusia County, Florida, providing for the division of the city of Edgewater, Florida into four (4) voting districts as set and defined in Ordinance No. 448 adopted by the City Council of Edgewater, Florida on September 8, 1965 so as to incorporate the presently existing voting districts into the charter of the city of Edgewater, Florida;and providing a referendum therefor; and providing for an effective date be approved? Shall House Bill No. 1668 as amended by House Bill No. 12xx: An act amending Section 14 of Chapter 27532, Laws of Florida, special acts 1951, as amended by Chapter 29049, Laws of Florida, special acts 1953; being the charter of the City of Edgewater, Volusia County, Florida, by providing that the Mayor and each of the four Councilmen be elected by the voters at large; providing a referendum therefor; and providing for an effec- tive date be approved? Shall House Bill No. 1668 as amended by House Bill No. 12xx: An act amending Section 13 of Chapter 27532, Laws of Florida, special acts 1951; being the charter of the city of Edgewater, Volusia County, Florida, which provides that the City Council may fill vacancies on the City Council if not more than two vacancies occur on the City Council at the same time, and further providing that should the office of Mayor become vacant the Vice Mayor shall succeed to Mayor; providing further, however, that if more than two vacancies occur on the City Council at the same time, then there shall be a special election to fill the said vacancies; providing a referendum therefor; and providing for an effective date be approved? Shall House Bill No. 1668 as amended by House Bill No. 12xx: An act amending Section 140 of Chapter 27532, Laws of Florida, special acts 1951, as amended by Chapter 29049, Laws of Florida, special acts 1953; being the charter of the City of Edgewater, Volusia County, Florida, by providing that in case of a tie vote upon the nomination and election of candidates for the office of Mayor or for Councilman, there shall be a special run-off election to determine the winner; providing a referendum therefor; and providing for an effective date be approved? Shall House Bill No. 1668 as amended by House Bill No. 12xx: An act amending Section 15 of Chapter 27532, Laws of Florida, special acts 1951; being the charter of the City of Edgewater, Volusia County, Florida; which provides for the election of a Vice Mayor from the City Council by the City Council and further, provides for the selection of an acting Mayor r J from the City Council by the City Council to serve in the absence of both the Mayor and the Vice Mayor; providing a referendum therefor; and providing for an effective date be approved? Shall House Bill No. 1668 as amended by House Bill No. 12xx: An act amending Section 26 of Chapter 27532, Laws of Florida, special acts 1951 and amending sections 27, 33 and 37 of Chapter 27532, Laws of Florida, special acts 1951; being the charter of the City of Edgewater, Volusia County, Florida, by providing that the City Council shall have the power to appoint an attorney at law, who shall be a graduate of an accredited law school, as Municipal Judge but that in the event the City Council does not appoint an attorney at law to serve as Municipal Judge, then the Munici- pal Court shall be presided over by the Mayor; and further providing that whenever in the city charter the expression " the Mayor as Municipal Judge" appears, the same shall be amended so as to read "Municipal Judge" only; providing a referendum therefor; and providing for an effective date be approved? Shall House Bill No. 1668 as amended by House Bill No. 12xx: An act amending Section 10 of Chapter 27532, Laws of Florida, special acts 1951, as amended by Chapter 29049, Laws of Florida, special acts 1953; being the charter of the city of Edgewater, Volusia County, Florida, by pro- viding that members of the City Council, including the Mayor, must own real and personal property within the city limits; providing a referendum therefor; and providing for an effective date be approved? That the city clerk be and she is hereby authorized to send a true copy of this resolution to the Secretary of State, State of Florida,for filing. Section 4. That all resolutions or parts of resolutions in conflict herewith be and the same are hereby recinded. Section 5. That this resolution shall become effective immediately upon its adoption by the city council and approval by the mayor. The above and foregoing resolution was presented by Councilman Bebbi npton who moved its adoption, said motion being seconded by Councilman Mosher . Upon roll call vote the said resolution was duly declared adopted at a special meeting of the said city council held on September 13, 1967.
