228RESOLUTION NO. 228 A RESOLUTION OF INTENTION TO REQUEST THE TRUSTEES OF THE INTERNAL IMPROVEMENT FUND OF THE STATE OF FLORIDA FOR A PERPETUAL DEDICATION TO THE CITY OF EDGEWATER, FLORIDA TO SUBMERGED AND SEMI -SUBMERGED LAND OF WHICH THE CITY OF EDGEWATER IS THE UPLAND OWNER, FOR THE PURPOSE OF FILLING IN THE SAID SUBMERGED AND SEMI - SUBMERGED LAND FOR USE BY THE PUBLIC FOR RECREATIONAL AND/OR PARK PURPOSES, AND FURTHER STATING THE INTENTION OF THE CITY COUNCIL TO DEVELOP AND USE THE SAME AS SOON AS REASON- ABLY PRACTICABLE. WHEREAS, the City Council of the City of Edgewater, Florida has determined that the citizens of the City of Edgewater need a larger and more adequate recreational and park area, and WHEREAS, the City Council is desirous of obtaining a perpetual dedication to this submerged and semi -submerged land from The Trustees of the Internal Improvement Fund of the State of Florida, which lies riparian to the upland hereinafter described, for the purpose of filling in the said submerged and semi -submerged land and to use the same for additional recreational and park area. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That the City of Edgewater does hereby intend to request a perpetual dedication from The Trustees of the Internal Improvement Fund of the State of Florida to the following described submerged and semi -submerged land lying and being in Volusia County, Florida, and to fill in and develop the same for park and/or recre- ational uses by the public of the City of Edgewater, Florida: Submerged and semi -submerged land lying Easterly of the Southerly 130 feet of Lot 4 L ASSESSOR'S SUBDIVISION of the G. ALVEREZ GRANT as shown on map in Map Book 3, Page 137 being more particularly described as follows: Commence at the Northeast corner of Section 33, T17S, R34E; thence N 29 W a distance of 1511.23 feet along the U. S. Government Meander Line to the Easterly prolongation of the Southerly line of Lot 4 L ASSESSOR'S SUBDIVISION of G. ALVEREZ GRANT as shown on map in Map Book 3, Page 137 of the Public Records of Volusia County, Florida; thence N 66 51 02 E 118.96 feet along the said Easterly prolonga- tion of the Southerly line of Lot 4 L for the Point of Beginning; thence continuing N 66 51 02 E 631.55 feet YvY along the said Easterly prolongation to the Westerly R/W line of the Intracoastal Waterway 500 foot R/W; thence N 24 22 01 W 129.94 feet along the said Westerly R/W line; thence S 66 51 02 W 641.95 feet; thence S 28 56 08 E 130.58 feet to the Point of Beginning, containing 1.90 acres more or less. SECTION 2. It is the intention of City Council at the present time that commercial concessions are not contemplated upon the said land when and if the said land is filled in and developed for use by the public of the City of Edgewater, Florida for recreational and/or park purposes. SECTION 3. The City Council does state its intention to develop the said submerged and semi -submerged land for recreation- al and/or park purposes as soon as is reasonably practicable and finances permit. SECTION 4. That all Resolutions or parts of Resolutions in conflict herewith be and the same are hereby rescinded. SECTION 5. That this Resolution shall take effect immediately upon its adoption by the City Council and approval by the Mayor. The above and foregoing Resolution was presented by Councilman Ledbetter who moved its adoption, said motion being seconded by Councilman Norman , and upon roll call vote, the said Resolution was duly declared adopted at a regular meeting of City Council held on March 4, 1968; the vote of said Council upon roll call being as follows: Approved this 4th day of March A.D., 1968.
