A RESOLUTION OF INTENTION TO
AMEND SECTION 13 of ORDINANCE
NO. 219 AS AMENDED BY SEC. 1
OF ORDINANCE NO. 346, COMMONLY
REFERRED TO AS SECTION 24-10
OF THE CODE OF ORDINANCES OF
THE CITY OF EDGEWATER, FLORIDA
SO AS TO PROVIDE THAT WHEN A
CHANGE OF CLASSIFICATION IN
ZONING IS SOUGHT THE PETITIONER
SHALL BEAR ALL ADMINISTRATIVE
EXPENSES INCURRED BY THE CITY
IN PROCESSING SAID APPLICATION
AND FURTHER PROVIDING'THAT NO
PERSON SHALL RE -PETITION THE
CITY COUNCIL FOR A CHANGE IN
ZONING CLASSIFICATION WITHIN
ONE YEAR AFTER AN INITIAL OR
PRIOR PETITION FOR RECLASSIFICATION
IN ZONING, UNLESS THERE HAS BEEN
A CLEAR CHANGE IN CIRCUMSTANCES,
TO BE DETERMINED BY THE ZONING
BOARD, AND FURTHER PROVIDING THAT
IT SHALL TAKE THE AFFIRMATIVE
VOTE OF THREE MEMBERS OF CITY
COUNCIL TO OVER RIDE THE RECOMMENDA-
TION OF THE ZONING BOARD ONCE THE
ZONING BOARD HAS DETERMINED THAT A
RE -PETITION DOES NOT CLEARLY SHOW
A CHANGE IN CIRCUMSTANCES; AND
PROVIDING AND SETTING A TIME AND
PLACE FOR PUBLIC HEARING ON THE
PROPOSED AMENDED ORDINANCE.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER,
FLORIDA:
SECTION 1. That the City Council does hereby announce its
intention to adopt an Ordinance amending Section 13 of Ordinance
No. 219 as amended by Section 1. of Ordinance No. 346, commonly
referred to as Section 24-10 of the Code of Edgewater, Florida so
as to provide that the owner of land seeking a change in zoning
classification shall bear all expenses incurred by the City in
processing said petition and further providing that no owner of
land who has once sought a change in zoning classification shall
re -petition the City Council for a change in zoning classification
on the same property or substantially the same property within one
(1) year after the initial or prior petition was filed with the
City, unless there is a clear showing of change in circumstances.
The question whether there has been a clear showing of change in
circumstances shall be solely determined by the Zoning Board of the
City of Edgewater, Florida; provided however, that in order for
the City Council to override the recommendation of the Zoning Board

relative to the question whether a clear change of circumstances
exists, the affirmative vote of three (3) members of the City
Council shall be necessary.
SECTION 2. That a public hearing shall be held in
connection with the next regularly scheduled meeting of the
City Council to be held on May 6, 1968 beginning at 7:30 P.M.
at the Community Center in Edgewater, Florida, for the purpose
of affording an opportunity to be heard to parties in interest
and citizens of Edgewater, Florida.
SECTION S. That a copy of this Resolution containing
this notice of public hearing shall be posted in three
conspicuous places within the City of Edgewater, one of
which shall be the bulletin board at City Hall, at least
fifteen (15) days prior to the public hearing specified herein.
SECTION 4. That all Resolutions or parts of Resolutions
in conflict herewith be and the same are hereby rescinded.
SECTION 5. That this Resolution shall take effect
immediately upon its adoption by the City Council and
approval by the Mayor.
The above and foregoing Resolution was presented by
Councilman Ledbetter who moved its adoption, said motion
being seconded by Councilman Dietz , and upon roll
call vote, the said Resolution was duly declared adopted at
a regular meeting of City Council held on April 15, 1968; the
vote of said Council upon roll call being as follows:
