267J RESOLUTION NO. 267 A RESOLUTION OF INTENTION TO CONSTRUCT AND ESTABLISH A FISHING PIER ON AND ABUTTING LAND OWNED BY THE CITY OF EDGE - WATER, FLORIDA, SAID FISHING PIER TO PROTRUDEINTO INDIAN RIVER NORTH, DECLARING THE INTENTION OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA TO SEEK PERMISSION FOR SAID PROJECT FROM THE VOLUSIA COUNTY COMMISSION, THE STATEgg,�.t__ OF FLORIDA, AND THE ARMY CORPS OF ENGINEERS, AND PROVIDING AN EFFECTIVE DATE THEREFOR. ��,., WHEREAS, the City Council of the City of Edgewater, Flo is desirous of constructing and establishing a fishing pier on and abutting land owned by the City of Edgewater, Florida, here- inafter more fully described, and WHEREAS, the Chamber of Commerce of the City of Edgewater, Florida has agreed to participate in said project, and WHEREAS, the City Council has determined that to construct a fishing pier will be in the best interest of the citizens of the City of Edgewater, Florida and will provide an additional means of recreation for said citizens. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA- - SECTION 1. That the City Council of the City of Edgewater, Florida does hereby declare its intention to construct and establish and maintain a fishing pier or wharf on and adjacent to land owned by the City of Edgewater, Florida lying and being in Volusia County, Florida and described as: The submerged, semi -submerged and filled land lying Easterly from the Southerly 140 feet of Lot 5, as measured on the East Right of Way Line of U. S. High- way 1, Lowd's Subdivision of Lot 2, Section 2, T18S, R34E, as recorded in Map Book 3, Page 81, Public Records of Volusia County, Florida, described as follows: Beginning at the Southeast corner of U. S. Lot 2, Section 2, T18S, R34E; thence North 270 30' West 138.62 feet; thence East 150 feet; thence South 271 30' East 138.62 feet; thence West 150 feet to the Point of Beginning. SECTION 2. That the said project shall be done in con- junction with the Chamber of Commerce of the City of Edgewater, n ^ , Florida. SECTION 3. That the City Council hereby declares its intention to seek approval and permission for said project from the County Commissioners of Volusia County, Florida, the State of Florida, by and through its appropriate agent or agency, and the Army Corps of Engineers. SECTION 4. That all Resolutions or parts of Resolutions in conflict herewith be and the same are hereby rescinded. SECTION 5. That this Resolution shall take effect immediately upon its adoption by the City Council and approval by the Mayor. The above and foregoing Resolution was presented by Councilman Dietz who moved its adoption, said motion being seconded by Councilman Dimm , and, upon roll call vote, the said Resolution was duly declared adopted at a regular meeting of the City Council of the City of Edgewater, Florida held on the 18th day of November A.D., 1968; the vote of said Council upon roll call being as follows: Mayor -2-
