RESOLUTION NO.389
A RESOLUTION AUTHORIZING THE MAYOR AND
CITY CLERK, ON BEHALF OF THE CITY OF
EDGEWATER, TO EXECUTE AN EASEMENT OF
FIVE (5) FEET IN WIDTH TO THE FLORIDA
POWER AND LIGHT COMPANY, A FLORIDA
CORPORATION, SAID EASEMENT LYING AND
BEING WITHIN LAND DEEDED TO THE CITY
OF EDGEWATER BY VOLUSIA COUNTY, FLORIDA
IN THAT CERTAIN DEED RECORDED IN OFFICIAL
RECORDS BOOK 523, PAGE 289, PUBLIC RECORDS
OF VOLUSIA COUNTY, FLORIDA, DECLARING THE o
GRANTING AND GIVING OF SAID EASEMENT TO
BE A PUBLIC PURPOSE AND IN THE BEST
INTEREST OF THE CITY OF EDGEWATER AND
PROVIDING AN EFFECTIVE DATE THEREFOR.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
EDGEWATER, FLORIDA:
SECTION 1. That the City Council does hereby declare
it to be in the best interest of the City of Edgewater to
give and grant unto Florida Power and Light Company, a
Florida Corporation, a five (5) foot easement in land owned
by the City of Edgewater, Florida for the construction and
maintenance of utility facilities and does hereby authorize
the Mayor and City Clerk to execute an Easement to said
Florida Power and Light Company, a Florida Corporation,
granting an easement to said Florida Power and Light
Company in and to the East five (5) feet of the following
described property in Volusia County, Florida:
Beginning at a point on the South line of the
Alvarez Grant, Section 52, T 17 S, R34 E., said
point being the Northwesterly corner of Edge-
water Acres Subdivision as shown on map in Map
Book 11, Page 299 of the Public Records of
Volusia County, Florida; thence S. 74 W 304.95
feet along the South line of the said Alvarez
Grant; thence S. 15 20 E 159.77 feet; thence
S. 3 32 E 316.82 feet; thence S. 7 22 E 180.96
feet; thence S. 17 29 30 E 101.59 feet; thence
S 24 01 30 E 519.56 feet; thence N 68 10 30
E 453.80 feet to the Westerly line of the
said Edgewater Acres Subdivision; thence N 21
49 30 W 1224.30 feet along the said Edgewater
Acres Subdivision Westerly line to the point
of beginning. Containing 12.00 acres more or
less and all being in Section 32, T 17 S,
R 34 E.
SECTION 2. That all Resolutions or parts of
Resolutions in conflict herewith be and the same are
hereby rescinded.
SECTION 3. That this Resolution shall take
effect immediately upon its adoption by the City
Council and approval by the Mayor.
The above and foregoing Resolution was presented
by Councilman Wiggins who moved its adoption,
said motion being seconded by Councilman Ganta ,
and, upon roll call vote, the said Resolution was duly
declared adopted at a regular meeting of the City Council
of the City of Edgewater, Florida held on the 15th day
of February A.D., 1971; the vote of said Council upon roll
call being as follows:
