432RESOLUTION NO. 432 A RESOLUTION AUTHORIZING THE ISSUANCE OF A PERMIT TO FILL SUBMERGED LAND TO ROBERT P. POLAND AND GAIL POLAND, THE UP -LAND OWNERS OF THE HEREINAFTER DESCRIBED PROPERTY IN VOLUSIA COUNTY, FLORIDA, THE ISSUANCE OF WHICH SAID PERMIT SHALL BE CONDITIONED UPON FULL COMPLIANCE BY THE SAID ROBERT P.POLAND W y„ AND GAIL POLAND WITH ANY REQUIREMENTS OF �ii', THE ARMY CORPS OF ENGINEERS AND ANY APPLICABLE ` STATE AGENCIES AND PROVIDING AN EFFECTIVE DATE THEREFOR. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That the application of Robert P. Poland and Gail Poland as the upland owners of the following described land in Volusia County, Florida., to -wit: That part of Lot 4, Lowds Subdivision as re- corded in Map Book 3, Page 81 of the Public Records of Volusia County, Florida., lying east of Riverside Drive, except the Southerly 2 feet (as measured on line parallel to U. S. No. 1 Highway), and property lying East of same described as follows: Submerged, semisubmerged and filled land lying Easterly of Lot 4, Lowd's Subdivision of Lot 2, Section 2, Township 18 South, Range 34 East, as recorded in Map Book 3, Page 81, of the Public Records of Volusia County, Florida, des- cribed as follows: Commence at the Southeast corner of U. S. Lot 2, thence N. 27 - 30 W. along the East line of said Lot 4 and 5 - 489 feet for the point of beginning; thence East 392 feet; thence S. 27 - 30 E. 150.5 feet; thence West 392 feet; thence N. 27 - 30 W. 150.5 feet to the point of beginning; for a fill permit is hereby approved, and the City Clerk is hereby authorized to issue said fill permit, the said permit being conditioned upon compliance with all regulations set forth by the Army Corps of Engineers and applicable State agencies. SECTION 2. That all Resolutions or parts of Resolutions in conflic t el rewith be and the same are hereby rescinded. SECTION 3. That this Resolution shall take effect immediately upon ifs aTopTion by the City Council and approval by the Mayor.
