488RESOLUTION NO. A RESOLUTION DECLARING THE RESULTS OF A REGULAR ELECTION HELD IN THE CITY OF EDGEWATER, VOLUSIA COUNTY, FLORIDA, ON NOVEMBER 6, 1973 FOR THE PURPOSE OF APPROVING 6 QUESTIONS COVERING CHARTER AMENDMENTS TO THE CITY CHARTER OF THE CITY OF EDGEWATER, FLORIDA AND PROVIDING AN EFFECTIVE DATE THEREFOR. �t BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1 That the following number of votes were cast concerning the following questions for proposed amendment of the City Charter of the City of Edgewater, Florida: Question 1: 11/3 9 votes for approval 2S7 votes against approval Question 2: 3 7R votes for approval 4{6y votes against approval Question 3: IMa votes for approval d 9 1 votes against approval Question 4: 57 J votes for approval votes against approval Question 5: S78 votes for approval aZ// votes against approval Question 6: Jr`1 0 votes for approval ;? 7Z votes against approval SECTION 2. That Questions 1, 3, 4,5 and 6 are hereby declared to be approved as proposed amendments to the City Charter of the City of Edgewater, Florida. µ9Y SECTION 3. That those proposed amendments so approved shall now be incorporated into the Charter of the City of Edgewater, Florida. SECTION 4. That all Resolutions or parts of Resolutions in conflict herewith be and the same are hereby rescinded. SECTION 5. That this Resolution shall take effect immediately upon its adoption by the City Council and approval by the Mayor. The above and foregoing Resolution was presented by Councilman Clinton who moved its adoption, said motion being seconded by Councilman Severance and upon roll call vote, the said Resolution was duly declared adopted at a Regular meeting of the City Council of the City of Edgewater, Florida held on the 7 th day of November, A.D., 1973. Shall the following proposed amendment to the City Charter of the City of Edgewater, Florida be approved: Charter•Section 39 (A) Merit Board The City of Edgewater Shall have a Merit Board, consisting of five (5) members, four of whom shall be ap- pointed by the City Council from the electorate of the City and the fifth member shall be nominated and appointed by the employees of the City of Edgewater. No elected official of the City of Edgewater, while in office, shall be eligible for membership on the Merit Board. The terms of appointment for the fifth member of the Merit Board shall be for one year, and term of appointment for the other four members shall be for three (3) years and shall be staggered. The City Council shall - which lish by Ordinance the duties and functions of the Merit Board, ch shall include but not necessarily be limited to Classification, Q fictions of employees, grievance procedures, rights of appeal for dis- ciplinary action. .The decisions and recommendations of the Merit Board shall be final, unless appealed to the City Council, which may reverse such decisions ar recommendation only by the unanimous vote of the City' Council.
