APPROVAL OF MINUTES a. AR-2019-4620 Minutes of the December 16,2019 Charter Review Committee Meeting A motion was made by Board Member Card, second by Vice Chair McKinney, to approve Minutes of December 16,2019.The MOTION was APPROVED by the following vote: Yes: 5- Ken Hooper,John McKinney,Gigi Bennington,Eric Rainbird,and Pat Card 3. DISCUSSION ITEMS a. AR-2019-4621 Final review of Charter Sections for modifications I Member Card made Motion to NOT consider a modification of the salary for council, Section 3.05 MOTION FAILED DUE TO LACK OF SECOND A motion was made by Board Member Hooper, second by Vice Chair McKinney, to approve section 3.05 as drafted by the City Attorney. The MOTION was APPROVED by the following vote: Yes: 5- Ken Hooper,John McKinney,Gigi Bennington,Eric Rainbird,and Pat Card section 3.08d approve as drafted by city attorney A motion was made by Board Member Hooper, second by Board Member Card, to approve section 3.08(d) as drafted by the City Attorney. The MOTION was APPROVED by the following vote: Yes: 5- Ken Hooper,John McKinney,Gigi Bennington,Eric Rainbird,and Pat Card A motion was made by Vice Chair McKinney, second by Board Member Card, to approve section 3.09(b)(1) for the ballot language as written. The motion FAILED by the following vote: No: 5- Ken Hooper,John McKinney,Gigi Bennington,Eric Rainbird,and Pat Card table 4.02 city manager relatives-have city attorney bring back A motion was made by Board Member Hooper, second by Board Member Card, to approve section 4.01 for city manager, section 4.05 for city attorney and section 4.06 for city clerk that a simple majority on hiring and firing of all three positions. The MOTION was APPROVED by the following vote: Yes: 5- Ken Hooper,John McKinney,Gigi Bennington,Eric Rainbird,and Pat Card table 4.02(12)city manager relatives-have City Attorney bring back different language 5.03(e) -can charter restrict employees running for council-City Attorney to review Items for further review by city attorney- 1) on the candidate nepotism issue-again there is no case law 2)can a charter prevent council member from having a personal relationship with an employee of city, since there is no case law on this, City Attorney cannot recommend this 3)can charter prevent a relative or significant other from being employed by the city-City Attorney responded that Cape Canaveral has an ordinance on this matter, again not tested in the courts so no guidance. City of Midway has a charter provision along those lines It was discussed that these are more personnel matters, not charter issues. City Attorney feels that this would be best by ordinance not charter. AR-2019-4621 Final review of Charter Sections for modifications A motion was made by Board Member Hooper, second by Board Member Rainbird, to add item (f) under General Powers citys obligation to protect the Indian River. The MOTION was APPROVED by the following vote: Yes: 5- Ken Hooper,John McKinney,Gigi Bennington,Eric Rainbird,and Pat Card 4.
