A RESOLUTION OF THE CITY OF EDGEWATER,
FLORIDA EXTENDING A STATE OF LOCAL
EMERGENCY RELATED TO CORONAVIRUS (COVID-
19); REPEALING RESOLUTIONS IN CONFLICT
HEREWITH; PROVIDING FOR SEVERABILITY AND
APPLICABILITY AND ESTABLISHING AN EFFECTIVE
DATE.
WHEREAS, a State of Emergency for the State of Florida was proclaimed by Governor
Ron DeSantis on March 9, 2020 in Executive Order Number 20-52 (Emergency Management
COVID-19 Public Health Emergency); and
WHEREAS, the County of Volusia declared a State of Local Emergency on March 13,
2020, as extended on March 17,2020 and March 24, 2020; and
WHEREAS, The City of Edgewater declared a State of Local Emergency on March 16,
2020 in Emergency Resolution No. 2020-R-10; and
WHEREAS, section 252.38(3)(a)(5), Florida Statutes, provides authority for
municipalities to declare a State of Local Emergency and to waive the procedures and formalities
otherwise required of municipalities in order to take the prudent actions necessary to ensure the
health, safety, and welfare of the community; and
WHEREAS, Chapter 252 of the Florida Statutes limits the duration of each state of
emergency declared locally to seven (7) days which may be extended, as necessary, for
additional terms in seven (7) day increments.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Edgewater
Florida.

SECTION 1. Due to the effects of Coronavirus (COVID-19) continuing to threaten the
health, safety and welfare of the residents of the City of Edgewater, effective immediately the
State of Local Emergency is extended throughout the City of Edgewater, Florida.
SECTION 2. The State of Local Emergency for the City of Edgewater shall run
concurrently with Volusia County's State of Local Emergency with the City declaration being
automatically extended concurrently with any additional seven-day extensions that may be
ordered by Volusia County, unless the City's State of Local Emergency is terminated earlier by
the City Council.
SECTION 3. Conflicting Provisions. All resolutions or parts of resolutions in conflict
herewith are hereby repealed.
SECTION 4. Severability and Applicability. If any portion of this resolution is for
any reason held or declared to be unconstitutional, inoperative, or void, such holding shall not
affect the remaining portions of this resolution. If this resolution or any provisions thereof shall
be held to be inapplicable to any person, property, or circumstances, such holdings shall not
affect its applicability to any other person, property, or circumstance.
SECTION 5. Effective Date. This resolution shall become effective immediately upon
passage and adoption.
