A RESOLUTION OPPOSING THE CONSTRUCTION
OF A OVERPASS ON STATE ROAD 44 TRAVERSING
THE EAST COAST RAILROAD TRACKS AND UNITED
STATES HIGHWAY ONE IN NEW SMYRNA BEACH,
REPEALING ALL RESOLUTIONS IN CONFLICT
HEREWITH, AND PROVIDING AN EFFECTIVE DATE
THEREFOR.
WHEREAS, the Florida Department of Transportation proposes to
construct an overpass on State Road 44 to traverse the Florida East Coast
Railroad tracks and United States Highway One, and,
WHEREAS, the City Council and concerned citizens of Edgewater,
Florida have expressed formal opposition to said overpass by various means
to appropriate State and Federal officials since it is felt that the proposed
overpass is an unnecessary expenditure of tax money and will create, rather
than alleviate, traffic congestion and noise in the area where the proposed
overpass is to be constructed.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF EDGEWATER, FLORIDA:
SECTION 1. The City Council of Edgewater, Florida hereby goes on
record as being strongly opposed to the construction of an overpass by the
State Department of Transportation on State Road 44, said overpass to traverse
the Florida East Coast Railroad tracks and United States Highway One in the
City of New Smyrna Beach, Florida.
SECTION 2. That unless said overpass is deleted from the proposed
widening and improvement of State Road 44, the City Council of Edgewater,
Florida will initiate immediate action to ask for a congressional investigation
of the proposed overpass.
SECTION 3. That all Resolutions or parts of Resolutions in conflict
herewith be and the same are hereby rescinded.
SECTION 4. That this Resolution shall take effect immediately upon its
adoption by the City Council and approval as provided by law.
