807IRESOLUTION NO. � O -7 A RESOLUTION ACKNOWLEDGING THE REQUIREMENTS CONTAINED IN THE VOLUSIA COUNCIL OF GOVERN- MENTS' 208 WATER QUALITY MANAGEMENT PLAN RELATED TO THE CITY OF EDGEWATER, FLORIDA AND INDICATING INTENT TO PROCEED WITH IMPLE- MENTATION OF THE PLANNING PROGRAM; REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to Section 208 of the Federal Water Pollution Con- trol Act, as amended (hereinafter called "the Act"), the Administrator of the United States Enviromental Protection Agency has designated the Volusia Council of Governments as the planning agency responsible for accomplishing water quality management planning within Volusia County; and WHEREAS, the City of Edgewater, Florida is an active member of the Volusia Council of Governments and has been identified pursuant to Section 208 of the Act as an agency to be designated by the Governor of the State of Florida to implement certain activities vital to accomplishing the goals and objectives of the planning program; and WHEREAS, regulations and guidelines published by the United States Environmental Protection Agency require that the affected general purpose units of government indicate their awareness of the assigned responsibilities as management agencies through formally adopted resolutions; and WHEREAS, the City of Edgewater, Florida has reviewed the recom- mended responsibilities as summarized in Chapter 1, Executive Summary and Chapter 15 Management Agencies, Table 15.14.2 through 15.14.26 of the Volusia Council of Governments' 208 Water Quality Management Plan; and WHEREAS, the City of Edgewater, Florida understands that financial grant assistance from the United States Enviromental Protection Agency will be available only to those designated management agencies, and only for those projects or activities which are identified in the Volusia Council of Governments' 208 Water Quality Management Plan; and WHEREAS, the City of Edgewater, Florida understands that failure to accept or perform these responsibilities may result in the transferral of all or any portion of the designated responsibilities to other management agencies, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1: That the City of Edgewater, Florida understands the responsibilities associated with formal designation as a management agency to accomplish assigned portions of the Volusia Council of Governments' 208 Water Quality Management Plan and hereby indicates its willingness to proceed with implementation of the assigned responsibilities. SECTION 2: That all Resolutions and parts of Resolutions in conflict herewith be and the same are hereby rescinded. SECTION 3: That this Resolution shall take effect immediately upon its adoption by the City Council and approval as provided by law.
