A RESOLUTION DECLARING THE NECESSITY OF
THE CITY OF EDGEWATER, FLORIDA, TO
CONDEMN CERTAIN DESCRIBED PROPERTY
FOR RIGHT OF WAY FOR SEWER MAINS, AND
DIRECTING THE CITY ATTORNEY TO FILE
CONDEMNATION PROCEEDINGS THEREUPON.
1 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER,
FLORIDA, AS FOLLOWS:
SECTION I. The City Council of the City of Edgewater, Florida, hereby determines
and declares that the following described parcels of property, to -wit:
For the extension of sewer main
PARCEL A - A parcel of land lying S feet either side of the
following described centerline: Commence at the intersection
of the Northerly R/W line of Indian River Blvd., as per Map
Book 23, page 57, of the Public Records of Volusia County,
Florida, and the Westerly R/W line of U. S. No. 1 Highway;
thence N 290 00' 30" West 147.6 feet for the point of beginning;
thence S 631 59' West 70 feet to a point which is approxi-
mately 10 feet North of the North bank of an existing
drainage ditch; thence S 780 03' 10" West 499.44 feet; to
the West line of Lot 8, Lowds Sub. as per Map Book 3,
page 81 of the Public Records of Volusia County, Florida,
said point being N 290 00' 30" West 297.78 feet from the
North R/W line of aforesaid Indian River Blvd; all being
part of Lot 8 aforesaid Lowds Sub. ; and all being in
Section 2, Township 18 South, Range 34 East.
For a proposed 10 foot construction easement
PARCEL B - A parcel of land lying 5 feet either side of the
above described Parcel A.
is needed for the construction and servicing of the sewer main for the municipal
sewer system of the City of Edgewater, Florida.
SECTION 2. The City Council of the City of Edgewater, Florida, has considered
alternatives, but based upon engineers, determines that the lands described
in Section 1 are desired, preferred and needed routes, and so finds as a matter
of policy.
SECTION 3. Jefferson W. Clark, City Attorney for the City of Edgewater, be,
and he is hereby immediately directed to proceed and acquire the above

described property in condemnation proceedings. Jefferson W. Clark is authorized
to order title, searches and surveys which may be needed, and have an appraisal
of said property.
SECTION 4. - That this Resolution shall become effective immediately upon
its adoption.
SECTION 5. - That all Resolutions or parts of resolutions in conflict herewith be,
and the same are hereby rescinded.
The above and foregoing Resolution was presented by Councilman Ridgdill
who moved its adoption, said motion being seconded by Councilman Tingle
and upon roll call vote, the said Resolution was duly declared adopted at the
special meeting of said Council held on the 25th day of September, 1964, the vote
of said Council on roll call being as follows:
