123RESOLUTION NO. 123 A RESOLUTION AUTHORIZING AND INSTRUCTING THE MAYOR AND THE CITY CLERK TO EXECUTE A CONTRACT TENDERED TO THE CITY OF EDGEWATER BY THE FLORIDA LIBRARY AND HISTORICAL COMMISSION, SAID CONTRACT BEING AN AGREEMENT BETWEEN THE FLORIDA LIBRARY AND HISTORICAL COMMISSION, THE CITY OF EDGEWATER, FLORIDA AND THE EDGEWATER LIBRARY BOARD, SAID CONTRACT PROVIDING FOR THE JOINT PARTICIPATION OF THE FLORIDA LIBRARY AND HISTORICAL COMMISSION, THE CITY OF EDGEWATER, FLORIDA, AND THE EDGEWATER LIBRARY BOARD IN THE CONSTRUCTION OF A NEW LIBRARY FOR EDGEWATER, FLORIDA. WHEREAS, A Certain contract has been tendered to the City of Edgewater by the State of Florida, by and through the Library and Historical Commission by the terms of which the Library and Historical Commission will provide funds in the amount of $12,650.00 for the construction of a new library for Edgewater, Florida upon the condition that the City of Edgewater provide funds for the same purpose in the amount of $10,350.00 , and WHEREAS, it is felt by the City Council of the City of Edgewater, Florida that a new library is needed for the City of Edgewater and that it is to the interest of the public welfare that said library be constructed and that the said required funds be expended by the City of Edgewater therefore; NOW THEREFORE, be it resolved by the City Council of the City of Edgewater, Florida that approval is hereby given to the sum and substance of the contract and agreement attached hereto, and said agreement being tendered by the Florida Library and Historical Commission to the City of Edgewater, Florida. Be it further resolved that the City Council of the City of Edgewater, Florida does hereby approve, ratify, and confirm the said agreement and does hereby fully authorize and instruct the Mayor and the City Clerk to execute the said agreement and the Mayor and the City Clerk are hereby further authorized and instructed and empowered to execute any and all checks, drafts, or other instruments necessary to consummate and comply with the terms of the said agreement. The above and foregoing resolution was presented by Councilman Cairnie who moved its adoptiop; said me&$60tion being seconded by Councilman Behningien Upon roll call said resolution was duly declared adopted at a regular meeting of said council held on May 16, 1966. Florida, hereinafter called the City Council , and the Edgewater Library Board , hereinafter called the Board. W I TN E S 3 E T H Whereas, the Commission, administrator of federal funds provided through the Library Services and Construction Act, under the plan of operation approved by the U.S. Commissioner of Education, and - - Whereas, the City Council , acting under the authority vested in them by the Statutes of Florida, for the establishment and maintenance of a free public library, Whereas, the Board, acting under their authority for the operation of the Edgewater Public Library, Whereas, the Commission, the City Council , and the Library Board are willing to cooperate in a state-wide plan for the admin- istration of this Library Services and Construction Act program; Therefore, the parties hereto agree as follows: 1. The City Council agrees to: a. Provide unobligated funds to the amount of $ 10,350.00 to be used under the program provided for in thi¢ agreement for the construction of a Library in the city of Edgewater, Volusia County. b. Employ a building consultant approved by the Commission. The building consultant will certify to the Commission that the plan is functional, flexible and expandable. c. Employ a registered architect. d. Provide the Commission with an approved.- (1) Copy of'plans and specifications. _ (2) Inspection reports and other -information needed to earq out ' tde w ra, a, OoM1y with the requirement that all laborers and meohaniae - - e4109ad by contractors $rod subcontractors on all construction - - projects shall be paid at not less than prevailing rates as deteruined by She Secretary of Labor in accordance with. the Davis -Bacon Act, as amended, and shall receive overtime.. - 001ansaticn in accordance with the Contract Work Hours - Sta=daMs Act and that contractors and subcontractors will ' co=P17 with the provisions of 29 CFR part 3 and abide by the - contract clauses required by 29 CFA 5.5 (a). and (c). Provide - for the receipt, auditing and preservation of copy of weekly Payroll and provide for on-the-job interviewa by a qualified - -1 Person- All copies of. the weekly payrolls Will be delivered to the Caaai.esian upon completion of the local audit of the Project. .. f.
