RESOLUTION NO. 2020-R-30
A RESOLUTION OF THE CITY OF EDGEWATER,
FLORIDA; GRANTING FEE WAIVER TO HOUSING
TRUST GROUP LLC IN ORDER TO QUALIFY FOR
HOUSING TAX CREDIT FOR THE CONSTRUCTION OF
AFFORDABLE HOUSING AND AFFIRMING ABILITY TO
PERMIT IN ACCORDANCE TO FLORIDA STATUTE;
PROVIDING FOR CONFLICTING PROVISIONS, AN
EFFECTIVE DATE,AND ADOPTION.
WHEREAS, the State of Florida has a statewide housing affordability crisis, which also
manifests at the regional and local level; and
WHEREAS, the livability and viability of the City of Edgewater is directly affected by
the availability of a sufficient amount of housing affordable to all residents; and
WHERAS,the City Council desires to create opportunities to ensure a variety of housing
which bears an essential nexus to maintain the social, economic and political fabric of the
community; and
WHEREAS, it has been determined that the housing costs continue to outpace wages in
the service sector areas of the economy and has resulted in making housing unaffordable and
unobtainable for many residents working within the service and manufacturing sector within the
City; and
WHERAS, it is in the best interest of the community and legitimate government interest
to create opportunities that will attract and support of additional development of affordable
housing within the City; and
WHEREAS, in accordance with the City Comprehensive Plan in order to provide
incentives to achieve the production of safe, decent, accessible affordable housing units, the City
desires to provide a fee relief in the form of a fee waiver of either impact fees or development
permitting fees;and
WHEREAS, GOAL 2 of the Comprehensive Plans Housing Element is to ensure an
adequate supply of a wide range of housing types at various levels of affordability to
accommodate the needs of the residents of the City of Edgewater;and
WHEREAS, Objective 2.1: Adequate Housing of the Goal—Provides that the City is to
assist the private sector to provide sufficient additional dwelling units of various types, sizes and
costs needed to support the population demand during the short-range (2019-2024) and long-
range(2040)planning periods; and
WHEREAS, Objective2.2: Provides that the City is to assist the private sector and
appropriate agencies in providing safe, clean and affordable housing for current and future very
low, low-and moderate-income residents of the City of Edgewater; and
WHEREAS, Policy 2.2.6: Reducing Infrastructure Charges and Fees and Affordable
Housing. Provides that the City shall review the Land Development Code to develop incentives

to promote affordable housing by reducing the infrastructure charges and fees associated with
very low, low and moderate-income housing projects. In addition, consideration should be given
to providing funds to offset fees in situations where they cannot be reduced. The City shall
encourage the County to assist in this effort as the provision of housing needs benefits the larger
area as well as the City itself.
WHEREAS, the City Council finds that a fee waiver will be most successful as an
incentive for private sector to develop affordable housing and as such a waiver and/or grant form
from the City is required to be eligible for the private sector to seek housing tax credits and
similar grants from state and federal funding sources; and
'WHEREAS, Florida Statute 166.04151- Affordable Housing- has been amended to
allow development of housing, that is affordable as defined in s. 420.0004, on any parcel zoned
for residential, commercial or industrial; and
WHEREAS, Housing Trust Group LLC ("HTG") is seeking a $50,000 government
contribution in the form of fee waivers of either impact fees or development permitting fees in
order to compete for State Apartment Incentive Loan competitive gap financing to be used in
conjunction with non-competitive low income housing tax credits as issued by the federal
government and managed by the Florida Housing Finance Corporation ("FHFC"); and
WHEREAS, HTG is seeking affirmation the City will permit multi-family affordable
housing on appropriately located commercial or industrial zoned properties as permitted in
Florida Statute 166.04151.
NOW, THEREFORE, BE IT RESOLVED by the People of the City of Edgewater,
Florida:
Section 1. Contribution City shall commit to HTG or an affiliated single purpose
entity controlled by HTG a $50,000 grant as a government contribution for each
application stated in Section 2 below in the form of fee waivers of either impact fees or
development permitting fees in order to compete housing tax credits as issued by the
federal government and managed by FHFC. In the event that one or both of these
applications are unsuccessful in obtaining financing from FHFC, these funds will be
deobligated to be determined at the time of invitation to credit underwriting issuance for
the 2020 RFAs by FHFC anticipated to occur in July of 2021.
Section 2. Permitted City shall permit multi-family affordable housing project, as
permitted in Florida Statute 166.0415, on properties located on S. Ridgewood Ave.
currently owned by Fong Inc. and the Diocese of Orlando that are presently zoned
commercial and residential which shall be enabled to develop within the land
development regulations provided for by MF Residential R-5 zoning with apartments
density of 12 units per acre.
Section 3. Forms City Council directs the City Manager to execute the FHFC Local
Government Verification of Contribution Fee Waiver and/or Grant Form.
Section 4. BudEet Amendment City Council authorizes to the City Manager to
make appropriate budget amendments to support this initiative.

Section 5. Conflicting Provisions All resolutions or parts of resolutions in conflict
herewith are hereby repealed.
Section 6. ConflictinL) Provisions Severability and Applicability. If any portion of
this resolution is for any reason held or declared to be unconstitutional, inoperative, or
void, such holding shall not affect the remaining portions of this resolution. If this
resolution or
any provisions thereof shall be held to be inapplicable to any person, property, or
circumstances.
Section 7. Adoption and Effective Date This Resolution shall take effect upon
adoption.
