141RESOLUTION NO. 141 A RESOLUTION DECLARING THE INTENT OF THE CITY COUNCIL OF THE CITY OF EDGE - WATER, FLORIDA, TO ACCEPT TITLE TO REAL PROPERTY IN THE CITY OF EDGEWATER, FLORIDA, SAID PROPERTY TO BE DONATED BY NAT BROWN AND TO BE USED SOLELY FOR PARK PURPOSES AND TO BE MAINTAINED BY THE CITY OF EDGEWATER. WHEREAS, Nat Brown, the owner of the hereinafter described real property in the City of Edgewater, Florida, has offered to deed and convey to the city of Edgewater, as a gift, the following described real property, upon the condition that the City of Edgewater. use the said land solely for park purposes and upon the condition that the City of Edgewater will perpetually maintain the said property, and, WHEREAS, the City Council of the City of Edgewater, Florida, is desirous of accepting title to said land, with the conditions imposed upon the said gift, and, WHEREAS, the City Council of the City of Edgewater is desirous of building a park for the use by the general public upon the following described land located .in Volusia County, Florida, to -wit: Commence at the Northeasterly corner of Lot 71, Edgewater Acres Re -Subdivision Unit No. 3 as shown on map in Map Book 19, Page 152 of the Public Records of Volusia County, Florida; thence S 24 11 10 E 30 feet along the Easterly line of said Lot 71; thence N. 74 E 20 feet for the point of begin- ning; thence N 74 E 74. 75 feet to the Westerly line of Lake Street; thence S 21 49 30 E 210 feet along the said Lake Street Westerly line; thence S 74 W 66. 01 feet; thence N 24 11 10 W 211.07.feet to. thepoint ofbeginning. All lying and being in the said Edgewater Acres Re -Subdivision Unit No. 3. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: Section 1: The said City Council does hereby accept the offer of Nat Brown to deed and convey the above described real property to the City of Edgwater, Florida, said land to be used for park purposes and to be perpetually maintained by the City of Edgewater, and upon the delivery to the city of the deed conveying the above described property, the same shall be accepted and ratified. Section 2: Be it further resolved that all resolutions or parts of resolutions in conflict herewith be and the same are hereby rescinded. The above and foregoing resolution was presented by Councilman Walls , who moved its adoption, said motion being seconded by Councilman Bebbington .
