A RESOLUTION GRANTING A VARIANCE TO
KENNETH HAROLD REPEALING ALL RESOLU-
TIONS IN CONFLICT HEREWITH AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, a public hearing was held by the Edgewater
Board of Adjustments pursuant to a request by Kenneth Harold for a
variance on corner lots at Francis and Palmway, and,
WHEREAS, said variance was approved by the Board of
Adjustments and the Edgewater City Council,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF EDGEWATER, FLORIDA:
Section 1: That Kenneth Harold is hereby granted a
variance as approved by the Edgewater Board of Adjustments as set forth
in their letter dated May 12, 1978, a copy of which is attached hereto as
Exhibit "A".
Section 2: That all Resolutions or parts of Resolutions
in conflict herewith be and the same are hereby rescinded.
Section 3: That this Resolution shall take effect immediately
upon its adoption by the City Council and approval as provided by law.

SUBJECT: Variance
for Mr. Kenneth Harold, corner lots at
Frances and
Palmway.
This is an R-2 area, requiring 75 x 115 feet for each lot
and residence. Mr. Harold has divided his property, con-
sisting of 139 feet x 120 feet, into two lots. One is 74 x
120, a corner lot and the other is 65 x 120, an inside lot.
This property has been owned by Mr. Harold since before the
inception of Ordinance 880, and this was taken into considera-
tion by the Board. There was no public opposition to this
application.
Also, the homes and lots of the surrounding area were in-
spected and it was determined that many were on smaller lots
than proposed here.
On the basis of "reasonable use of property" and "practical
difficulty" of complying with 880, the Board of Adjustments
has granted the following variance:
On the corner lot: a front set back of 25 feet instead of
30 feet; a back yard set back of 19 feet
instead of 20; one foot on total width
and all other set backs normal.
On the inside lot, facing Frances Drive: front and back set
backs normal; 10 feet on total width;
side set backs of 17 feet on the North
and 8 feet on the South.
All set backs must be observed exactly as specified on the plot
plan, which was modified -at the hearing. This is to insure
that any houses built on these lots will be properly placed to
preserve the open spaces between houses generally prevelant in
this neighborhood.
The vote was 5 to 0 to grant the variance, effective three
years from date of Council approval.
